HomeMy WebLinkAbout057359 CITY OF IRWINDALE LOS ANGELES COUNTY, CALIFORNIA ORDINANCE NO. 57 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE REGULATING THE USE, CARRYING, AND SALE OF FIREARMS WITHIN THE CITY OF IRWINDALE. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Firearms, Permit. No person shall shoot or discharge within the CIany gun, pistol or other firearm, or any air -gun or pistol, or spring -gun or pistol without having first obtained a written permit from the Sheriff of Los Angeles County, SECTION 2. Exception. It shall be unlawful for any person, except a duly elec etd or appointed peace officer, to carry con- cealed upon or about his person any revolver, pistol, dagger, dirk, splug or sling shot, billy or other deadly weapon or in- strument without first having obtained a written permit from the Sheriff of Los Angeles County. SECTION 3. Exception. The provisions of SECTION not apply to persons carrying such weapons on his own premises or property. SECTION 4. Issuance of Permits. The Sheriff of Los Angeles County may in his discretion issue permits to responsible parties to carry concealed weapons for a term not exceeding one year. SECTION 5. Same. All such permits shall be issued in the manner provided by—ffie Ordinances of Los Angeles County in respect to the issuance of said permits, and a record of said permit shall be kept in the Sheriff's office and a duplicate thereof in the City Clerk's office. Said permit must contain those matters re- quired by the Ordinances of Los Angeles County. SECTION 6. Application. Every person desiring to obtain a permit must file w th .Sheriff a written application for the same, which application must be signed by the person making such application and approved by two or more resident citizens of the City, and a record thereof kept in the Sheriff's office. Said application must contain all matters, statements, and information required by the Ordinances of Los Angeles County pertaining to the carrying of concealed weapons. SECTION 7. Refusal to Exhibit, Misdemeanor. Every person having a permit as provided f or erein an who refuses to exhibit such permit upon demand of any peace officer of Los Angeles County is guilty of a misdemeanor. 360 SECTION $, Confiscation of Concealed Weapons. All con- cealed weapons found on persons violating the provisions of this�� Ordinance shall, upon conviction of said person, be confiscated upon order of the Court in which said conviction has been had. SECTION 9. Permit to Sell. No person shall sell at retail within the City a pistol, revolver or other firearm capable of being concealed upon the person without first having received a permit from the Sheriff of Los Angeles County, authorizing such person to make such sale. SECTION 10. Same; Application and Fee. The Sheriff of Los Angeles County shall issue a permi for the sale of firearms at retail upon the receipt of an application accompanied by a fee of Fifty Dollars ($50.00) for the issuance of such permit, or for the renewal of any permit. SECTION 11, Same; Form. No permit shall be issued by the Sheriff of Los Angeles County except in a form prescribed by the Attorney General of the State of California, and all permits so issued shall expire upon June 30 next following the date of Issuance, SECTION 12, Same; Conditions. Any permit issued shall be subject to the folliowing con ions, the breach of any of which shall be sufficient cause for revocation of the permit by the Sheriff of Los Angeles County: (1) The business shall be carried on only in the building designated in the permit. , (2) The permit or a copy thereof certified by the Sheriff of Los Angeles County shall be displayed on the premises where it can be read easily. (3) No pistol or revolver shall be delivered: A. On the day of the application for the purchase, B. Unless the Purchaser is known personally to the holder of the permit or possesses evidence of his identity. (4) Any pistol or revolver delivered shall be unloaded and wrapped securely. (5) No pistol or revolver or imitation thereof or placard advertising the sale or other transfer there- c7f shall be displayed in any part of said premises where it can be readily seen from the outside of the place of business of the holder of the permit. SECTION 13, Public Parka, It shall be unlawful for any person, firm or corporation to take, carry or otherwise trans- p�,rt ,any firearms into any of the public parks or other public prtperty under the jurisdiction of the City or to have in his -2- or its possession any firearms within all said parks or upon other public property. SECTION 14. Violation and Punishment. Any person who shall violate any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine not exceeding Five Hundred Dollars ($500) or by imprisonment in the County Jail of the County of Los Angeles for a term not exceeding six (6) months, or by both such fine and imprisonment. Each separate day, or any part thereof, during which any violation of this ordi- nance occurs or continues constitutes a separate offense, and upon conviction thereof shall be punishable as herein provided. SECTION 15. Severability. If any section, subsection, subdivision, sentence, clause or phrase of this ordinance is for any reason.held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, sub- section, subdivision, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, sub- sections, subdivisions, sentences, clauses or phrases be de- clared unconstitutional. SECTION 16. Effective Date. This ordinance shall take effect thirty (30) days after a date of its adoption and, prior to the expiration of fifteen (15) days from the passage thereof, shall be posted in three public places within the city limits of the City of Irwindale, as prescribed by Resolution No. 57-1.
