HomeMy WebLinkAbout016KV e CITY OF IRWINDALE COUNTY OF LOS ANGELES, CALIFORNIA ORDINANCE NO. 16 AN ORDINANCE REGARDING SALE TO AND POSSESSION OF WEAPONS BY MINORS. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Except as otherwise provided in Section 4 hereof, it shall be unlawful in the City of Irwindale for any person, firm, or corporation, to sell, give, loan, or in any way furnish, or to cause or permit to be sold, given, loaned, or in any way furnish, to any person under the age of eighteen (18) years, any gun, revolver, pistol, firearm, spring gun, air gun, sling, sling shot, or device designed, or intended, to discharge, or capable of discharging, any dangerous missile. SECTION 2. Except as otherwise provided in Section 4 hereof, it shall be unlawful in the City of Irwindale, for any person, firm, or corporation, to sell, give, loan, or in any way furnish, or to cause or permit to be sold, given, loaned, or in any way furnished, to any person under the age of eighteen (18) years, any cartridge, shell, ammunition, or device containing any explosive substance, designed, or intended to be used in, or fired from, any gun, revolver, pistol, or firearm. SECTION 3. Except as otherwise provided in Section 4 hereof, it shall be unlawful in said City of Irwindale, for any person under the age of eighteen (18) years to fire, discharge, shoot, or operate, or to assist or participate in the firing, discharging, shooting, or operating, or to have in his or her possession, care, custody, or control, any gun, revolver, pistol, firearm, spring gun, air gun, sling, sling shot, or device design- ed, or intended, to discharge, or capable of discharging, any dangerous missile, or any cartridge, shell, ammuni- tion, or device containing any explosive substance, de- signed or intended to be used in or fired from, any gun, revolver, pistol, or firearm. SECTION 4. Nothing in this ordinance shall be deemed or construed to prohibit in said City of Irwindale the selling, giving, loaning or furnishing to any person under the age of eighteen (18) years, upon the written consent of the parent or guardian of such person, any article mentioned in Sections 1 and 2 hereof; nor to pro- hibit any such person under the age of eighteen years from having in his or her possession, care, custody or control any article mentioned in Section 3 hereof in the event that such possession, care, custody, or control of such article is had with the consent of the parent or guardian of such person and is under the direct supervision and control of some adult person; nor to prohibit any such "IN r• person under the age of eighteen years from firing, dis- charging, shooting, or operating any article mentioned in Section 3 hereof when such person is accompanied by, and under the direct care and control of, some adult per- son and is engaged in hunting any wild game or predatory bird or animal which may be lawfully hunted and killed in said City of Irwindale, or is lawfully engaged in shooting at any inanimate target, or trapshooting device, while accompanied by, and under the direct care and con- trol of, some such adult person. SECTION 5. Any person, firm, or corporation violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for not to exceed six (6) months, or by both such fine and imprisonment. SECTION 6. The City of Irwindale was incorpor- ated on August 6, 1957, and the City Council thereof has not yet adopted any legislation with respect to the fore- going matters, which affect the peace, health, and safety of the residents of the City of Irwindale. This Ordin- ance is, therefore, required for the immediate preser- vation of the public peace, health, and safety, and the same shall take effect immediately upon passage thereof. SECTION 7. This Ordinance shall take immediate effect after the date of its adoption and the same shall be posted in three public places within the City Limits of the City of Irwindale, as prescribed by Resolution No. 57-1.
