ORDINANCE NO. 177
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF IRWINDALE, REPEALING
SECTIONS 9100 THROUGH 9106 OF THE
IRWINDALE MUNICIPAL CODE, AND ADDING
ARTICLE X TO SAID CODE, CONSISTING
OF SECTIONS 9300 THROUGH 9504,
INCLUSIVE, RELATING TO ZONING REGULATIONS.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN
AS FOLLOWS:
SECTION 1. That Sections 9100 Through 9106, inclusive,
of the Irwindale Municipal Code, are hereby repealed and rescinded.
SECTION 2. That Article X is hereby added to the
Irwindale Municipal Code, consisting of Sections 9300 through 9504,
to read, respectively, as follows:
ARTICLE X
CHAPTER I
PART I - INTRODUCTION
9300. Short Title. The provisions of this Article

shall be known to s the 'Irwindale Zoning,Code".
9301. Replacement of Previous Regulations. Insofar
as the provisions,of this Article are substantially similar to
the former zoning regulations contained in the Irwindale Municipal
Code, they shall be construed as restatements and continuations
of such regulations and not as new enactments.
9301. Purpose. The purpose of this Article is to
encourage, classify, designate, regulate, and restrict, so as
to permit the highest and best use of buildings, structures,
and land, to serve the needs of agricultural, residential,
commercial and industrial developments within the City; and
to regulate and limit the height, number of stories, size,
and location of buildings and other structures, hereafter designed,
erected, or altered; to regulate and determine the size of
yards and open spaces; to regulate and limit the density of
population; to facilitate adequate provisions for community
utilities, such as transporation, water, sewage, schools, parks
and other public requirements; to lessen congestion on streets;
to promote the public health, safety, welfare and general
prosperity with the aim of preserving a wholesome, serviceable
and attrative community.
This said Article is adopted pursuant to and in
accordance with the Government Code of the State of California,
and all other applicable laws.

9303. Minimum Requirements. In applying the provisions
of this Article to properties located within the City, the
provisions hereof shall be deemed to be minimum requirements
for the promotion of the public health, safety and interest,
unless the context of the regulation otherwise provides.
9304. Reference to other Laws. Whenever reference
is made herein to other provisions of this Code, or other
laws, said reference shall be deemed to apply to all amendments
now, or hereafter, adopted, with reference to such laws.
9305. Severability. If any provision of this Code
or the application thereof to any person or property is held
invalid for any reason, the remaining provisions hereof, shall
not be affected by such invalidity.
9306. Continuation of Zone-Var
and Conditional or Special Use Permits. All variances, special
permits and exceptions heretofore granted or issued by the
County of Los Angeles prior to the incorporation of the City
of Irwindale or granted or issued by the said City subsequent
to such incorporation, are hereby approved, ratified and confirmed
as to the entire premises to which the same relate and shall
be deemed to remain in full force and effect in accordance
with the provisions thereof. All such variances and permits
here and above described shall be subject to the provisions
of Sections 9351 and 9353 hereof. Proceedings for modification
or revocation on such permits shall, in all cases, be heard
by the Planning Commission of said City.
9307. Existing Nonconforming Uses. No use established
or conducted, nor any building or improvement existing, in
violation of the former zoning regulations of the City of
Irwindale upon the effective date of this Article, shall be
deemed to have acquired a legal nonconforming status by reason
of the adoption of these regulations.,
9308. Procedure 1jeS!1r�in&,P2nding Proceedings.
If, prior to the effective date 0� t is Article, pursuant to
the provisions of the former zoning regulation of this City,
legislative or administrative action has been taken, such
action shall be deemed to have been taken pursuant to the
pTovisions of this Article, and shall be processed, insofar
as possible, in accordance with the provisions hereof.

SECTION 3. That Ordinance No. 175 is hereby repealed
and rescinded.

SECTION 4. Thai the City Clerk shall certify to
the adoption of this Ordinance and cause the same to be published
or posted in the manner prescribed by law.

ABSENT: COUNCILMEN: Miranda.

On April 18, 1966, she securely and conspicuously
posted at each of the public places in said City, to wit:
1. Police Department, 5050 North Irwindale Avenue;
2. Post Office, 5150 North Irwindale Avenue; and
3. At or near the door of the Council Chambers,
5050 North Irwindale Avenue.
