PARK AND RECREATION Memorandum from the Park and Recreation YJ COMMISSION - PROPOSED Commission setting forth the proposed ' PROGRAM FOR FIESTA program for the September 14, 1963, Fiesta, and a list of the estimated expenses was presented for Council consideration 455 Upon request of the City Clerk, Councilman Breceda moved, seconded by Councilman Sulzer that $300 00 be transferred to the Petty Cash Fund to be used for minor and immediate expenses incurred for the Fiesta to be held September 14, 1963 Motion carried unanimously COUNCILMAN MARTINEZ ARRIVED AT 7 35 O'CLOCK P M AND TOOK HIS PLACE ON THE ROSTRUM PARK AND RECREATION The City Clerk presented a memo- y5'7" COMMISSION RECOMMENDATIONS randum from the Park and Recreation Commission making several recommend- ations for Council consideration, as follows 1 The Park and Recreation requested that the Council jr& r^ adopt a policy regarding the attendance and supervision of small children in the Park and Recreation Building They felt that children under 5 years of age should be accompanied by a responsible adult or teenager No action was taken on this matter as it was the general feeling of the Council that the Park and Recreation attendants on duty could take care of the number of small children using the park facilities 2 The Park and Recreation Commission recommended that an area close to the City of Hope should be developed ✓ into a picnic area only, to serve residents of the north- east end of Irwindale and Duarte residents They felt that this should be considered in view of the fact that the area along the north side of Arrow Highway could not be developed because of the location of the high tension wises Councilman -Mayor Diaz moved, seconded by Councilman Breceda that this matter be referred back to the Park and Recreation Commission for a more detailed suggested plan as to exactly what area is involved and what type of recreation they have in mind Carried unanimously 3 Recommendation was made by the Park and Recreation /,Of, Commission that Ficus Redusa Trees be planted along the � parkway on the South Side of Arrow Highway The City Clerk stated that she had contacted Mr Spalding of the County Arboretum concerning the temperature at which the Ficus Redusa may be damaged He stated that the Golden Rain Tree or the Crape Myrtle would be most suitable to our needs, and strongly recommended the Crape Myrtle Councilman -Mayor Diaz moved, seconded by Councilman Breceda that this matter be tabled to the next meeting and requested r^ that the City Manager obtain photographs of the Crape Myrtle and the Golden Rain Tree for Council review Carried unanimously 4 Park and Recreation Commission felt that the restrooms -WY- that are located under the pepper trees be relocated nearer to the ball diamond Councilman Breceda stated that he felt that these restrooms should not be relocated at the present time Councilman Breceda moved, seconded by Councilman Sulzer, that the AUDIT The City Manager introduced Mr Osterhout of Zazueta, Osterhout and Company, C P A 's who submitted the 1962-63 Annual Audit bo the Council and made a brief verbal presentation of same He mdde reference to the General Fund Unappropriated Fund Balance and stated that in the past it had been the custom of the City to transfer these funds to the Capital Fund for Capital Projects The City Attorney presented a Resolution entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE APPROVING AND ADOPTING THE ANNUAL AUDIT FOR THE CITY OF IRWINDALE AS OF JUNE 30, 1963", and read same in full Councilman Martinez moved, seconded by Councilman Breceda that said Resolution be adopted as presented Carried unanimously Resolution as adopted is No 63-39-284 Councilman Martinez moved, seconded by Councilman -Mayor Diaz, that the City Manager be instructed to make a recommendation to the City Council as to whether the General Fund Unappropriated Balance should be transferred to the Interim Tax Reserve or the Capital Fund Carried unanimously TONY ORTIZ - REQUEST PERMIT The City Manager presented a letter 3,27 EXTENSION TO STORE HOUSES from Mr Tony Ortiz requesting an ON VACANT LOT extension of the permit issued by the vacant property on Arrow Highway The City Manager also presented a memorandum from the License and Zoning Inspector, Mr Ernie Aguirre, recommending that permission be granted to retain the house for a period not to exceed 30 days, at which time, if the house is not to be removed or demolished, a court complaint be issued against Mr Ortiz without further notification from this City Mr Antonio Silva, Irwindale Avenue, stated that he represented Mr Ortiz and that Mr Ortiz wished to offer the house in question to any resident in the City who wished to have it The only cost involved would be moving costs He stated that the costs to