HomeMy WebLinkAbout286475 ORDINANCE NO. 286 AN ORDINANCE OF THE CITY OF IRWINDALE ADDING NEW SECTION 9496 TO THE ZONING CODE RELATING TO JUNK, SALVAGE AND DISMANTLING YARDS. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN: SECTION 1. The Irwindale Zoning Code is hereby amended by repealing the current definitions of automobile wrecking and junk yards and reenacting two new definitions as follows: Automobile Dismantling Yard. Any premises used for the dismantling or wrecking of motor vehicles required to be registered under the Vehicle Code of the State, including the buying, selling or dealing in such vehicles or integral parts or component materials thereof and the storage, sale or salvage of dismantled, partially dismantled, or wrecked, inoperative vehicles. Automobile dismantling shall not include the incidental storage of inoperative or disabled vehicles in connection with the legal operation of an automobile repair garage of body and fender shop. Junk and Salvage Yard. Any premises used for the storage or keeping of old, used, or second-hand scrap, ferrous and non-ferrous metals, brick and building materials, including roofing and tar paper cloth and clothing, wood and wood products, rubber tires, rope and plastic products, paint, clay and porcelain products, trash and similar materials and shall include dismantled machinery, equipment and parts, but shall not include any business defined as an automobile dismantling yard by this chapter. SECTION 2. A new Section 9496 reading as follows is hereby added to the Irwindale Municipal Code. 9496 wherever in the Irwind4leZoning Code automobile dismantling yards or junk and salvage yards (Section 9491 (1) and (15))are allowed as a permitted use or as a Conditional Use, the operation of the same (hereinafter referred to as 'Iyards") shall be subject to the following regulations: A. All operations and storage, including all equipment used in conducting such use, other than parking shall be conducted within',an area enclosed as hereinafter set forth. B. Walls and fences shall be constructed as follows: (1) A masonry decorative block wall (at least 50% percent open) a minimum height of 8 feet, shall be constructed along and parallel to any street or alley. (2) A solid masonry wall 8 feet in height shall be constructed along the property lines abutting property zoned for commercial or residential uses. Concrete tilt -up panels may substituted with the Planning Commission approval, if appropriately textured. ORDINANCE NO. 286 476 (3) The remainder of the perimeter of any dismantling yard shall be enclosed by a 6 foot solid fence constructed of masonry, metallic, concrete or asbestos panels with a permanent finish or painted with a uniform natural color which blends with the surrounding area. (4) All walls and fences shall be constructed of new materials, unless used materials will provide the equivalent service, appearance, and useful life, when approved by the Planning Commission. (5) All walls and fences shall be maintained at all times in a neat and orderly condition (repaired immediately when so notified). C. Any structures which are used as part of the wall or fence shall be constructed and/or painted to conform with the color and/or materials of the wall or fence. D. Landscaped areas with irrigation shall be provided for every such "yard" in accordance with the following: (1) A five (5) foot wide area located on the street side of every required wall (between the property line or wall) running parallel to the street the full length of such yard. (2) All landscaping shall be subject to approval of the Planning Commission. (3) All landscaping shall be maintained in an acceptable standard. E. No wrecked or dismantled vehicles or junk or salvage shall be placed, stored or allowed to remain outside of the individually enclosed "yards". F. No wrecked or dismantled vehicles or junk or salvage shall be placed or stacked at a height greater than the required wall or fence; all crane booms shall be lowered as far as possible when not in use. G. The hours of operation shall be limited to: 8 a.m. to 6 p.m. Sunday through Friday 8 a.m. to 9 p.m. on Saturday H. All existing "yards" shall comply with A through G within one (1) year after the effective date of this Ordinance, except as follows: i. Existing "yards" shall have two (2) years to comply with B. (3); ii. Existing "yards" that do not have at least a five (5) foot area per D.(1) shall landscape only the area between the street and the wall. ORDINANCE NO. 286 SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be processed in the manner prescribed by law. 24th PASSED and APPROVED this / day of July 1975.
