HomeMy WebLinkAbout58-16-68CITY OF Iff,4INDALE LOS ANGELES COUNTY, CALIFORNIA RESOLUTION No. 58-16-4u A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE CANVASSING ELECTION RETURNS AND DECLARING RESULTS. The City Clerk reported that the returns of the regular general munici§al election held on Tuesday, the 8th day of April, 1958, in the City of Irwindale, California, were then and had been in his possession in the envelopes containing them in the same condition as when received. Said City Clerk then presented said returns to the City Council as this meeting. It was thereupon moved by Mayor Ornelas and seconded by Councilman Martinez that the City Council proceed forthwith to canvass the returns of the general munipipal election held in the City of Irwindale, California, on Tuesday, the 8th day of April, 1958. The said motion was carried and adopted by the following vote: Ayes: Councilmen Barbosa, Diaz, Martinez, Miranda, Ornelas Noes: Councilman None Absent: None Said motion having carried, the City Council then proceeded forthwith to publicly examine and canvass the said returns, all as provided by law. Upon the completion of said canvass by said Council, it was moved by Councilman Martinez, and seconded by Councilman Miranda, that the follow- ing resolution be adopted: WHEREAS, there was held and conducted in the City of Irwindale, County of Los Angeles, State of California, on Tuesday, the 8th day of April, 1958, a regular general municipal election of the qualified voters of said City, under and pursuant to, and as required by the provisions of the laws of the State of California relating to General Law Cities, for the purpose of electing the following officers of said City, to wit: Three members of the City Council of said City for the full term of four years; and WHEREAS, there was also submitted to the qualified electors of said City at said election, and appeared upon the ballots at said election above referred to, pursuant to the law in such case made and provided, the following question or measure, to wit: Shall the members of the City Council of the City of Irwindale receive YES compensation in the amount of $50.00 peit month? NO and WHEREAS, it appears that notice of said general municipal election was duly and regularly given; that there was one voting precinct established within the said City for holding said election, consisting of a consolidation of the regular voting precincts Nos. 1, 3, 4, 5, 6 and 7 established by the Board of Supervisors of Los Angeles County, California for the holding of general state and county elections; that eledtion officers were appointed and election supplies furnished; and that in all respects said election was held and conducted, and the votes cast thereat received and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the laws of the State of California relating to General Law Cities, and pursuant to all laws of said state and of said City in such case made and provided; and WHEREAS, the City Council of said City of Irwindale met in the Council Chamber of said City Council in the City Hall of said City on Tuesday, the 15th day of April, 1958, as provided by law, beginning at the hour of 7:30 o'clock P. Y. of said day, to canvass the returns of said general municipal election and declare the results thereof, where- upon the said Council found that the number of votes cast in the voting precinct, the names of the persons voted for, the office to fill which each person was voted for, the results of said election, and the other matters required to be determined by law, to be as hereinafter stated. NOW, THEREFORE, THE CITY DOUNCIL OF THE CITY OF IRWINDALE, DOES HEREBY RESOLVE, DECLARE, FIND, AND DETERMINE AS FOLLOWS: SECTION 1. That said general municipal election was held and conducted in said City of Irwindale, California, on Tuesday, the 8th day of April, 1958, in time, form, and manner as required by law. SECTION 2. That there was one voting precinct establishing within said City for the purpose of holding said general municipal election, consisting of a consolidation of the regular voting precincts estab- lished by the Board of Supervisors of Los Angeles County, California, for the holding of general state and county elections, as follows: Voting Precinct No. 1, comprising State and County Precincts Nos. 1,'Y3, 4, 5, 6 arot�?, the polling place of which was at 5140 North Irwindale Avenue, in said City. SECTION.3. That (a) the whole nnunber of votes cast in said City of Irwindale at said election; (b) the names of the persons voted for; (c) the office to fill which each person was voted for; (d) the number of votes given at said precinct; and (e) the number of votes given in said City to each person are as hereinafter set forth in this resolution. SECTION 4. That the whole number of ballots cast in said voting precinct in said City at said regular general municipal election was 177 ballots, and that the whole numberof absent voters' ballots case was 0 ballots. SECTION 5. For member of the City Council of the City of Irwindale, for the full term of four years, the, following persons received the number of votes hereinafter indicated: (1) That Henry V. Barbosa received for member of the City Council of said City for the full term of four years, a total of 77 votes in the voting precaact at said election, and 0 absentee votes. (2) That Richard C. Breceda received for member of the City Council of said City for the full term of four years, a total of 69 votes in the voting precinct at said election, and 0 absentee votes. (3) That Richard L. Diaz received for member of the City Council of said City for the full term of four years, a total of 84 votes in the voting precinct at said election, and 0 absentee votes. (4) That Justin Garcia received for member of the City Council of said City for the full term of four years, a total of 83 votes in the vcting precinct at said election, and 0 absentee votes. (5) That Mike Miranda received for member of the City Council of said City for the full term of four years, a total of 78 votes in the voting precinct of said election, and 0 absentee votes. (6) That Mrs. Luisa F. Silva received for member of the City Council of said City for the full term of four years, a total of 90 votes in the voting precinct at said election, and 0 absentee votes. SECTION 6. That the question or measure voted upon at said election; the number of votes given at said precinct and in absent voters' ballots for and against said question or measure; and the total number of votes given in said City and in said absent voters' ball&ts, for and against said question or measure, are as follows: The question or measure appearing upon the ballots at�said election was the following question or measure, to wit: Shall the members of the City Council of the City of Irwindale YES receive compensation in the amount of $50.00 per month? 