date are $900 00 and that it would cost approximately $300 00 to have the house moved anywhere within the City Limits of Irwindale Upon questioning by the Mayor Mr Silva stated that Mr Ortiz would not object to the City sending out Notices to all residents advising them of Mr Ortiz's offer Councilman Breceda moved, seconded by Councilman Martinez, that a 30 day extension of the permit be granted to Mr Ortiz Motion and second were amended to include, that the City Manager be instructed to send out notices of the people of Irwindale and that the 30 day extension become effective as of the date of mailing of said notice, and said notice is to include the moving costs as quoted by Mr Silva Carried unanimously CYPRESS AVENUE The City Manager presented a memo IMPROVEMENT regarding a request from the Covina Unified School District for the City to participate in costs of Street Improvements on Cypress Avenue The City Clerk stated that since this letter had been received, an additional expense would be involved concerning the relocation of light poles from the Edision Company She requested that this matter be pulled off the agenda, and re -submitted at such time as all costs are received Councilman Martinez moved, seconded by Councilman Sulzer, that this matter be tabled until all costs are presented to Council Carried unanimously of DUARTE SEWER The City Manager presented a letter ASSESSMENT DISTRICT from Mr Robert Poff, City Administrator of the City of Duarte advising that the assessments in the Sewer Assessment District No 1 in the City � of Duarte have been lowered by 15% Councilman -Mayor Diaz instructed the City Clerk to notify Y all residents on Date Street of the reduction 3y$ HIGHLAND AVENUE IMPROVE- The City Manager presented a letter from MENT - CITY OF DUARTE Mr Robert Poff, City Administrator of the City of Duarte requesting City participation in the cost of improving thht portion of Highland Avenue lying within the City of Irwindale Councilman Sulzer moved, seconded by Councilman Martinez, that a more detailed report be submitted, and that a representative from the City of Duarte be present at the next meeting to make a report and answer any questions the Council may have Carried unanimously g0 THIRD ANNUAL MUNiCIPA The City Manager presented a memo SEMINAR Q requesting permission to attend the Third Annual Municipal Seminar on September 21 and 22, 1963, at Santa Catalina Island Councilman Martinez moved, seconded by Councilman Breceda, that the request be denied Carried unanimously PROPOSED SWIMMING POOL The City Manager presented a memo to- gether with a plan for the proposed swimming pool for the Irwindale Park Councilman Martinez, seconded by Councilman -Mayor Diaz that this matter be tabled until the City Manager can get other plans for study, and can submit a yearly maintenance cost estimate Carried unanimously SERGEANTS EXAMINATIONS- The City Manager presented a memo ✓ POLICE DEPARTMENT from the Chief of Police requesting authorization to proceed with the proposed examinations for Police Sergeants The Chief of Police requested that his original request for 4 sergeants be reduced to three Councilman Breceda moved, that the request to proceed with examinations be denied Motion died for lack of a second Councilman Martinez moved, seconded by Councilman Sulzer that the examinations be given as set forth in the Chief's original memo, but that only part 1, written examination, be included in this motion Carried by the following vote of the Council Ayes Martinez, Sulzer and Mayor Diaz Councilman Breceda Absent Councilman Miranda RECESS Councilman -Mayor Diaz requested a 5 minute recess in order to answer an urgent long distance telephone call Meeting recessed at 8 57 O'Clock P M Meeting reconvened at 9 12 O'Clock P M , with the following Councilmembers present Breceda, Martinez, Sulzer and Mayor Diaz Absent Councilman Miranda SERGEANTS EXAMINATIONS Councilman Breceda made reference A�z CONTINUED to the examinations recently given to the Reserve Officers to fill the patrolmen positions open and stated that he had heard that the Chief had taken the test papers home with him The Chief of Police took personal exception to the remark, whereupon, Council- man Breceda moved that the Chief of Police be suspended for 15 days without pay Motion died for lack of a second RECESS Recess was called at 9 20 O'Clock P M , for the purpose of entering into an Executive Session to discuss Councilman Breceda's complaint of the Chief of Police Meeting reconvened at 9 55 O'Clock P M with the following Councilmembers present Breceda, Martinez, Sulzer and Mayor Diaz Absent Councilman Miranda SERGEANTS EXAMINATIONS Following the recess, Mayor Diaz Izz CONTINUED stated that the difference between " Councilman Breceda and the Chief of Police had been