HomeMy WebLinkAbout99-36-1651r RESOLUTION NO. 99-36-1651 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE ESTABLISHING USER FEES AND DEPOSITS REQUIRMENTS FOR RENTAL OF THE IRWINDALE COMMUNITY CENTER WHEREAS, The City Council in approving the FY98/99 Budget had reaffirmed its policy to fully recover costs for services provided; and WHEREAS, the City Council deems it prudent and responsible to take reasonable measures regarding its public facilities to preserve them for use by the public; and WHEREAS, the City Council deems it prudent to recover costs for providing discretionary services including security services for private events; and. WHEREAS, a survey by City Staff indicates that the user fees collected for the rental of the Irwindale Community Center are far below the market rates charged for comparable facilities in the surrounding communities. NOW, THEREFORE, BE IT RESOLVED by die, City Council of the City of Irwindale, California, as follows: Section 1. Effective January 1, 2000 approve the user fees and deposits specified in the Rules and Regulations for Rental of the Irwindale Community Center attached hereto as Exhibit "A" and hereby made a part hereof, and Section 2. The fee schedule attached hereto may only be waived or modified by the City Council. The schedule itself may only be modified by resolution but individual fee waiver requests may be approved by the City Council where the Council finds significant community benefits or extraordinary hardship. Ki br , Deputy City Clerk Resolution No. 99-36-1651 Page 2 ig EXHIBIT "A" RULES AND REGULATIONS FOR IRWINDALE COMMUNITY CENTER I. APPLICATION: The applicant is responsible for knowing and complying with all rules and regulations pertaining to the Community Center. The applicant must be present and available to the janitor on duty at all times during the requested decoration period and function duration. The facility will be opened and closed for the applicant only, as the applicant is the person requesting the facility. A date is deemed reserved when a completed application along with the $300 deposit is received by the City of Irwindale, and the approved rental application is received by the applicant with the total amount of fees due and deposit marked PAID. 2. FEES: Rental $40.00 per hour β€” City of Irwindale Residents (2 hour minimum) $90.00 per hour β€” Non-resident (2 hour minimum) Decoration and Clean up $20 per hour Security $45.00 per hour (4 hour minimum) Refundable Deposit$300.00 (Due with application) Rental fees are to be paid no less than 10 working days prior to decoration and/or function date or a 10% per day penalty will be charged on the rental balance. A $10.00 Cancellation Service Charge shall be assessed if the function is cancelled 60 days or more prior to function date. If the cancellation is made less than 60 days prior to the function a $100 cancellation fee will be charged. A reservation may not be made more than I year prior to the function. Any reservation made 6 months or more prior to the function requires a $50 Pre -registration deposit. The $50 shall be forfeited if the function is canceled; otherwise the $50 shall be applied toward the $300 Refundable Deposit. 3. SECURITY: Security is required when Alcohol or music (i.e. live band, DJ, instrumentals, etc.) is included at the function. A personal radio or boom box is excluded from the definition of music. All music equipment must be contained within the enclosed walls of the Community Center. Security shall be provided by the Irwindale Police Department and, in every case, will remain on premises one-half hour longer than the event to ensure the premises are cleared and secured. 4. DEPOSIT: The $300 refundable deposit is forfeited if. a. The applicant fails to accompany the city worker and police officer during the walk through at the beginning and conclusion of the terβ€ž function, or is not present during the scheduled function; or j b. The custodian is unable to clear and lock the facility at the time the function is scheduled to end due to the actions or in -actions of the applicant; or c. The applicant occupies the center at times other than those requested on their application, causing the custodian on duty to work unscheduled hours. Any balance accrued for additional rental and/or security hours are agreed to be deducted from the deposit. Otherwise, all changes to hours must be made and paid for at the Senior Center prior to the decoration and/or function date; or d. The center is damaged in any way, including damaged, broken and/or missing equipment, graffiti, vandalism, or similar damage; or e. The center is left in an unacceptable manner. (This decision is left to the Community Center worker on duty.) 5. PAYMENT PROCEDURE: Refundable deposit is due with application. Rental and Security Fees must be paid 10 working days prior to decoration and/or function. Rental and security service fees received less than fifteen working days prior to the decoration and /or function date must be made in cash. Fees and Deposit must be paid with separate checks. All refunds will be paid by a city check to the applicant stated on the application. 6. RENTAL AND ROOM SET-UP: Deadline for room set-up is the Monday preceding the event, or the room will be set up at the janitor's discretion. The facility is available for rental seven days a week, between the hours of 7:00 a.m. β€” 12:00 midnight. Cleanup must be completed prior to 12:00 midnight of the function date. One hour should be allowed for cleanup at the end of each function. Maximum capacity is 100 people for assembly. We, the undersigned, have read, understand and hereby agree to abide by and enforce all rules and regulations pertaining to the above Community Center facility established by the City of Irwindale. We further agree to save harmless said City of Irwindale, its officers and employees from any and all claims, damages or losses to persons or property resulting from use of the Community Center facility by applicant, their invitees, or anyone attending the event whether or not caused by negligence of such person, unless resulting solely from negligence of the City.
