HomeMy WebLinkAbout289ORDINANCE NO. 289 AN ORDINANCE AMENDING ORDINANCE NO. 256 OF THE CITY OF IRWINDALE BY ADOPTING BY REFERENCE THE LOS ANGELES COUNTY MECHANICAL CODE AS CONTAINED IN THE 1975 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS,, INC. AND INCLUDING THE APPENDIX THERETO AND MAKING OTHER AMENDMENTS'. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 256 entitled "Mechanical Code" adopted June 29, 1972 is hereby amended by adopting by reference, , except as hereinafter provided, that certain Mechanical Code known and designated as the Los Angeles County Mechanical Code as contained in the,1975 edition of the Los Angeles County Building Laws published by the Building News, Inc. and including the appendix to said Los Angeles County Mechanical Code and such code, except as herein provided, shall be and become the Mechanical Code of the City of Irwindale, providing for the issuance of permits and the collection of fees therefor and providing penalties for violation of such code. Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Irwindale and shall be at all times maintained by said Clerk for use and examination by the public. SECTION 2. Whenever any of the following names or terms are used in said Los Angeles County Mechanical Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows: "Board of Appeals" or "Board of Examiners of Plumbers" shall mean the Board of Examiners of Plumbers, Gas Fitters and Sewerage Contractors of the County of Los Angeles established by Section 73 of the Los Angeles County Plumbing Code as published in the 1975 edition of the Los Angeles County Building Laws preveiously referred to in this ordinance. "Building Department" shall mean the "Building and Safety Division" of the Department of the County Engineer. "Building Code", "Uniform Building Code" or "Los Angeles County Building Code: shall mean Ordinance No. 287 of the City of Irwindale entitled Building Code. "Building Official" shall mean County Engineer of the County of Los Angeles. "City" shall mean the City of Irwindale. "Electrical Code" shall mean Ordinance No. 290 of the City of Irwindale, entitled Electrical Code. "Fire Code" or "Los Angeles County Fire Code" shall mean Ordinance No. 236 of the City of Irwindale, entitled Fire Code. 489 Ordinance No. 289 "General Fund" shall mean the City Treasury of the City of Irwindale. "Health Code", or "Los Angeles County Health Code" shall mean Ordinance No. 218 of the City of Irwindale, an ordinance adopting a Health Code. "Mechanical Code" shall mean -the Mechanical Code of the City of Irwindale. "Plumbing Code" shall mean Ordinance No. 288 of the City of Irwindale, entitled Plumbing Code. SECTION 3. Section 108 of said Los Angeles County Mechanical Code is amendgd to read: Section 108. Violations and Penalties. It shall be unlawful for any person, firm or corporation to erect, install, alter, repair, relocate, add to, replace, use or maintain heating, ventilating, comfort cooling, or refrigeration equipment in the jurisdiction or cause the same to be done, contrary to or in violation of any of the provisions of this Code. Maintenance of equipment which was unlawful under this Code if installed after the effective date of this Code, shall constitute a continuing violation of this Code. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this;Gode is committed, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or; by both such fine and imprisonment. SECTION 4. Section 304 of said Los Angeles County Mechanical Code is amended to read as follows: SECTION 304 - PERMIT FEES. Any person desiring a permit required by this Code, shall, at the time of filing an application therefor, pay a fee as required by this _section. However, occupancy inspection corrective work, as. defined in Sec -tion 306(a) of the Building Code, is exempted from further fees when the total valuation for the corrective work is under $1,000. 1. For the issuance of each permit ----------- $ 4.50 2. For the installation, alteration or re- location of each refrigeration compressor or absorption unit, and for each fuel burning furnace, heater, boiler and vented decorative appliance including vents attached thereto: Up to and including 100,000 BTU --------------- 7.50 More than 100,000 BTU to and including 500,000 BTU ----------------------------- 11.25 More than 500,000 BTU to and including 1,000,000 BTU ---------------------------- 15.00 490 Ordinance No. 289 More than 1,000,000 BTU to and including 2,000,000 BTU --------- ------ 22.50 More than 2,000,000 BTU 37.50 3. For the installation, relocation or replacement of each appliance vent installed and not included in an appliance permit -------- 3.00 4. For the installation or alteration of each air handling unit for air conditioning including ducts attached thereto: Up to and including 2,000 CFM Each Unit up to 10 --------------------- 3.00 Each unit over 10 ---------------------- .75 More than 2,000 CFM to and including 10,000 CFM ---------------------------- 7.50 More than 10,000 CFM ---------------- 15.00 Note: This fee shall not apply to an 'air handling unit which is a portion of a factory assembled air conditioning appliance for which a permit is required elsewhere in this Code. 5. For each evaporative cooler other than portable type------------------------------------- 4.50 6. For required ventilation fans which serve a single register Each fan up to 10 ---------------------- 3.00 Each fan over 10 ---------------------- .75 7. For each required ventilation system which is not a portion'of any air conditinning system for which a permit is required elsewhere in this code. ------------------------------- 6.00 8. For the installation of each commercial kitchen hood or spray booth served by mechanical exhaust, including the fans and ducts attached thereto ------------------------- 7.50 9. For the alteration of an existing duct system for which a permit -is not required elsewhere in the Code ------------------------------ 4.50 SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be processed in the manner prescribed by law. APPROVED arid ADOPTEDthis14th day of August, 1975.