settled somewhat to the satisfaction of both The Chief of Police stated that he was on record as apologizing to Councilman Breceda Councilman Sulzer moved, seconded by Councilman Martinez, that the Chief of Police select and submit to council 5 names of persons he would like to have serve on the Oral Board for the Sergeants examinations, and that the City Council shall then select three of the five to serve on the board Carried unanimously POLICE DEPARTMENT OVER- The City Manager presented a memo TIME AUTHORIZATION from the Chief of Police concerning Overtime Authorization in the Police Department Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that this matter be tabled until the next meeting at which time the City Clerk is to present a report of the Police Department hours over the past year Carried unanimously AREA "D" CIVIL DEFENSE The Chief of Police presented a memo 5y concerning a request from Civil Defense concerning allocation of sufficient space within our new facility Councilman Martinez moved, seconded by Councilman -Mayor A^ Diaz, that this matter be tabled until such time as the plans for I the new City Hall and Police Department are actually finalized Carried unanimously OFFICER LELAND B HALL The Chief of Police presented a memo REQUEST FOR LEAVE OF from Police Officer Leland B Hall, ABSENCE requesting a 6 month leave of absence to accept a position in another City Councilman Martinez moved, seconded by Councilman Breceda, that inasmuch as Officer Hall had previously submitted his resignation and same had been accepted, that the request be denied Carried unanimously COUNCIL POLICY REGARDING INJURED ON DUTY PAY inured on duty The Chief of Police presented stating that Council Policy be determined concerning pay for a memo G employees 459 0 Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that any employee, regardless of what department he is in if injured on duty be allowed to borrow against his sick leave and vacation time up to one year So as to make up the difference between what the employee receives from Workman's compensation and their regular take home pay The City Attorney stated that he did not believe the City could this since workman's compensation was payinj a percentage of the take home pay, and this may affect what workman s compensation would pay Councilman -mayor Diaz withdreq his motion and Councilman Martinez withdrew his second Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that this matter be tabled until such time as the City Attorney can check into the matter and advise Council of what can be legally done The mayor further stated that should there be a legal way to accomplish, this, he would be happy to call a Special Meeting to take action Carried unanimously �i,,RESIGNATION OF POLICE The Chief of Police presented the OFFICER GARZA Resignation of Police Officer Albino Garza, and requested permission to fill the vacancies created by the resignations of both Officers Garza and Hall Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that the resignation of Mr Garza be accepted, and that the vacant positions be filled withe next men in line Motion and second were amended to include that a letter of Commendation be sent to Mr Garza Carried unanimously POLICE DEPARTMENT The Chief of Police stated that the RADIO SYSTEM Federal Communications Commission had issued an order making it ' mandatory that as of October 1, 1963, that all Police channels be separated He requested that he be authorized to negotiate with Motorola to accomplish this and to use the $5,000 00 set up for this purpose in the budget Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that bhis matter be tabled to the next regular meeting for further discussion Carried unanimously ORDINANCES FIXING CHARGES FOR The City Attorney presented an CONNECTING TO SEWERS Ordinance entitled "AN ORDINANCE ON HIDALGO AND JUAREZ OF THE CITY COUNCIL OF THE CITY STREETS OF IRWINDALE FIXING CHARGES FOR CONNECTING TO SEWERS ON HIDALGO AND JUAREZ STREETS, TIMES AT WHICH SUCH CHARGES SHALL BE DUE, THE MANNER IN WHICH THEY SHALL BE PAID, THE RATE OF INTEREST THEREON, THAT SAID CHARGES AND INTEREST SHALL CONSTITUTE A LIEN AGAINST THE BENEFITED LOTS AND SETTING A HEARING THEREON," and read same by title The City Attorney also presented a memo regarding this and explained that the Council should decide if they want to charge the residents, if so, how much, should they pay cash or installments, and if installments, how long a period of time, and when a public meeting should be held Councilman Martinez moved, seconded by Councilman Sulzer, that the charge per foot would remain at $5 90 as stated in the ordinance and that the interest rate will be nil Carried unanimously Councilman -Mayon Diaz moved, seconded by Councilman Martinez, that this be payable