Also present City Manager Douglas Flautt, City Attorney Martin, City Engineer W J Lockman, City Clerk M Barbosa, and Chief of Police E Aguirre APPROVAL OF MINUTES OF PREVIOUS MEETINGS The minutes of January 26, 1972, regular adjourned meeting, which had been tabled for corrections, were presented for approval The City Clerk advised the Council that she had checked the tape of this meeting, and the correction that Councilman Breceda requested on Page 7, under request for legal assistance for Councilman Breceda, first paragraph, after "matters", add 'for other councilmen and different people in the community when they are involved in litigation' Councilman Breceda moved, seconded by Mayor Chico to approve minutes, as corrected Carried by the following vote Ayes Councilmen Breceda and Chico, Noes Councilmen None, In abstention Councilmen Diaz, Absent Councilmen Mike and Pat Miranda It was noted that the minutes of February 24, 1972, regular meeting, were pending PUBLIC HEARING BATEMAN AVENUE L Public Hearing continued from ASSESSMENT DISTRICT November 11, 1971, to consider the formation of Bateman Avenue Assessment District The City Manager presented an estimated cost for water, sewer, and Lighting, as directed by the City Council, for the Bateman Avenue Assessment District In summary, the total costs involved are $69,000 for water, �^ $90,000 for sewer, and a monthly electric rate increase of $50 It would appear that any type of expenditure of this magnitude would be premature because the area is not developed to what its potential is and the real water and sewer needs cannot be accurately planned In addition to this, the present assessed value of the land cannot absorb this expense, plus the $195,000 for streets, curbs and gutters Questions were directed to the City Engineer by the City Council regarding the costs involved and the need for these improvements, also, how many property owners were in favor of this improvement 174 Regular City Council Meeting March 9, 1972 Mr Lockman, City Engineer, stated the cost for this improvement would be $13 per front foot About 78% of the property owners were for this improvement As a matter of information, 17 parcels were involved, which were to be assessed Seven (7) parcels, which is 42% were protesting, fifteen (15) different parties were involved Upon question from Councilman Breceda, Mr Lockman described the area involved in this assessment district, and stated that this improvement did not involve any of the homes Upon question from the City Council, Mr Lockman stated that he felt this improvement would definitely upgrade and increase the value of the property Councilman Diaz personally felt that in view of all the information submitted, that area did need upgrading and improving It presently is an eyesore for the people living in the westerly area There is a definite need for lighting due to the crime problem, therefore, would like to see this matter continued Councilman Diaz moved, seconded by Mayor Chico to continue this hearing to the next meeting Carried unanimously COMMISSION CONSIDERATION PARK & RECREATION The Park & Recreation Commission COMMISSION MINUTES P minutes of congressional district Lines, and requesting to meet with members of the City Council to discuss matters of mutual interest The City Manager was instructed to set up a meeting with Congressman Rousselot to meet with the City Council ORAL PUBLIC APPEARANCES CITY PLAQUES j, ✓ Robert Anderson, Osborne Kemper Thomas Inc , 338 W Badillo Avenue, Covina, appeared and presented a plaque that had been prepared for the City t 1 175 Regular City Council Meeting March 9 1972 Upon question from the City Council, Mr Anderson presented prices, and the Mayor displayed and described the plaque After discussion, the City Council felt that all councilmembers should be present to see the plaque CITY MANAGER ANALYSIS OF BIDS The City Manager stated that at FOR POLICE CARS the last meeting of the City Council two (2) bids for furnishing three (3) police units were received and opened Of the two (2) �. bids there was only one valid, as the other bid did not specify a trade-in allowance The staff recommended that all bids be refused and that the City broaden its procedure for replacing the police units by considering the following a) other makes of cars, as well as Plymouths, b) Leasing of cars, c) Joint purchase with the State of California (Dodge highway patrol units) After discussion, the City Manager was instructed to call for bids again on options "a" and "b" There were no objections AUDIT REPORT ON EXCAVATION �F`" Matter to be discussed in an TAX, & GROSS RECEIPTS AUDIT executive session ON DUMP OPERATIONS The City Attorney advised the City Council that the reason being that this might entail a law suit PROPOSAL FOR PARK !NJ ✓ The