HomeMy WebLinkAbout10/11/2001CITY HALL CONFERENCE ROOM OCTOBER 11, 2001 5050 N IRWINDALE AVENUE THURSDAY IRWINDALE, CALIFORNIA 91706 5 30 P M The Irwindale CITY COUNCIL met in special session at the above time and place ROLL CALL Present Councdmembers Patrrcio S Miranda, Rosemary M Ramirez, Manuel R Garcia Mayor Pro Tem Joseph F Tapia, Mayor Mark A Breceda (arrived at 5 48 p m ) CLOSED SESSION At 5 30 p m , Council convened in Closed Session RECESS At 5 42 p m , Council recessed to Open Session in the Council Chambers MICHAEL Michael Montgomery, attorney for Valley Vista Services, MONTGOMERY explained his belief that the reason his client David M Perez who is the Operations Manager of the Recycling Center in the City of Industry, was late to the pre -submission conference is not relevant since the meeting was not specified as mandatory in the bid packet and there was no indication in the bid packet of penalties for not attending the conference However, he continued to explain that a serious injury accident occurred at 10 00 a m , at the recycling center requiring Mr Perez to stay at the scene until it was taken care of He indicated that the conference began at 1 00 p m and Mr Perez arrived at 3 00 p m He further stated his contention that since the bid packet was accepted it was apparently done correctly, and if his client did not comply with a certain requirement, he would have been notified Mr Montgomery continued to advise that he received a letter from the City Attorney s office offering to return the packet, however, he indicated his preference that the packet and the cashiers check not be returned He also stated that any problem that was caused by Mr Perez s lateness was cured since the bid packet and check were submitted properly and accepted Michael Montgomery continued to express his opinion that the purpose of receiving contracts is to receive the best arrangement for the business community and stated his belief that no purpose would be served by excluding his client s bid He also stated that if Valley Vista submitted the best overall proposal, including the lowest bid then that would be the best for the business community Further, he said that he would like to avoid a disqualification on a technicality for the purpose of benefiting one or more of the other bidders on a pre-bid basis, since that would not be proper and may lead to personal WJ CITY COUNCIL MINUTES SPECIAL MEETING OCTOBER 11, 2001 PAGE 2 liability He then requested the bid packet and check to be considered with the other bids CITY ATTORNEY City Attorney Aleshire advised the Council that, after having ALESHIRE heard these comments, it may return to Closed Session RECONVENE At 5 49 p m , Council reconvened in Closed Session to discuss the following Conference with Legal Counsel — Anticipated Litigation Pursuant to California Government Code Section 54956 9 Number of Cases Three ACTION Status report given on two cases, no reportable action taken Conference with Legal Counsel — Existina Litigation Pursuant to California Government Code Section 54956 9 Name of Case United Rock v City of Irwindale Case No BS032524 ACTION Status report given no reportable action taken Conference with Labor Negotiator Pursuant to California Government Code Section 54957 Agency Negotiator City Manager Employee Organization Irwindale Public Works Employees Association ACTION Not discussed Public Employment Pursuant to California Government Code Section 54957 Title Receptionist Clerk ACTION Status report given, no reportable action taken Public Emplovee Performance Evaluation Pursuant to California Government Code Section 54957 Title City Manager ACTION Status report given, no reportable action taken CITY COUNCIL MINUTES OCTOBER 11, 2001 SPECIAL MEETING PAGE 3 Public Employee Discipline/Dismissal/Release (2) Pursuant to California Government Code Section 54957 ACTION Status report given no reportable action taken RECESS At 6 29 p m , Council recessed to open session RECONVENE At 7 08 p m , Council reconvened in closed session COUNCILMEMBER At 7 08 p m , Councdmember Miranda excused himself from MIRANDA the meeting ADJOURNMENT Subsequent to reporting the above action and there being no further business to conduct, the meeting was adjourned at 8 22 pm u Mark A Breceda, Mayor ATTEST Li a J Kim ro CM eputy City C erk Approved as submitted at the meeting held February 7, 2002 W �. and Linda Kimbro, Deputy City Clerk ANNOUNCEMENTS COUNCILMEMBER Counalmember Ramirez announced that State Senator RAMIREZ Gloria Romero will be present at the Ayutla Market on Saturday October 13, 2001, between 10 00 a m and 12 00 �^* p m , to discuss the services her field office provides She will be available to answer questions regarding such subjects as senior programs and grant funding Counalmember Ramirez also announced that the Mayor s Cup Race will be held on Saturday, October 13, 2001, at the Irwindale Speedway, and invited the public to attend CITY MANAGER City Manager Blancarte announced that the presentations BLANCARTE relating to the fundraising