ORDINANCE No. 186
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF IRWINDALE AMENDING
CERTAIN OF THE PROVISIONS OF
CHAPTER 2 OF ARTICLE V OF THE
IRWINDALE MUNICIPAL CODE RELATING
TO SANITARY SEWERS.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN
AS FOLLOWS:
SECTION 1. That Sections 5200 through 5203, inclusive,
of the Irwindale Municipal Code, are hereby amended to read,
respectively, as follows:
"5200. DEFINITIONS. For the purpose of
this chapter, the following words and phrases
shall be defined as follows, unless it is
apparent from the context that a different
meaning is intended:
(a) 'Alter' shall mean any change or
addition to any public sewer or any house
connection sewer.
(b) 'City' shall mean the City of
Irwindale.
(c) 'City Engineer' shall mean the
City Engineer of City.
(d) 'City Manager' shall mean the
City Manager of City.
(e) 'House Connection Sewer' shall
mean that part of the sewer line which
extends from the exterior wall or foundation
of a building or structure, to its connection
to a public sewer.
(f) 'Permit' shall mean a permit
required by this Section for the purpose
of construction, installation, alteration
or repair of any public or house connection
sewer.
(g) 'Person' shall mean any person,
partnership, corporation or other legal
entity, except a governmental agency,
owning any real property within the City
to which the provisions of this Chapter apply.
(h) 'Public Sewer' shall mean any
sewer line, other than a house connection
sewer, which is the property of the City or
of any other governmental agency."

"5201. PERMITS. No person shall make any
connection to any public sewer, nor shall any
person construct, alter or pepair any public or
house connection sewer, without first obtaining
a permit therefor, in the manner hereinafter set
forth."
"5202. SAME. EXCEPTIONS. Nothing contained
in this Chapter shall be deemed or construed to
require:
(a) a permit for the purpose of removing
stoppages, or repairing leaks in any house
connection sewer, except when it is necessary
to replace any or all of such sewer line
with other lines or different materials; or
(b) contractors constructing sewers and
appurtenances under contracts awarded and entered
into under proceedings had or taken by any governmental
agency, to obtain such permit."
"5203. SAME. APPLICATION. Application for
a permit shall be in writing, upon a form
prescribed by the City Engineer. Said application
shall be accompanied by a fee in an amount
set forth hereinafter."
SECTION 2. That Section 5204 through 5208, inclusive,
are hereby added to the Irwindale Municipal Code, to read,
respectively, as follows:
"5204. PRIVATE SEWER SYSTEM. No private
sewer system, including but not limited to,
cesspools and ceptic tanks, shall be permitted
or allowed to be constructed, except to service
property which the City Engineer finds is not
then served by a public sewer."
5205. PRIMATE EASEMENT. Whenever any
person proposes to locate a house connection
sewer line in and along private property,
other than property upon which the building
to be served by said house connection sewer,
is located, he shall file with the City Engineer
a certified copy of the recorded instrument
of conveyance granting an easement for
the same."
"5206. INSPECTION. All work done under
the provisions of this Chapter shall be subject
to inspection by the City Engineer to insure
compliance with the provisions hereof, provided,
however, that approval by the City Engineer
shall not relieve the permittee or any other
person from complying with all applicable
laws. "

"5207. MATERIALSAND CONSTRUCTION TO MEET
STANDARD SPECIFICATIONS. All material used and
all work done under these provisions shall meet
all the requirements of the latest edition of
the specifications entitled "Standard
Specifications for the Construction of
Sanitary Sewers" prepared by the Office of the
County Engineer, County of Los Angeles. The
City Engineer shall have the authority to
modify said standard specifications to meet
local or special conditions."
"5208. FEES. The fees to be paid
contemporaneously with the filing of an application
for a permit, shall be for the purpose of
processing the said application, and inspecting
the work. Such fee shall be in the sum of
$15.00, provided that where a private party
proposes to construct a portion of a public
sewer, the City Engineer shall require an
additional fee in an amount equal to the
estimated cost of plan checking and inspection
thereof."
SECTION 3. That Sections 5209, 5210, 5211 and 5212
of the Irwindale Municipal Code are hereby amended to read
as follows:
"5209. SEWER REIMBURSEMENT CHARGES. Whenever
a permit is requested for any lot, to allow
connection to a public sewer, constructed by
the City, which lot has not borne its just
share of the original cost of the installation
and construction of tsaid public sewer, either
by means of an assessment district proceeding,
contract, voluntary contribution or other wise,
a reimbursement fee shall be charged in such
cases, prior to the issuance of a permit, in
accordance with,the following schedule, subject
to the provisions of this Chapter:
A. Those lots described on Appendix A
hereto, which is incorporated herein by this
reference, shall be charged the fees as set
forth on said Appendix A.
B. Six Dollars ($6.00) for each foot of
street frontage of the lot if said lot is not
referred to in paragraph A hereof, or if such
lot has no street frontage, or the Engineer
finds that such charge is otherwise not appropriate,
he may set such fee upon the basis of an
acreage charge, determined in the same manner
as if the property were to be assessed therefor,
in a Special Assessment District proceeding.
C. No reimbursement fee shall be required
for connection to a public sewer owned by the
County Sanitation District, provided that a
permit therefor, shall be required, as set forth
in Sections 5200 through 5208, inclusive,
hereof."

"5210. APPEAL. Any person dissatisfied with
respect to the amount of fees as set forth in
Section 5209, shall have the right to appeal
the same to the City Council. Any such appeal
shall be in writing, and shall describe the
property concerned, the name of the appealing
party, and such other information as the
appealing party deems appropriate. Such appeal
shall be filed with the City Clerk; upon
receipt of such an appeal, the City Clerk
shall set the same for the next most convenient
City Council Agenda, and shall give the .
appealing party at least five (5) days written
notice of the time and place of such hearing,
by United States Mail, postage pre -paid,
addressed to the appealing party at his last
known address."
"5211. COUNCIL DETERMINATION. At the
time set for the hearing, the City Council
shall determine whether the proposed fee,
prima facie established pursuant to Section
5209 hereof, is just and reasonable under
all of the circumstances applicable to the
case. The Council hearing shall not be a
formal hearing, but the Council shall give
the appealing party a reasonable opportunity
to be heard concerning the amount of such
fee. The Council may also consider such
other evidence as may be pertinent and
relevant, including, but not limited to,
staff reports. The Council shall have the
authority, by motion, to modify the amount
of the fee as set forth in Section 5209
hereof, in accordance with its findings.
The decision of the City Council shall be
final and conclusive.
"5212. SAME. PAYMENT. All reimbursement
fees shall be paid prior to issuance of the
permit, provided, however, the City Manager
may, in cases where such payment would constitute
a hardship, execute a contract by and between
the property owner and the City, providing
for payment of such amount over a reasonable
period of time, not to exceed five (5) years.
Said contract shall be recorded and constitute
a lien against the property; if litigation is
reasonably necessary by City to enforce the
provisions of such contract, the Court, in its
discretion, shall have the authority to award
City its reasonable attorneys fees."
SECTION 4. That Sections 5200.1 through 5200.21,
inclusive, 5208.1 through 5208.3, inclusive, 5211.1, 5213
through 5256, inclusive, are hereby repealed and rescinded.
SECTION 5. That all ordinances be consistent herewith
are hereby repealed and rescinded.