City Manager requested that FENCE this matter be tabled to the next meeting, since he is having difficulty obtaining proposals for the wrought iron fence There were no objections REPORT ON PROPOSALS FOR The City Manager presented a full ENGINEERING SEWER LINE report on the five (5) proposals ON ARROW HIGHWAY the City received to perform the necessary engineering work for the installation of some 800 feet of sewer on Arrow Highway from Irwindale Avenue westerly The City Manager had recommended that H M Scott, the low bidder be awarded this work, however, since that time Mr Scott had withdrawn from the project After reading the letter sent by the City Manager requesting for bids, it was decided that it was not too clear that this would be sealed bids Councilman Diaz moved, seconded by Councilman Breceda to call for bids again and spell out that they should be sealed bids Carried unanimously Councilman Breceda asked the City Manager for the record if this was the first time engineering bids had been received from the Engineer The City Manager stated that the Engineer had preceded his tenure here in the City and did not have any knowledge of what went on prior to that time 1'76 Regular City Council Meeting March 9, 1972 REQUEST FROM CORP OF / tip v As recommended by the City Council ENGINEERS TO ABANDON at the first meeting in January, A PORTION OF BUENA the City Manager had contacted the VISTA STREET Corp of Engineers to determine whether the City could have the right of first refusal when the parcel was sold The City Manager recommended that the City notify the Corp of Engineers that the City does have a continuing need for the parcel Matter tabled to the next meeting REPORT ON MINI PARK IN Matter held over until Councilman NORTHWEST SECTION OF Mike Miranda is present, since he IRWINDALE is the member of the Council appointed to report on this matter REPORT ON NEED FOR ✓ As recommended by the City Council, ' PROPERTY APPRAISAL the City Manager stated that he FOR BUILDINGS AND had reviewed the City's insurance EQUIPMENT coverage for buildings and equipment After investigation, it has been determined that this fob should be done by a regular established industrial appraising firm The initial cost for such a survey would be between $800 to $900, and then about $100 annually to update the records Mayor Chico moved, seconded by Councilman Breceda to authorize the City Manager to hire a firm to go ahead with this appraisal at a cost not to exceed $900 Carried unanimously PROPOSALS FOR MAINTENANCE _ The City Manager stated that the OF HEATING & AIR 3y3 City's maintenance service contract CONDITIONING EQUIPMENT will expire in April, 1972, therefore, had prepared a maintenance proposal for the existing units and new equipment Based on this proposal he had received quotations from seven (7) companies The second low bidder is presently under contract with the City, therefore, the staff would recommend that his contract be upgraded to include the new equipment, and that his retainer be increased from $50 to $60 , as per his bid Councilman Diaz moved, seconded by Councilman Breceda to accept the recommendation of the City Manager and retain Air Conditioning Service & Maintenance to maintain all heating and air conditioning equipment Carried unanimously REQUEST FROM SAN GABRIEL 22 D` The City Manager presented a request VALLEY TRIBUNE RE ANNUAL dD from the San Gabriel Valley Tribune SPECIAL EDITION to participate in their annual special edition The City Manager stated that a representative from the Tribune was to be present tonight, therefore, matter tabled to the next meeting until a representative is present ACCEPTANCE OF IRWINDALE M6 AVENUE LANDSCAPING PROJECT Council that he was recommending and final payment A memorandum dated March 8, 1972, was presented from W J Lockman, City Engineer, advising the City this project for final acceptance 177 Regular City Council Meeting March 9 1972 The final payment due is in an amount of $629 02 The 10% retention of $11,731 11 would be due the contractor after expiration of the 35 day lien period He presented the final payment certification and the letter of approval by the Landscape Architect A letter dated March 2, 1972, was presented from Mr Armand Ramirez, landscape architect, stating that on this date he had completed final inspection and found that the contractor, Landscape Services, Inc , had corrected or replaced all items as per their inspection, Tuesday, February 29, 1972, and subsequent correction list Mr Ramirez was therefore notifying the City that he was accepting the landscape work as per their mutual plans and specifications Councilman Diaz moved, seconded by Councilman Breceda to approve final payment Carried unanimously Mr Martin, City Attorney, stated he had been contacted by the