Home My WebLink About31960 ORDINANCE N0, 319 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING ORDINANCE NO. 287 OF THE CITY OF IRWINDALE BY ADOPTING BY REFERENCE THE IAS ANGELES COUNTY BUILDING CODE CONTAINED IN THE 1977 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC. FOR AND INSTEAD OF THE PRESENT BUILDING CODE AND MAKING OTHER AMENDMENTS. THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 287 entitled "Building Code" adopted August 14, 1975 is hereby amended by adopting by reference, except as hereinafter,provided, that certain Building Code known and designated as the Los Angeles County Building Code as contained in the 1977 Edition of the Los Angeles County Building Laws published by Building News Inc., and such code shall be and become the Building Code of the City of Irwindale, regulating the erection, construction, enlargement, alteration., repair, moving, removal, demolition, conversion, accupanay, use., height,.area, maintenance of all structures and certain equipment therein specifically regulated and grading within the City of Irwindale, and providing for the issuance of permits, and the collection of fees therefore, providing penalties for violation of such code, declaring and establishing fire zones. Three copies of said Los Angeles.County.Building Laws have been deposited in the office of the City Clerk of the City of Irwindale and shall be at all times maintained by said Clerk for use and examination by the public. Said edition,of the Los Angeles County. Building Code, except as provided hereinafter, is hereby substituted for, and shall take place of, the Building Code set forth.in said Ordinance No. 287, and such amending ordinances previously adopted. SECTION 2. Section 101 of said Los Angeles County Building Code is amended to read Section 101. Title, Ordinance No. 319, adopted January 26, 1978, shall be known as the "Building Code", may be cited as such, and will be ,referred to herein as "this Code?. The provisions of said Ordinance No. 319 applying to dwellings, Lodgings, houses, hotels, apartment houses, convents, monasteries, or other uses classified by this Code as a Group R-1 or R-3 occupancy and including Chapters 1, 22 3, 43 98 and 99 is and may be cited as the "Housing Code". SECTION 3. Section 207 of said Los Angeles County Building Code is amended to read: Section 207. ]Definitions. Whenever any of the names or terms � defined in this Section are used in this Code, each such name or - term shall be deemed and construed to have the meaning ascribed to . it in this Section. "Board of Appeals" shall mean the Board of Appeals established by Section 206 of said Los Angeles County Building Code. "Building Department" shall mean the "Building and Safety Division" of the Department of County Engineer. "Building Official" shall mean County Engineer of the County of Los Angeles. "City" shall mean the City of Irwindale except in Section 103 of said Building Code. 61 Ordinance No. 319 "County", "County of 'Los Angeles" or "unincorporated territory of the County of Los Angeles" shall mean the City of Irwindale. "County Engineer" shall mean the County Engineer of the County of Los Angeles. "Electrical Code" shall mean Ordinance No. 322 of the City of Irwindale. "Fire Code" shall mean Ordinance No. 236 of the City of Irwindale. "Fire Zone" shall mean the fire zone adopted by an ordinance creating and establishing fire zones or where no such fire zones have been adopted by the City of Irwindale.shall be considered to s be in Fire Zone No. 3. "General Fund" shall mean the City Treasury of.the City of Irwindale. "Health Code" pr "Los Angeles County Health Code" shall mean Ordinance No. 218 of the City of Irwindale. "Health Officer" shall mean the Health Officer of the City of Irwindale. "Mechanical Code" shall mean Ordinance Na.:321 of the City of Irwindale. "Plumbing Code" shall mean Ordinance No. 320 of.the City of Irwindale. "Special Inspector" shall mean a person holding a valid certificate of Registration issued by the County of Los Angeles as set forth in Section 305 (b) of said Los Angeles County Building Code. SECTION 4. Section 208 of the Building Code of the City of Irwindale shall read as follows: Section 208 (a). Compliance with Code. A person whAll not erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or. structure or perform any grading in the City or cause the same to be done, contrary to, or in violation of any of the provisions of: this Code. (b) Penalty. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall'.be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is Committed, continued or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or by both such fine and imprisonment. SECTION 5. Section 303 of said Los Angeles Building. Code is amended by amending Table No. 3-A to 1'k times the fees shown. SECTION 6. Said Los Angeles County Building Code is amended by deleting Section 307 therefrom. SECTION 7. Section 9906 of said Los Angeles County Building Code is amended to read: 62 Ordinance 319 Section 9906. .Building Rehabilitation Appeals Board. In order to hear appeals provided for in Chapter 98 and in this chapter, there shall be and is hereby created a Building Rehabilitation Appeals Board consisting of five (5) members who are qualified to pass on matters pertaining to substandard building and property. The members of the Board shall be appointed by and hold office at the pleasure of the City Council of the City. of Irwindale and may recommend such new Legislation as deemed necessary. The Board shall adopt reasonable rules and regulations for conducting its investigations. The Building Official shall be an ex -officio nonvoting member and act as secretary. He shall keep a record of all proceedings and notify all parties concerndd of the findings and decisions of the Board. SECTION 8. Section 9907 of said Los Angeles County Building Code is deleted. SECTION 9. The provisions of said Ordinance No. 287 as amended by this ordinance insofar as they are substantially the same as the provisions of said Ordinance No. 223 prior to November 19, 1970 shall be construed as restatements and continudations and not as new enactments. All changes and modifications of the Uniform Building Code, 1975 Edition in said Ordinance No. 287 as amended by this Ordinance are reasonably necessary because of local conditions. This finding is made pursuant to Section 17958.5 of the State Health and Safety Code.
