HomeMy WebLinkAbout095ORDINANCE NO. 95 AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE PRESCRIBING THE ENFORCEMENT OF DECORUM WITHIN THE CITY'S COUNCIL CHAMBERS DURING A MEETING OF A DULY AUTHORIZED CITY COUNCIL, PLANNING COMMISSION, OR PARKS AND RECREATION COMMITTEE, AND THE PENALTIES FOR VIOLATION THEREOF. The City Council of the City of Irwindale does ordain as follows: SECTION 1. Where used herein, the descriptive phrase "Council Chambers" shall include any place or locale where a duly authorized regular, adjourned, special meeting, or study session or other public hearing of the City Council, Planning Commission, or Parks and Recreation committee is being held within the City of Irwindale, California. SECTION 2. Any person in the audience who uses loud, boisterous or profane language at any duly authorized meeting in the Council Chambers, or any language tending to bring the members of that meeting, or any City employee who participates therein, into contempt; or any person in the audience who persistently interrupts or disrupts the proceedings of such a meeting, or refusses to maintain silence and take a seat when so ordered by the Presiding Officer of the meeting, shall be deemed guilty of a misdemeanor under this Ordira nce. SECTION 3. Any person deemed guilty of a misdemeanor under this Ordinance, upon conviction thereof, shall be punished by a fine of not more than Five Hundred Dollars ($500), or by imprisonment in the County Jail for a period of not more than six (6) months, or by both such fine and imprisonment. SECTION 4. The Chief of Police (or in his absence, his designated assistant) shall be the ex officio Sergeant -at - Arms of the Council, Commission or Committee in session. Iie shall carry out all orders and instructions given to him by the Presiding Officer for the Purpose of maintaining order and decorum in the Council Chambers, and it shall be his duty to eject any person from the Council Chambers, or to place that person under arrest, or both, when so ordered by the Presiding Officer. SECTION 5. Publication. The Mayor shall sign this emergency Ordinance and the City Clerk shall attest to same, and the same shall be posted immediately thereafter in three (3) public places within the City Limits of the City of Irwindale, as prescribed by Resolution No. 60-8. McLEAN, City Clerk of the City of Irwindale, do hereby certify that the foregoing Ordinance No. 95 was regularly introduced and passed at a regular adjourned meeting of the City Council on the 22nd Day of December, 1960, by the following vote, to -wit: AYES: Councilmen: L. Silva, A. Tapia, R. Breceda and Mayor Garcia. NOES: Councilmen: S. Diaz. ABSENT: Councilmen "--- STATE OF CALIFORNIA ) COUNTY OF LOS ANGELES ) ss. CITY OF IRWINDALE ) and says: JAMES M. McLEAN, being first duly sworn, deposes That he is the City Clerk of the City of Irwindale, California, and is and was at all times herein mentioned a citizen of the United States over the age of eighteen (18) years and competent to be a witness herein. On December 7, 1960, he securely and conspicuously posted at each of the public places in said City, to -wit: (1) 5140 North Irwindale Avenue; (2) Post Office on Irwindale Avenue; (3) Door of storage room located in Irwindale Park; a copy of Ordinance No. 95 of the City of Irwindale, being in all respects the same as that attached hereto and made a part hereof.