contractor, Landscape Services, Inc , and the contractor was under the assumption that the project had been accepted 60 days ago, not only for the purpose of maintenance, but also for payment of their 10% retention There appears to be some misunderstanding, meanwhile, the contractor stated that waiting 35 days for the 10% retention would constitute a hardship Possibly the Council could authorize payment of a portion of the $12,000 , based on releases from the sub -contractors Councilman Diaz moved, seconded by Councilman Breceda to accept the recommendation of the City Attorney and authorize payment of half of the 10% retention amount that is now outstanding, only if the subcontractors sign releases Carried unanimously REPORT ON MERIDIAN gNl ✓ It was suggested that this matter be STREET IMPROVEMENT held over until Councilman Pat Miranda is present Councilman Breceda did not feel this should be delayed any further, since this matter had been brought up in the past Upon question from Councilman Breceda, the City Engineer stated that this project had been under consideration before, but the petitions were not signed by 100% of the property owners The City Engineer was instructed to bring a full report, including the petitions for Meridian, Date, Shrode, and Mountain Avenue EXECUTIVE SESSION x The City Council adjourned to an executive session at 9 p m , to discuss the excavation tax audit and audit of dumping operations within the City Meeting reconvened at 9 30 p m , with the following councilmembers in attendance Present Councilmen Breceda, Diaz and Chico, Absent Councilmen Pat and Mike Miranda OTHER LEGAL MATTERS IRWINDALE v CLEVELAND �7 The City Attorney presented a letter (PARCEL 38 - Ester Silva) dated March 8, 1972, and stated that the party involved was having considerable hardship Mayor Chico felt it was a very fair amount, and he concurred with Councilman Diaz that it should be settled tonight, in spite of the controversy involved 178 Regular City Council Meeting March 9, 1972 Councilman Breceda also brought out that other property owners had not been paid, therefore, Attorney Martin to check into this Councilman Diaz moved, seconded by Mayor Chico to authorize payment in the amount of $12,440 00 on parcel 38, and exclude the 38' strip to be paid until it is determined who the true owner is For point of clarification, Mayor Chico advised Councilman Breceda that this did not involve his family Motion carried by the following vote Ayes Councilmen Diaz and Chico, Noes Councilmen None, In abstention Councilmen Breceda, Absent Councilmen Mike and Pat Miranda BUDGET FOR ANNUAL �`r The City Manager presented a FIESTA tentative budget for the Annual Fiesta to be held on September 16, 1972, which will be the City's Fifteenth Anniversary He pointed out that this budget did not include any expenses for the usual children's King and Queen Contest, the Queen Contest or the Parade Mayor Chico moved, seconded by Councilman Breceda to approve tentative budget for the fiesta in the amount of $1,950 Carried unanimously REIMBURSEMENT OF g a Councilman Diaz moved, seconded by PETTY CASH Councilman Breceda to approve reimbursement of petty cash Carried unanimously COUNCILMEN ITEMS "CITY INDUSTRIAL Councilman Diaz requested discussion COMMITTEE" °i regarding the formation of a "City Industrial Committee" Councilman Diaz stated that his concern had always been to utilize the City's vacant land property He had dust received a favorable report regarding the property previously occupied by American Hoist, it was going to be occupied again The City should try to entice different businesses, and much has to do with the climate that has been provided He felt the climate was much better today and felt that a committee composed of members of the City Council, staff, and industry should sit together to talk over community problems, and ways of enticing industry Councilman Breceda felt it was a good idea, and also felt that while looking into this that the City's regulations should be enforced and landscape some of the eyesores in some of these pits Councilman Breceda further stated that in regards to that some interested people from the community should play a part in this and have small businessmen included The City Manager was instructed to provide the Council with some ideas or suggestions on how to proceed with forming this committee, such as, how many members, purposes and goals Mayor Chico stated that along these lines, he felt it was a mistake for not having appointed at least one Planning Commissioner to serve in the Rehabilitation Committee, which makes for better communications 179 Regular City Council Meeting March 9, 1972 There were no objections to have the Planning Commission appoint one of the commissioners to attend the next rehabilitation