over a period of 15 years Carried unanimously Councilman Sulzer moved, seconded by Councilman Martinez, that the public hearing be held on October 7, 1963 at 7 00 P M in the Council Chambers Carried unanimously 461 It was decided to hold over the ordinance until after the Public Hearing is held, and the City Clerk is to send Notices of the Public Hearing to all residents on Hidalgo and Juarez RESOLUTIONS CALLING AND GIVING NOTICE The City Attorney presented a All ✓ OF SPECIAL ELECTION - Resolution entitled "A RESOLUTION �S ZONING ORDINANCE & MAP OF THE CITY COUNCIL OF THE CITY OF IRWINDALE CALLING AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON OCTOBER 29, 1963," and read same by Title r„ Councilman -Mayor Diaz moved, seconded by Councilman Martinez, that further reading of the resolution be waived Carried unanimously Councilman Martinez moved, seconded by Councilman Sulzer that said resolution be adopted as presented Councilman Breceda referred to a court case pending in the City of San Bruno regarding the adoption of their master plAn Councilman Sulzer moved, seconded by Councilman Martinez, that this matter be tabled until such time as the City Attorney brings in a written legal opinion concerning the City of San Bruno and the possible effect it may have on the City of Irwindale's adoption of the Zoning Map and Ordinance Carried unanimously Because of the proceedings action, the association resolutions concerning authorization of councilmembers to file written arguments for and against a city measure were tabled also HIGHWAY USERS TAXES The City Attorney presented a resolution AND FEES entitled "A RESOLUTION OF THE CITY s s COUNCIL OF THE CITY OF IRWINDALE ACCEPTING THE IMPOSITION OF ADDITIONAL HIGHWAY USERS TAXES AND FEES PURSUANT TO CHAPTER 1852, STATUTES OF 1963", and read same by title Councilman Breceda moved, seconded by Councilman Martinez that further reading of the resolution be waived Carried unanimously Councilman Martinez moved, seconded by Councilman Sulzer, that said Resolution be adopted as presented Carried unanimously Resolution as adopted is No 63-40-285 OTHER MATTERS REPORT OF POLICE The City Manager presented a report �2z TRAINING SESSION from Mayor Diaz and Councilman Sulzer regarding the Police Training Session, and the City Clerk apologized for not getting copies of this reper t to the councilmembers sooner Councilman -Mayor Diaz moved, seconded by Councilman Sulzer, that this matter be tabled to the next meeting in order to give the councilmembers time to study each individual item Carried unanimotaly EMPLOYEE QUALIFICATION Councilman -Mayor Diaz stated that 6 previously a resident had been disqualified for employment in the City, and that information had come to him whereby the disqualification may be lifted He stated that he would contact Mr s Young and give her the name of the person involved Councilman -Mayor Diaz moved, seconded by Councilman Martinez than an evaluation be made regarding the eligibility of employment of the person concerned Carried unanimously POLICE DEPARTMENT PERSONNEL Councilman Breceda stated that he PROBLEM - LIE DETECTOR TEST understood that one of the Police Officers in the City had made a complaint in a neighboring city against 2 other officers in the City of Irwindale, and he felt that his matter should be investigated by our own department He stated that since there were 3 officers involved, one of them was lying Councilman Breceda moved, seconded by Councilman -Mayor Diaz, that the three officers involved be required to take a lie detector test and that the one that refuses to take the test be fired from the department After some discussion Councilman -Mayor Diaz withdrew his second because he felt it amy interfere with a persons consi.tutional rights Councilman -Mayor Diaz again seconded the motion pending a legal opinion from the City Attorney as to whether or not the men's constitutional rights were being violated Carried unanimously J HIDALGO & JUAREZ Councilman Martinez moved, seconded by STREET NUMBERING Councilman Sulzer, that the matter of having numbers put on the curbs on Hidalgo and Juarez be considered by the City Council Carried unanimously City Manager to investigate and report to Council HIDALGO & JUAREZ FENCES Councilman Sulzer stated that he had j received complaints from some of the residents of Hidalgo and Juarez Street, thr the fences were not to the satisfaction of the residents Councilman Sulzer moved, seconded by Councilman Martinez that tb3s ,job not be signed off until the property owners on these streets are satisfied Carried unanimously Mrs Young stated that there were several items not included in the contract which would be brought to Council's attention later ADJOURNMENT Upon motion, meeting was adyeu�ned at 11 17 O'Clcok P M d at
