HomeMy WebLinkAbout047313 CITY OF IRWINDALE LOS ANGELES COUNTY, CALIFORNIA ORDINANCE NO. 47 AN ORDINANCE TEMPORARILY PROHIBITING USES PROHIBITED IN ZONE C-2 IN PORTIONS OF THE CITY OF IRWINDALE, DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Every personis guilty of a misdemeanor who uses any property now zoned M - 1i in the following described portions of the City of Irwindale for any purpose other than expressly permitted in Zone C-2 by Ordinance No. 41 of the City of Irwindale, entitled "AN ORDINANCE PROVIDING FOR THE CREATION WITHIN THE CITY OF IRWINDALE OF ZONES AND PRESCRIBING AREA RE- QUIREMENTS AND CLASSES OF USES OF BUILDINGS, STRUCTURES, IMPROVE- MENTS AND PREMISES IN SAID SEVERAL ZONES AND INCORPORATING LOS ANGELES COUNTY ZONING ORDINANCE NO. 1494 THEREIN BY REFERENCE." Said Ordinance No. 41 adopted and approved Ordinance No. 1494, as amended, of the County of Los Angeles. References herein- after made to the various provisions of said Ordinance No. 1494 shall be deemed to be references to said Ordinance No. 1494 only in so far as said Ordinance No. 1494 was adopted and ap- aroved in Ordinance No. 41 of the City of Irwindale. The area to which this ordinance shall apply is described as follows: A portion of the NWJ of the NEJ of Section 9, T. 1 S., R. 10 W., S.B,B.& M., in the County of Los Angeles, State of California: 11 Beginning at a point in the North line of said Quarter Section 164.5' East of the Northwest corner of said Quarter Section; thence East on said North line 674 feet; thence South parallel with the West line of said Quarter Section 474.375 feet; thence West parallel with the North line of said Quarter Section 674 feet; thence North parallel with the West line of said Quarter Section 474.375 feet to the point of beginning, EXCEPTING the North 20 feet thereof. SECTION 2. In addition to the grounds provided in Chapter 5 of Or Hance o. 1494, as amended, of the County of Los Angeles, an exception may be granted if such exception will not be materially detrimental to the public welfare nor to the property of other persons located in the vicinity thereof. 314 Ordinance No. 47 SECTION 3. Each and every provision, including all defin ons erein in said Ordinance No. 1494, applies to the territory covered by this ordinance as if such territory were zoned C-2 (Neighborhood Business). SECTION 4. Violation of this ordinance is punishable by a fine o no :Wore than $500 or by imprisonment for a period of not more than 6 months, or by both such fine and imprison- ment. Each day during any portion of which any violation of any provision of this ordinanee-is committed, continued or permitted, is a separate offense. SECTION 5. If any portion of this ordinance or the aPPli_0a_f1"0_n_tFsreof to any persons or circumstance is held invalid, the remainder of the ordinance and the application of such provision to other persons or circumstances shall not be affected thereby. SECTION 6. At the present time the Planning Commission of the City ofi Irwindale is commencingstudies of the area described in Section l of this ordinance, for the purpose of recommending to the legislative body necessary amendments in the zoning ordinance applicable to that area. In order to prevent the estalkishment of uses detrimental to the area prior to the completion of said studies, it is necessary that this ordinance take effect immediately. By reason of the foregoing this ordinance is urgently needed for the immediate preservation of the public peace, health, safety and general welfare, and shall take,,effect immediately upon the passage thereof. SEC. The provisions of this ordinance shall not be deemedor construed to repeal, alter or amend or change ordi- nance No. 43. SECTION 8. On February 189 1958, he securely and con— spicuously posted at each of the public places in said city, to wit: (1) 5140 North Irwindale Avenue (2) Post Office on Irwindale Avenue (3) Southwest corner of Arrow Highway and Irwindale Avenue a copy of Ordinance No. 47 of the City of Irwindale, being in all respects the same as that attached hereto and made a part hereof.
