HomeMy WebLinkAbout1244 ORDINANCE NO. 124 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE RELATING TO THE DISPOSITION OF UNCLAIMED PROPERTY AND AMENDING THE IRWINDALE MUNICIPAL CODE. THE CIIFY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. a new section of the Irwindale Municipal Code is hereby adopted as follows: "CHAPTER 9 - DISPOSITION OF UNCLAIMED PROPERTY 2900. Stolen, Lost or Abandoned Personal Property. It is hereby made the duty of all officers and employees of the City whenever they find within the corporation limits of said City, or whenever there comes into their possession any personal property which such finder or possessor has reason to believe may have been stolen, lost, or abandoned, to deliver the same to the Chief of Police. 2901. Return of Personal Property. It shall be the duty of the Chief of Police to take charge of and keep in his possession said property, and he must within a reasonable time inform the owner thereof, if known, and make restitution to him of such property upon demand without compendation. 2902. Auction of Unclaimed Personal Property. Should any such property remain unclaimed by its true owner for a period of sig months from the date of finding, the Chief of Police is hereby authorized and required to cause the same to be sold at public auction to the highest bidder. 2903. Notice of Sale. Notice of such sale shall be given by the Chief of Police at easter five days b efore the time fixed therefor, together with a schedule of the property to be offered for sale. 2904. Disbursement of Proceeds. Immediately after the completion of any such sale, the Chief of Police shall give to the City Treasurer of statement of the proceeds thereof together with the expense incurred in concluding such sale. Said Chief of Police shall forthwith pay such proceeds to the City Treasurer and the City Treasurer after deducting the necessary expenses actually incurred shall deposit the balance thereof in the general fund. 2905. Disposition of Unsold Personal Property. If there be no bids for any such property offered for sale at suc auction, the property shall again be offered for sale together with other such un- claimed property at the next auction sale. If such property is not sold at the second auction sale, the Chief of Police may make such disposition thereof in the public interest as he shall deem fit. 2906. Exceptions. The provisions of this Cahpter shall not apply to property subject to confiscation under State or Federal Law. SECTION 2. The Mayor shall sign this ordinance and the City Clerk shall attest to same, and the same shall be posted immediately thereafter in three (3) public places within the City Limits of the City of Irwindale, as prescribed by Resolution of the City of4ywindale. On January, :22,L1963, she securely and conspicuously posted at each of the public places in said City, to'wit; (1) 16034 Calle de Norte; (2) Post Office on Irwindale Avenue; and (3) At or near the door of the Council Chambers, 5050 North Irwindale Avenue, a copy of Ordinance No. 124 of the City of Irwindale, being in all respects the same as that attached hereto and made a part hereof.
