HomeMy WebLinkAbout315I ORDINANCE NO. 315 AN ORDINANCE OF THE CITY OF IRWINDALE. ADDING NEW SECTIONS 4152 THROUGH 41{2 D OF THE IRWINDALE MUNICIPAL CODE RELATING TO GRAFFITI. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Sections 4152 through 4152D, reading as follows are hereby added to the Irwindale Municipal Code: Section 4152. Graffiti, Prohibition. It shall be unlawful for any person to paint, chalk, or otherwise apply graffiti or other inscribed material on public or privately owned permanent structures located on public or privately owned real property within the city. Section 4152 A. Graffiti, Removal by Violator. Any person applying graffiti within the city shall have the duty to remove the same within 24 hours after notice by the city of by the public or private owner of the property involved. Failure of any person to so remove graffiti shall constitute an additional violation. Where graffiti is applied by juveniles, the parent or parents shall be responsible for such removal or for the pay m ent therefor. Section 4152 B. Graffiti, Removal by Owner. It is hereby declared to be a public nuisance for the owner of any property, public or private, to permit graffiti to remain thereon for more than 72 hours after notice from the city to remove the same. Abatement proceedings shall be conducted pursuant to Section P.C. 370, C.C. 347980, or appropriate section of the Municipal Code. Section 4152 C. Graffiti, Public Removal. After a finding by the City Council that any graffiti or other inscribed material is obnoxious --and after securing, in the case of a publicly owned structure, the consentobf the public entity having jurisdiction thereof, and in the case of the privately owned structure, after securing the consent of the owner thereof --the City Council may order, at public expense, the removal of such graffiti or other inscribed material. Section 4152 D. Graffiti, Misdemeanor. Violation of this ordinance is declared unlawful and shall constitute a misdemeanor, punishable by a fine of not to exceed $500.00, or imprisonment tot to exceed six months, or both. Every day of such violation shall constitute a separate offense. Ordinance No. 315 Section 2. The City Clerk of the City of Irwindale shall certify to the passage and adoption of this ordinance and to its approval by the Mayor and shall cause the same to be posted as required by law.
