HomeMy WebLinkAbout188217 ORDINANCE NO. 188 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE ENACTING AN INTERIM ZONING ORDINANCE PURSUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE RELATING TO A MORATORIUM ON BUILDING PERMITS ON CERTAIN PROPERTY PENDING PLANNING COMMISSION STUDIES WITH RESPECT THERETO. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN: SECTION 1. The City Council does hereby direct that the Planning Commission of this City to undertake studies to determine the appropriate zone classification for the property hereinafter described in order to prescribe necessary regulations to safeguard the public interest and the devaluation of neighboring properties. SECTION 2. The City Council further finds that the recommendations of the Planning Commission on such matters should be forthcoming within the next few months, and to permit construction in the manner proposed by the owner on said property prior to the consumation of said studies would in large measure emasculate the benefits to be derived therefrom, and would be contrary to the best interests of the residents of this City. SECTION 3. Pending completion of such studies and recommendations of the Planning Commission, and pursuant to the provisions of Section 65858 of the Government Code, a moratorium is hereby imposed upon the construction of all structures and building on the hereinafter described property and any division of said property, and the provisions of the Irwindale Municipal Code authorizing any such construction or division are hereby suspended. SECTION 4. This Ordinance shall remain in effect until July 3, 1967, and the Building Inspector of -this City is directed to issue no building permits during the terms of this Ordinance upon the following described'�paecel of propertyi. All that property fronting on Galen Street in the City of Irwindale, County of Los Angeles, State of California, for a depth of 75', as shown on Exhibit "A" attached hereto, and incorporated herein by their reference. SECTION 5. This ordinance shall become immediately effective pursuant tothe provisions of Section 65858 of the Government Code and for the reasons above stated, and is adopted pursuant to the authority of Anderson V. Pleasant Hills, 229 ACA 81, Metro Realty v. Co. of El Dorado, 222 AGA 560, Hunter v. Adams, 180 2d 511, and Los Angeles v. Superior_Court, 221 ACA 151. SECTION 6. The City Clerk of the City of Irwindale shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and Shall cause this same to be posted.
