ORDINANCE NO. 179
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF IRWINDALE IMPOSING A MORATORIUM
UPON CERTAIN USES PERMITTED PURSUANT TO
THE ZONING REGULATION OF SAID CITY
(URGENCY ORDINANCE)
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS
FOLLOWS:
SECTION 1 '. That the City Council of the City of Irwindale
does hereby find, determine and declare as follows:
(a) That certain activities are presently permitted
uses -in the M-2 and Q -Zone, as set forth in the
Irwindale Municipal,Code, which relate to quarry
operations and allied activities;� and
(b) That the regulations applicable to said uses
do not appear to be adequate to insure the orderly
and compatible development of such uses in the City
of Irwindale; and
(c) That studies have been initiated and public
hearings will shortly be held by the Planning
Commission of said City, to determine the
appropriate regulations to be made applicable to
such uses; and
(d) That pending the outcome of said studies and
hearings, irreparable injury will occur if such
uses, as hereinafter set forth, are not prohibited
until a determination is reached by said Commission
and Council, as to the regulations which should be
made applicable to said uses; and
(e) That in order to protect the public safety,
health and welfare, for the reasons hereinabove
described, it is necessary that this ordinance be
adopted as an urgency ordinance, pursuant to
Section 65858 of the Government Code of the State
of California, so that the same will take effect
immediately.
SECTION 2. Notwithstanding any provision of the Irwindale
Municipal Code to the contrary:
(a) No application for a conditional use permit,
zone variance or change of zone proceeding shall be
accepted, filed or acted upon so as to permit the
utilization of land for any of the uses as hereinafter
set forth; and
(b) Nor shall any of the uses, hereinafter described,
now in existence be in any way expanded in any area,
as to which no vested right exists on the date of
adoption of this ordinance; and
(c) Nor shall any rights or privileg&s authorized by
the regulations applicable to the "Q" Zone, which are
not now exercised, be exercised as to any new or
additional uses or new areas; and

(d) The uses to be so prohibited, above referred
to, are as follows:
1. Asphalt Plants;
2. Batching plants;
3. Quarry Operation;
4. Block or tile plants;
5. Specialty'plahts using,or processing
crushed rock, sand.j gravel, decomposed
granite or other similar.material,
SECTION 3. That this ordinance is hereby declared to be
an urgency ordinance and shall take affect at 12:01 A. M., on
May 6, 1966. A statement of facts constituting,its urgency is as
hereinabove set forth.
SECTION 4. The City Clerk shall certify the adoption of this
ordinance and cause the same to be posted in the manner prescribed
by law.

the City Council on the 3rd day of May, 1966, by the following vote:

Miranda.
NOES: COUNCILMEN: None

I, Margaret S. Barbosa, being first duly sworn,
deposes and says:
That she is the duly appointed,and City,Clerk of'
the City of Irwindale, California, and is and was at all times
herein mentioned a citizen of the United States over the age
of eighteen (18) years and competent to be witness herein.
On May 6, 1966, she securely and conspicuously
posted at each of the public places in said City, to wit:
1. PoliceDepartment;
2. Post Office on Irwindale Avenue;
3. At or near the door of the Council Chambers,
a copy of Ordinance No. W9 of the City of Irwindale, being
in all respects the same as that attached hereto and made a
part hereof. I
