AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF IRWINDALE AMENDING
SECTION 4114 AND 4115 OF THE IRWINDALE
MUNICIPAL CODE RELATING TO GAMBLING
AND DECLARING THIS ORDINANCE IMMEDIATELY
EFFECTIVE.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES
ORDAIN:

SECTION 1. Section 4114 of the Irwindale Municipal
Code is hereby amended to read as follows:
Sec. 4114. Games Prohibited.
No person shall deal, play, carry on, open
or donduct any game or contest play with cards,
dice or any other device, for money, checks
credits or other thing of value; and no person
shall bet at any of said prohibited games or
contests.
Provided, however, that no provision of
this section shall be deemed or construed as
prohibiting any act made unlawful by the
provision of Section 320, or of Section 320a,
or of Section 330, or of Section 337a of the
Penal Code, or of any other code section or
general law of the State of California, it
being the intent of the City Council to
prohibit by this Section all games, operations
or transactions herein described whether of
chance or skill, not prohibited by the
provisions of any general law of this State.
SECTION 2. Section 4115 of the Irwindale Municipal
Code is hereby amended to read as follows:
Sec. 4115. Permitting Prohibited Games
on Premises.
No person shall knowingly permit any game
prohibited by this Chapter to be played,
conducted, or dealt in any house or other
premises owned by, rented by or in lawful
possession of such person.
SECTION 3. This Ordinance shall become immediately
effective as an urgency ordinance for the reason that it has
been ascertained that the existing code sections of
Irwindale regarding gambling are deficient in certain
particulars and could authorize certain games of skill or chance
unless a corrective amendment is adopted; that gambling in any
form would be contrary to the best interests of the residents of
Irwindale and being an undesirable element into the City.
For these reasons, the City Council finds and determines
that it is necessary to make this ordinance immediately effective.

SECTION 4. The City Clerk shall certify to the
adoption of this Ordinance and shall cause the same to be
processed in the manner prescribed by law.

being Ordinance No. 238, was introduced as an urgency
ordinance at a regular adjourned meeting of the City Council
of the City of Irwindale, held on the 14th day of August, 1970,
and was duly passed, approved and adopted by said Council,
approved and signed by the Mayor and attested by the City Clerk
by the following vote of the Council:
AYES: COUNCILMEN: Chico, Pat Miranda, Diaz and
Mayor Mike Miranda;
NOES: COUNCILMEN: None;
ABSENT: COUNCILMEN: Breceda.
