ORDINANCE NO. 161
AN ORDINANCE OF THE CITY OF IRWINDALE
ENACTING AN INTERIM ZONING ORDINANCE
PURSUANT TO THE PROVISIONS OF SECTION
65806 OF THE CALIFORNIA GOVERNMENT CODE
RELATING TO A MORATORIUM ON BUILDING
PERMITS ON CERTAIN PROPERTY PENDING
PLANNING COMMISSION STUDIES WITH RESPECT
THERETO.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN:
SECTION 1. The City Council finds and determines
that the Planning Commission of this City has heretofore undertaken
in good faith studies to determine the appropriate zone classification
of the property hereinafter described in order to prescribe necessary
regulations to safeguard the public park and the devaluation of
neighboring properties.
SECTION 2. The City Council further finds that
the recommendations of the Planning Commission on such matters
should be forthcoming within the next few months, and to permit
further construction on said property prior to the consumation
of said studies would in large measure emasculate the benefits
to be derived therefrom, and would be contrary to the best interests
of the residents of this City.
SECTION 3. Pending completion of such studies
and recommendations of the Planning Commission, and pursuant
to the provisions of Section 65806 of the Government Code, a
moratorium is hereby imposed upon the construction of all structures
and building on the hereinafter described property and the provisions
of the Irwindale Municipal Code authorizing any such construction
are hereby suspended.
SECTION 4. This Ordinance shall remain in effect
until May 20, 1965, and the Building Inspector of this City is
directed to issue no building permits during the terms of this
Ordinance upon the following described parcel of property:
Beginning at a point in the North line of said
Quarter Section 164.5 East of the Northwest
corner of said Quarter Section; thence East on
said North line 674 feet; thence South parallel
with the West line of said Quarter Section
474.375 feet; thence west parrallel with the North
line of said Quarter Section 674 feet; thence
North parallel with the West line of said Quarter
Section 474.375 feet to the point of beginning,
excepting the North 20 feet thereof.

SECTION 5. This Ordinance shall become immediately
effective pursuant to the provisions of Section 65806 of the
Government Code and for the reasons above stated, and is adopted
pursuant to the authority of Anderson V. Pleasant Hills, 229 ACA
81, Metro Realty v. Co. of El Dorado, 222 ACA 560, Hunter v. Adams,
180 CA 2d 511, and Los Angeles v. Superior Court, 221 ACA 151.
SECTION 6. The City Clerk of the City of Irwindale
shall certify to the passage and adoption of this Ordinance and
to its approval by the Mayor and shall cause this same to be posted.
Passed, approved and adopted this 19th day of

posted at each of the public places in said City, to wit:
1. 16034 Calle del Norte;
2. Post Office on Irwindale Avenue; and
3. At or near the door of the Council Chambers,
5050 North Irwindale Avenue.
