HomeMy WebLinkAbout284ORDINANCE NO. 284 AN ORDINANCE OF THE CITY OF IRWINDALE AMENDING SECTION 4114 AND 4115 OF THE IRWINDALE MUNICIPAL CODE RELATING TO GAMBLING AND DECLARING THIS ORDINANCE IMMEDIATELY EFFECTIVE THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN: SECTION 1. Section 4114 of the Irwindale Municipal Code is hereby amended to read as follows: Sec. 4114. Games Prohibited. A person shall not: a) Deal, play, carry on or conduct, i) Any game where players bet or wager money, checks, credits or other things of value against each other; or ii) Any game of chance for money, checks, credits or other things of value. b) Bet or wager at or on any such game. Provided, however, that no provision of this section shall be deemed or construed as prohibiting any act made unlawful by the provision of Section 320, or of Section 320a, or of Section 330, or of Section 337a of the Penal Code, or of any other code section or general law of the State of California, it being the intent of the City Council to prohibit by this Section all gambling herein described, not otherwise prohibited by the provisions of any law of this State. SECTION 2. Section 4115 of the Irwindale Municipal Code is hereby amended to read as follows: Sec. 4115. _Permitting Prohibited Games on Premises. No person shall knowingly permit any game prohibited by Section 4114 to be played, conducted, or dealt in any house or other premises owned by, rented by or in lawful possession of such person. SECTION 3. This Ordinance shall become immediately effective as an urgency Ordinance for the reason that it has been ascertained that the existing code sections of Irwindale regarding gambling, as adopted by Ordinance No. 238, are deficient in certain particulars and have been placed in jeopardy by a recent ruling of the Appellate Department of the Superior Court challenging a similar Los Angeles County Ordinance; that gambling in any such form would be contrary to the best interests of the residents of Irwindale and bring an undesirable element into the City. 471 4'72 Ordinance No. 284 For these reasons, the City Council finds and determines that it is necessary to make this Ordinance immediately effective. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be processed in the manner prescribed by law.
