HomeMy WebLinkAbout085ORDINANCE NO. 85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING THE IRWINDALE MUNICIPAL CODE BY ADDING THERETO SECTION 3183, WHICH SAID SECTION RELATES TO SPEED UPON PRIVATE STREETS THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOL - LOWS: SECTION 1. The Irwindale Municipal Code hereby is amended by adding thereto Section 3183 to read as follows: .- 3183. Speed on Private Streets. No person shall drive a motor vehicle upon any privately owned street, road, or vehicle easement serving or providing vehicle access to three or more separately owned parcels of real property at a speed greater than 15 miles per hour. As used in this section, the phrase "separately owned parcels of real property" includes any separate parcels, whether a separate parcel in a recorded subdivision or by reason of a metes and bounds description. SECTION 2. This ordinance is declared to be an urgency ordinance necessary for the protection of the public, peace, health, safety, and welfare, and shall take effect immediately upon its adoption. The reasons for the urgency are: There are many private streets within the City of Irwindale serving as the main access to residences and business, such streets having all the characteristics of public streets ex- cept the want of dedication as such. Present laws do not regu- late speed on such private streets, thus creating a hazardous condition insofar as the residents of the City and users of such streets are concerned. SECTION 3. The City Clerk shall certify to the passage of this ordinance and cause the same to be posted in the manner required by law. APPROVED AND PASSED this S day of — 1960.