efforts from the Police and Recreation Departments for the victims of the September 11 u, terrorist attack have been postponed to the next City Council meeting due to a tragic incident in the community COUNCILMEMBER Councilmember Ramirez congratulated Mike Rados on his RAMIREZ appointment as Public Works Manager MAYOR BRECEDA Mayor Breceda also congratulated Public Works Manager Rados on his appointment PUBLIC WORKS Public Works Manager Rados thanked the Council for its MANAGER RADOS support and said that he appreciates the opportunity to serve in a more responsible position CITY COUNCIL MINUTES REGULAR MEETING PROCLAMATIONS/ COMMENDATIONS/ PRESENTATIONS OCTOBER 11, 2001 PAGE 2 PRESENTATION Jane Faulker, Director of Public Information and Community RELATING TO Relations, Mt San Antonio College presented a video report SUPPORT FOR in support of'Measure R, a bond measure in the amount of MEASURE R $221 million to support local colleges CITY MANAGER City Manager Blancarte reminded Council about the BLANCARTE Resolution on the Consent Calendar in support of Measure R PRESENTATION TO Mayor Breceda presented a Certificate of Appointment to ALFONSO F CRUZ - Alfonso F Cruz, Administrative Hearing Officer The Council ADMINISTRATIVE also recognized Mr Cruz's dedication and commitment to HEARING OFFICER the City and thanked him for his service ALFONSO F CRUZ In response to a question from Councilmember Ramirez Alfonso Cruz explained that his duty as Administrative Hearing Officer consists of determining whether or not an individual is guilty when he/she contests a parking violation ticket RECOGNITION OF Mayor Breceda advised that the recognition of volunteer VOLUNTEER EFFORTS efforts of Irwindale Police Officers Association and OF IRWINDALE POLICE Recreation Department staff in fundraising for the WTC OFFICERS Police Disaster Relief Fund will be continued to the ASSOCIATION AND meeting of October 25 2001 RECREATION DEPARTMENT SPONTANEOUS COMMUNICATIONS BILL BACA Bill Baca, Field Representative for State Senator Gloria Romero, introduced himself and encouraged anyone with issues to contact the Senator CITY MANAGER City Manager Blancarte thanked Bill Baca for being present BLANCARTE at the Council meeting and said that he looks forward to seeing Senator Romero at future PROTECTIVE EQUIPMENT FOR EMERGENCY FIRST RESPONDERS COUNCILMEMBER In response to a question from Councdmember Ramirez RAMIREZ Finance Director De Dios advised that the funds that would be taken out of the general fund would be reimbursed by a grant funded by the State of California RESOLUTION Resolution No 2001-58-1778, entitled NO 2001-58-1778 ADOPTED A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE APPROPRIATING FUNDS TO PURCHASE PERSONAL PROTECTIVE EQUIPMENT FOR EMERGENCY FIRST RESPONDERS was passed, approved, and adopted, reading by title only and waiving further reading thereof, on the motion of Councdmember Ramirez, seconded by Mayor Pro Tem Tapia, and unanimously approved NEW BUSINESS ITEM NO 2A INCLUSION OF ADDITIONAL DECORATIVE TRAFFIC INCLUSION OF LIGHT POLES / ARROW HIGHWAY PROJECT (Requested ADDITIONAL by Councdmember Ramirez) DECORATIVE TRAFFIC LIGHT POLES / ARROW HIGHWAY PROJECT CITY COUNCIL MINUTES REGULAR MEETING OCTOBER 11, 2001 PAGE 6 COUNCILMEMBER Councdmember Ramirez requested that the light poles along RAMIREZ Irwindale Avenue that have not been improved be included as part of the fob description for the Arrow Highway improvement project MAYOR BRECEDA Mayor Breceda advised that the original plan for the improvement project was to beautify the area surrounding the Civic Center He suggested that painting the existing poles might be more efficient CITY MANAGER City Manager Blancarte explained that it would be BLANCARTE impractical to paint the poles DIRECTOR OF PUBLIC Director of Public Works Tam confirmed that the cost of re - WORKS TAM painting the existing poles would be very close to the amount of money required to purchase new poles MOTION A motion was made by Counalmember Ramirez, seconded by Mayor Pro Tem Tapia, to refer this item to staff for a cost analysis of options, including the number of light poles that would be affected The motion was unanimously approved MAYOR PRO TEM In response to a question posed by Mayor Pro Tem Tapia, TAPIA Director of Public Works Tam advised that the safety lights that belong at the top of the traffic signals will be installed next week ITEM NO 213 INCREASE SALARY FOR ADMINISTRATIVE HEARING INCREASE SALARY OFFICER (EXAMINER) (Requested by Mayor Breceda) FOR ADMINISTRATIVE HEARING OFFICER MAYOR BRECEDA Mayor Breceda expressed his belief that, since increases of salary have been given to many current employees, the Administrative Hearing Officer (Examiner) also deserves an increase in salary, from $35 to $50 per hearing CITY ATTORNEY City Attorney Aleshire advised that the salary increase ALESHIRE should be made in the form of a resolution MOTION A motion was made by Mayor Pro Tem Tapia, seconded by Councdmember Ramirez, to direct staff to return with a
