HomeMy WebLinkAbout151125 ORDINANCE NO. 151 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE FIXING SEWER CONNECT- ION CHARGES IN SEWERS ON CENTRAL AVENUE AND ALLEN DRIVE, PROVIDING FOR SAID CHARGES TO BE A LIEN, AND PROVIDING FOR THE PAYMENT THEREOF. I I THE CITY COUNCIL OF THE CITY�OF IRWINDALE DOES ORDAIN AS FOLLOWS: I SECTION 1. The City Council hereby finds and determines that a duly noticed hearing in accordance with Section 5474 of the California Health and Safety Code was held on August 17, 1964, that there are no opponents to the adoption of this Ordinance, and the City of Irwindale for the health, safety, and welfare of its residents that this Ordinance be adopted. SECTION 2. The City Council hereby finds and determines that a sewer connection charge is fixed for the connection by the owners of property hereinafter described at $6.30 per front foot on the following terms and conditions: 1) The legal description of the real property subject to the sewer connection charge herein referred to is attached here- to as Exhibit "A". 2) Said connection charges shall be due upon connection to said. sewers on Central Avenue and Allen Drive, and payable at the option of the property owner either immediately upon said connection or in equal'semi-annual installments amortized over a period of 15 years from the date said connection is made, and collected by the Los Angeles County Tax Collector in accordance with Sections 5473, 5474.6 and 5474.7 of the California Health and Safety Code. 3) There shall be no interest charge on said connection charges. 4) Said connection charges shall constitute a lien against the above described real property to which said sewers are connected in accordance with Article 4, Chapter 6 of the California Health and Safety Code. 5) The connection -charges imposed herein and collected by the City of Irwindale shall be used in accordance with Section 5474.9 of the California Health and Safety Code. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance, cause the same to be published in a manner prescribed by law, and forward a copy to the Los Angeles County Tax Collectors Office. SECTION 4. City Clerk is hereby authorized and directed to execute any and all necessary documents with the Los Angeles County Tax Collector's Office to carry out the terms of this Ordinance. YOUNG, being first duly sworn, deposes and says: That she is the duly appointed and City Clerk of the city of Irwindale, California, and is and was at all times herein mentioned a citizen of the United States over the age of eighteen (18) years and competent to be witness herein. On September 22, 1964, she securely and conspicuously posted at each of the public places in said City, to wit: 1. 16034 Calle De Norte; 2. Post office on Irwindale Avenue; and 3. At or near the door of the Council Chambers, 5050 North Irwindale Avenue. a copy of Ordinance No. 151 of the City of Irwindale, being in all respects the same as that attached hereto and made a part hereof.
