HomeMy WebLinkAbout051CITY OF IRWINDALE LOS ANGELES COUNTY, CALIFORNIA ORDINANCE N0, 51 AN, ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE PROHIBITING THE DEALINGS PLAYING, CARRYING ON OR CONDUCTING OF GAMS OF CHANCE, AND ACTING AS LOOKOUTS FOR ILLEGAL ACTS. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. ,Games Prohibited. Every person who deals, plays, carries on, ops s, or causes to be opened, or oonduots, any game of.chanoe played with cards, dice or any other device, for money, checks, credits or other thing of value, and every person who bets at any of said prohibited games, is guilty of a misdemeanor. SECTION 2.Permitting Games Prohibited. -Every person who knowingly permits any game pro e y this ordinance to be played, conducted, or dealt in any house or other promises owned by, rented by or in the lawful possession of such person, is guilty of a misdemeanor. SECTION 3. Lookouts. Every person who acts as a guard or lookout for any bu ng, premises, or establishment used for gembling,-proatituion, or any other form of vio or illegal act, or where alcoholic beverages are illegally kept, sold, or pur- chased, or for any person soliciting, offering, or engaging in prostitution, gambling, or any other form of vice, or illegal act, is guilty of a misdemeanor. SECTION 4., Same. Every person who gives any signal in- tended to, or oaloTu a ted to warn, or give warning of the approach of any peace officer to any person in or about any building or premises or places mentioned in Section 3 of this ordinance, is guilty of a misdemeanor. SECTION 5. Destruotion of Gamin E ui meat. The -Sheriff, or other law enforcemen agency or s y, shall destroy any game, cards, or other thing which is used, kept, placed or main- tained in violation of any statute or of this or any other ordi- nance after any person, firm, corporation, or association, owning, possessing or having control of such cards, game or.thing has pleaded guilty to or has been convicted of such violation and such plea of guilty or conviction has become final. SECTION 6. Deposit of Money. The Sheriff, or other law enforcement agency or this cityj shall deposit with the City Clerk to the credit of the general .fund all money contained in any game or thing he destroys pursuant to the provisions of Section 5 of, this ordinance. He shall destroy all other con- tents of such game or thing. SECTION 7.- A lilacs tion to Court. The Sheriff, or other law enforcement ageno o h' Hie—City, shall app17 to the judge of any court which has custody of any thing subject to destruc- tion under the terms of Section 5 of this ordinance for an order releasing such cards, game or thing to him for the purpose of complying with this ordinance. SECTION 8. Penalty. Every violation of this ordinance is a misdemeanor pu- ssiable by imprisonment in the County Jail for not more than six (6) months, or by a fine of not more -than Five Hundred Dollars ($500), or by both such fine and imprison- ment. SECTION 9. Severability. If any section, subsection, sen- tence, clause, phrase or por ion of this ordinance, or the application thereof to any person, firm, corporation or eircum- stance, is for any reason held to be invalid or unoonetitutlonal by the decision of any court of ogmpetent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City.,of-Irwindale hereby declares that it would have adopted this ordinance and each aection, subsection, sentence, clause`, phrase orrtion thereof, irrespective of the fact that any one or more, -,**,,subsection, sentence, clause, phrase'or portion be-dealmred oid or un- constitutional. SECTION 10. Effeotive Date and ublioatlon. This ordinance shall take effect thirty ay s a er Pe date or its adoption and, prior to the expiration of fifteen days from the passage thereof, shall be posted in three public places within the city limits of the City of Irwindale, as presoribed by Resolution No. 57-1.
