ORDINANCE NO. 160
AN ORDINANCE OF THE CITY OF IRWINDALE ENACTING
AN INTERIM ZONING ORDINANCE PURSUANT TO SECTION
65806 OF THE GOVERNMENT CODE, PROHIBITING THE
ERECTION, ALTERATION OR MOVING OF BUILDINGS, OR
COMMENCEMENT OF CERTAIN USES, IN THE M-1 i
ZONES OF THIS CITY, AS DELINEATED ON THE ZONE MAP
ADOPTED IN SECTION 9100 OF THE IRWINDALE
MUNICIPAL CODE, PENDING CURRENT STUDIES FOR
AMENDMENT OF THE ZONING CODE.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN:
SECTION 1. The City Council does hereby find and
determine that the amendments hereinafter set forth in Section 2
hereof have been undertaken for consideration, in good faith by the
Planning Commission of this City as a portion of a more comprehensive
plan and that said Planning Commission is conducting public hearings
thereon. It is further found and determined that it is necessary to
protect the public health, safety and welfare that this City enact as
an emergency ordinance a prohibition against all persons from violating
the said proposals of the Planning Commission all in the manner and
means prescribed in Section 65806 of the Government Code.
SECTION 2. Proposed regulations in the M-1 k zones:
A. To suspend Code Section 271.7 of the Los Angeles
County Zoning Code to the extent inconsistent herewith.
B. To adopt a new Code Section 271.7, replacing the
foregoing, as follows:
"Section 271.7. Property in this zone may be
used for single family residences only in the
manner set forth in Sections 207, 209, 211, 211.2,
211.4 and 211.6 of the Los Angeles County Zoning
Code."
SECTION 3. From and after the date of the adoption of
this Ordinance, no building or structure shall be erected, nor shall
any existing building or structure be relocated, reconstructed,
structurally altgred, added to or enlarged, nor shall any permit be
issued for any of the foregoing, as to any lot or parcel of property
in any of the M-1 ' zones as the same are set forth and delineated on
the Zone Map of this City as set forth in Section 9100 of the
Irwindale Municipal Code, except in conformity to the provisions of
Section 2B above; and all buildings and uses not conforming thereto
are prohibited. Excluded from such prohibition, however, are all plans
and applications for permit filed with the Building Department prior
to 7:00 P.M., February 15, 1965.
SECTION 4. It shall be unlawful for any person to
violate the proposals of the Planning Commission as set forthin
Sections 2 and 3 hereof.
SECTION 5. This Ordinance shall remain in effect until
September 30, 1965, or until said amendments shall be earlier repealed
or enacted upon a permanent basis. During the term of this Ordinance,
the provisions of Sections 2 and 3 hereof shall be the law of this City.

SECTION 6. The City Council declares this Ordinance
to be an urgency Ordinance, for the immediate enactment hereof, and
that the same is necessary to the public health, safety and welfare,
and that the prohibitions imposed herein shall become effective at
once as an emergency measure for the following reasons:
a) That the present M-1 � regulations have manifested
inequities and features inimical to the safety and welfare of the City.
b) That the Planning Commission is conducting hearings
and will, within the near future, forward its recommendations to the
City Council regarding the foregoing and other modifications for
community betterment.
c) That to protect the public safety, health and
welfare, it is essential that the erection of buildings and the
commencement of uses which will become non -conforming under such
prospective amendments and additions to the zoning ordinance be
prevented.
d)' The studies thus far completed by and under the
direction of the City Planning Commission described in Section 2 of
this Ordinance indicate clearly the necessity for the amendment of
and addition to the zoning regulations effecting the same; that the
purpose of such studies, amendments and additions to the zoning
regulations will be seriously jeopardized and thwarted if prior to the
effective date thereof buildings and uses may be erected and commenced
contrary thereto.
e) Said M-1 z zones as presently situated in the City
of Irwindale are proximal to existing parks or single family dwellings,
and to permit heavy industrial and commercial uses in such areas would
deteriorate property value and frustrate the purpose and goals of the
zoning ordinance.
SECTION 7. PENALTY. Any person, firm or corporation
violating this ordinance shall be guilty of a misdemeanor and upon
conviction thereof shall be punishable by a fine of not more than
$500.00 or by imprisonment in the City or County Jail for a period
not to exceed 6 months, or by both such fine and imprisonment.
SECTION 8. The City Clerk of the City of Irwindale
shall certify to the passage and adoption of this Ordinance, and
cause the same to be published in a manner prescribed by law.

was regularly introduced, adopted and passed at a regular meeting of
the City Council on the 15th day of February, 1965, by the following
vote:
AYES: COUNCILMEN: Breceda, Miranda, Martinez and
Mayor Diaz.
NOES: COUNCILMEN: None.
ABSENT:, COUNCILMEN: None.
IN ABSTENTION: COUNCILMEN: Sulzer.

That she is the duly appointed and City Clerk of the
City of Irwindale, California, and is and was at all times herein
mentioned a citizen of the United States over the age of eighteen
(18) years and competent to be witness herein. .
On February 16, 1965, she securely and conspicuously
posted at each of the public places in said City, to wit:
1. 16034 Calle del Norte;
2. Post Office on Irwindale Avenue; and
3. At or near the door of the Council Chambers,
5050 North Irwindale Avenue.

respects the same as that attached hereto and made a part hereof.
