ORDINANCE NO. 323
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF IRWINDALE AMENDING
SECTION 9490 (2) OF THE IRWINDALE
MUNICIPAL CODE, PURSUANT TO SECTION
65858 OF THE GOVERNMENT CODE AND
DECLARING THIS ORDINANCE IMMEDIATELY
EFFECTIVE.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN
AS FOLLOWS:
SECTION 1. The City Council of the City of Irwindale
finds that it has heretofor, through its Community Redevelopment
Agency, adopted a Plan involving the location of Miller Brewing
Company on certain lands as described in a Disposition and
Development Agreement, on file in the Office of the Community
Redevelopment Agency, which said Agreement was approved by the
City Council and, which said Agreement provides for the
installation by Miller Brewing Company of a manufacturing plant
for the manufacture of beer.
SECTION 2. The City Council further finds that Section
9490 (2), of the Irwindale Zoning Code, provides the following:
"Alcohol manufacture, other than for human consumption".
SECTION 3. The City Council further finds that it was
not the intent of such Section, in prohibiting alcohol manufacture
of, to prohibit the manufacture of beer and such use has been
specifically authorized by contract by the City Council.
SECTION 4. The City Council specifically finds that such
Section is not consistent with the intent of the Planning
Commission, the Community Redevelopment Agency (CRA), nor is
it consistent with the contracts actually authorized by such
bodies.
SECTION 5. Accordingly, Section 9490 (2) is hereby
amended and/or interpreted in such fashion as to indicate that
the prohibition of alcohol manufacture does not apply to the
manufacture of beer.
SECTION 6. The City Council declares that pArsuant to
Section 65858 of the Government Code, that it is necessary and
appropriate that this Ordinance become immediately effective
as amended to clarify existing Code provisions, in order to
permit the City and the Community Redevelopment Agency to carry
out its existing contracts, to avoid litigation and to permit
Miller Brewing Company to meet its construction contracts as to
make unnecessary employee layoffs or other financial
disadvantages.
-*-O"'' SECTION 7. The City Clerk shall certify to the adoption
of this Ordinance and shall cause the same to be processed in
the manner prescribed by law.

No. 323, was approved, passed and adopted at a regular
meeting of the City Council held on the 27th day of
April, 1978 by the following vote:
