A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING
FY 23-24 ADOPTED BUDGET BY APPROPRIATING $29,078.10 FROM THE
GENERAL FUND RESERVE, WAIVING FORMAL BIDDING PROCEDURES, AND
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH MSL
ELECTRIC INC FOR CONSTRUCTION OF THE TRAFFIC SIGNAL MODIFICATIONS
PROJECT AT ARROW HIGHWAY AND VINCENT AVENUE
WHEREAS, the City Council approved the plans for an Interim Design for Traffic
Signal Modifications at Arrow Highway and Vincent Avenue and authorized staff to solicit
bids for construction of this project; and
WHEREAS, City staff requested a construction estimate from our Traffic Signal
Maintenance contractor, the City of Santa Fe Springs Traffic Signal Maintenance Division,
for implementation of the interim traffic signal modifications; and
WHEREAS, based on the construction estimate of $177,000, staff recommended
to move forward with construction utilizing the City's extraordinary traffic signal
maintenance contract with Santa Fe Springs to implement the interim design; and
WHEREAS, the City of Santa Fe Springs was not able to execute the contract with
their subcontractor, MSL Electric Inc., on behalf of the City of Irwindale due to their policy
guidelines, thus requiring Irwindale enter into a contract agreement with MSL Electric for
their scope of the work ; and
WHEREAS, several accidents have occurred at the intersection of Arrow
Highway and Vincent Avenue, prompting the City of Irwindale, the City of Azusa, and
Los Angeles County to immediately implement interim traffic signal modifications to
protect the public's health, safety and welfare by implementing safe turning movements
at the intersection of Arrow Hwy and Vincent Ave; and
WHEREAS, it is a matter of urgency that the Irwindale City Council waive the
formal bidding requirements so that the interim traffic measures may be implemented;
and
WHEREAS, Section 3.44.080(H) of the Irwindale Municipal Code provides for the
waiving of the formal bid procedure "when the city council determines by resolution it
would be in the best interest of the city to dispense with bidding; provided, however, that
the city council shall state the basis of its determination"; and

WHEREAS, staff recommends waiving formal bidding procedures and awarding
the construction contract to MSL Electric, Inc for the interim traffic signal modification work
in the amount of $90,000; and
WHEREAS, this Project is categorically exempt from CEQA as it consists of
replacement or reconstruction of existing facilities, pursuant to Section 15302(c) of CCR,
Title 14, Division 6, Chapter 3 "Guidelines for Implementation of the California
Environmental Quality Act".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES
HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. That the City Council of the City of Irwindale waive the formal bidding
procedures for the Traffic Signal Modifications Project at Arrow Highway and Vincent
Avenue pursuant to IMC Section 3.44.080 Subsection H.
SECTION 2. That the City Council does hereby approve the budget amendment
and the appropriation of $29,078.10 from the General Fund Reserves into Capital
Improvements Program Project 8306.
SECTION 3. That the City Council of the City of Irwindale awards the contract for
the Traffic Signal Modifications Project at Arrow Highway and Vincent Avenue to MSL
Electric Inc.