110 That the whole number of votes cast in said City at said election on said question or measure was 149 votes; and that the number of votes given at said precinct for and against such question or measure was as follows: That the total number of votes given in the voting precinct in said City at said election for "Yes", or in favor of said question or measure, was 130 and 0 absentee votes were cast; and that the total number of votes given in the voting precinct in said City at said election for "No", against or not in favor of said question or measure, was 19 and 0 absenteexotes were cast. SECTION 7. That said City Council does therefore hereby further resolve, declare, find and determine that at said regular general municipal election: (1) That Mrs. Luisa F. Silva is the candidate for the office of member of the City Council of the City of Irwindale, California, for the full term of four years, who received the highest number of votes cast in said precinct for said office, and that there— fore said Mrs. Luisa F. Silva was elected and is hereby declared elected to the office of member of the City Council of the City of Irwindale, California, for the full term of four years. (2) That Richard L. Diaz is the candidate for the office of member of the City Council of the City of Irwindale, California, for the full term of four years, who received the second highest number of votes cast in said precinct for said office, and that therefore said Richard L. Diaz was elected and is hereby declared elected to the office of member of the City Council of the City of Irwindale, California, for the full term of four years. (3) That Justin Garcia is the candidate for the office of member of the City Council of the City of Irwindale, California, fhn the full term of four years, who received the third highest number of rotes cast in said precinct for said office, and that therefore said Justin Garcia was elected and is hereby declared elected to the office of member of the City Council of the City of Irwindale, California, for the full term of four years. -3- (4) That a majority of those voting on the question or measure which appeared upon the ballots used at said election, to wit: Shall the members of the City Council of the City of Irwindale YES receive compensation in the amount of $50.00 per month? NO _ voted "Yes" on said question or measure, and therefore a majority of those voting on said question or measure are in favor of said question or measure, and said question or measure is therefore hereby declared to have won and it has been approved by the electors. SECTION 8. That the City Clerk of said City shall (in the manner as hereinafter indicated) enter on the records of said City Council a statement of the results of said election, showing: (a) The whole number of votes cast in said City: (b) The names of the persons voted for: (c) Tor what office each person was voted for: (d) The number of votes given at each precinct to each person, and the number of absentee votes given to each person. (e) The number of votes given in the City (including the number of votes given in the precincts and in absent voters' ballots) to each person; (f) The questions or measures voted upon; (g) The number of votes given at each precinct to each said question or measure; and (h) The number of votes given in the City (including the number of votes given in the precincts and in absent voters' ballots) to each question or measure. SECTION 9. That the City Clerk sahll, and heris hereby directed to: (1) Cause this resolution to be entered in full upon the official kinutes of the meetings and proceedings ofthe City Council of the City of Irwindale, California, in the minutes of the meeting of said Council at which the same is adopted, as the report and statement of said election; (2) Immediately make and deliver to each of such persons so elected, as soon as such person has filed, a statement as provided in Section 4530 of the Election Code of the State of California, a certificate of his or her election, signed by him and duly authenticated, said certificates to certify respectively as follows: a. That Mrs. Luisa F. Silva was elected as a member of the City Council of the City of Irwindale, California, for the full term of four years. b. That Richard L. Diaz was elected as a member of the City Council of the City of Irwindale, California, for the full term of four years. C. That Justin Garcia was elected as a member of the City Council of the City of Irwindale, California, for the full term of four years. (3) After Nirs. Luisa F. Silva, Richard L. Diaz, and Justin Garcia have filed said statements as provided in Section 4530 of said Election Code, impose (or cause to be unposed) the Constitutional Oath of Office -4- upon said Mrs. Luisa F. Silva, Richard L. Diaz, and Justin Garcia as members of the City Council of said City for the full term of four years; and have them subscribe thereto and file the same in the office of said City Clerk. SECTION 10. That thereupon, each and all of said respective persons so elected to said respective offices shall be inducted into the said respective offices to which they have respectively been elected.
