HomeMy WebLinkAbout043298 CITY OF IRWINDALE COUNTY OF LOS ANGELES, CALIFORNIA ORDINANCE NO. 43 AN ORDINANCE TEMPORARILY PROHIBITING USES PROHIBITED IN ZONE C-2 IN PORTIONS OF THE CITY OF IRWINDALE, DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Every person is guilty of a misdemeanor who uses any property now zoned M -1'k in the following described portions of the City of Irwindale for any purpose other than expressly permitted in Zone C-2 by Ordinance No. 13 of the City of Irwindale, entitled "An Ordinance Regulating the Use of Land Within the City of Irwindale." Said Ordinance No. 13 adopted and approved Ordinance No. 1494, as amended, of the County of Los Angeles. References hereinafter made to the various provisions of said Ordinance No. 1494 shall be deemed to be references to said Ordinance No. 1494 only in so far as said Ordinance No. 1494 was adopted and approved in Ord- inance No. 13 of the City of Irwindale. The area to which this ordinance shall apply is described as follows: (a) A portion of the NW Quarter Section 9, Township 1 South, Range 10 Los Angeles, State of California: of the NE 1/2, West, County of Beginning at a point in the Northerly line of said Section 9, distant thereon South 890 48' 0511, 329 feet east of the Northwest corner of the Northeast Quarter; thence parallel with the West line of said Quarter sec- tion, South 00 9' 10" West 474.375 feet, more or less, to the North line of the land conveyed in deed from Grgerio Fraijo to Juana C. Paredes, recorded in Book 767, page 67, of Deeds; thence Easterly on said Northerly line 100 feet; thence North 00 09' 10" East 474.375 feet, more or less, to the intersection of the North line of the Northeast Quarter; thence on the last mentioned line North 890 48' 05" West 100 feet to the point of beginning; EXCEPTING THEREFROM the North 20 feet. 29j Ordinance No. 43 (b) A portion of the Northwest Quarter of Section 9, Township 1 South, Range 10 West, S.B.B.M., County of Los Angeles, State of California, beginning at a point in the North line of said Quarter Section 164.5 feet East of the Northwest corner of said Quarter Section; thence East on said North line 165.0 feet, more or less, to the prolongation North of the West line of the land conveyed by A. Moss Merwin, et ux., to Abram C. Grviso by Deed dated February 17, 1902, recorded in Book 3075, page 68, of Deeds; thence South on said prolongation and on said West line of the Ind of Arviso, 474.375 feet to a point in the South line of land con- veyed by Grgorio Fraijo to Miguel Ayon April 7, 1890, recorded in Book 676, page 206 of Deeds; thence West on said last mentioned line 164 feet, more or less, to a point 164.5 feet East of the West line of said Quarter Section; thence North parallel with said last mentioned West line 474.375 feet to the point of beginning. EXCEPTING THEREFROM the North 20 feet thereof. SECTION 2. In addition to the grounds provided in Chap- ter o r nance No. 1494, as amended, of the County of Los Angeles, an exception may be granted if such exception will not be materially detrimental to the public welfare nor to the property of other persons located in the vicinity thereof. SECTION 3. Each and every provision, including all defin t ons t erein in said Ordinance No. 1494, applies to the territory covered by this ordinance as if such territory were zoned C-2 (Neighborhood Business). SECTION 4. Violation of this ordinance is punishable by a fine—more than $500 or by imprisonment for a period of not more than 6 months, or by both such fine and imprison- ment. Each day during any portion of which any violation of any provision of this ordinance is committed, continued or permitted, is a separate offense. SECTION 5. If any portion of this ordinance or the appl cat on t ereof to any person or circumstance is held invalid, the remainder of the ordinance and the application of such provision to other persons or circumstances shall not be affected thereby. SECTION 6. At the present time the Planning Commission of t e ty of Irwindale is commencing studies of the area described in Section 1 of this ordinance for the purpose of recommending to the legislative body necessary amendments in the zoning ordinance applicable to that area. In order to prevent the establishment of uses detrimental to the area prior to the completion of said studies, it is necessary that this ordinance take effect immediately. -2- 340 Ordinance No. 41 By reason of the foregoing this ordinance is urgently needed for the immediate preservation of the public peace, health, safety and general welfare, and shall take effect immediately upon the passage thereof. SECTION 7. This ordinance shall be posted in three public places w t n the city limits of the City of Irwindale, as prescribed by Resolution No. 57-1. On December 24, 1957, he securely and conspicuously posted at each of the public places in said city, to wit: (1) 5140 North Irwindale Avenue (2) Post Office on Irwindale Avenue (3) Southwest corner of Arrow Highway and Irwindale Avenue a copy of Ordinance No. 43 of the City of Irwindale, being in all respects the same as that attached hereto and made a part hereof.
