AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF IRWINDALE AMENDING THE BUILDING CODE
RELATING TO GRADING, LOCATION OF BUILDINGS
AND SWIMMING POOLS IN RELATION TO SLOPES,
FLOOD HAZARDS AND GEOLOGIC HAZARDS.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 104(i) of the Building Code, adopted
January 26, 1978, is amended by adding a paragraph to read:
Drainage structures, devices or systems required by Chapter 70,
"Excavation and Grading", shall be maintained in a manner that will
insure their effectiveness.
SECTION 2. Section 301(d) of said Building Code is amended by
adding a paragraph to read:
Where proposed construction will affect site drainage, existing
and proposed drainage patterns shall be shown on the plot plan.
SECTION 3. Section 304(a) of said Building Code is amended by
adding a paragraph to read:
Prior to plan check of building plans for lots or parcels in
areas having slopes of five horizontal to one vertical (5:1) or
steeper, a site inspection shall be made. The fee for such in-
spection shall be as set forth in Section 303(f). The building
official may waive this inspection and fee when he determines that
the nature of the work does not require preinspection of the building
site. Such a preinspection shall not be required for a building pad
graded under the provisions of Chapter 70.
SECTION 4. Section 308(a) of said Building Code is amended by
adding a sentence after the third sentence to read:
The placement of the building and other structures (including
walls and fences) on the building site shall be such that water or
mud flow will not be a hazard to the building or adjacent property.
SECTION 5. Section 308(b) of said Building Code is amended by
amending Subdivision 2 to read:
2. Work requiring a building or grading permit by this code
is not permitted in an area determined by the County Engineer to be
subject to hazard from landslide, settlement or slippage. These
hazards include those from loose debris, slopewash and the potential
for mud flows from natural slopes or graded slopes. For the purpose
of this section, landslide, settlement or slippage does not include
surface displacement due to the earthquake faults.
SECTION 6. Section 308(b) of said Building Code is amended by
adding Paragraph "h" to Subdivision 3 to read:
(h) Notwithstanding any other provisions of this subsection,
the County Engineer may, at his descretion, deny a permit for any
building, structure or grading subject to a hazard of a geological
nature which cannot be mitigated and may endanger the health or
safety of the occupants, adjoining property or the public.
SECTION 7. Section 7005(b) of said Building Code is amended by
adding paragraph number 13 to read:

13. A drainage plan for that portion of a lot or parcel to
be utilized as a building site (building pad) including elevations
of floors with respect to finish site grade and locations of proposed
stoops, slabs and fences that may affect drainage.
SECTION 8. Section 7005 of said Building Code is amended by
adding Subsection (g) to read:
(g) Preplan Check Site Inspection. Prior to plan check of
grading plans, a site inspection shall be made. The fee for such
inspection shall be as set forth in Section 303(F).
The Building Official may waive this inspection and fee when he
determines that the nature of the work does not require preinspection
of the site.
SECTION 9. Section 7010(a) of said Building Code is amended
by deleting Exception 1, by renumbering Exceptions 2 and 3 to be 1 and
2 respectively and by adding a paragraph to read:
(a) Compaction. All fills shall be compacted throughout their
full extent to a minimum of 90 percent of maximum density as
determined by A.S.T.M. Soil Compaction Test D1557.70. Field density
shall be determined by a method acceptable to the Building Official.

Fill slopes in excess of a 2:1 steepness ratio are to be
constructed by the placement of soil a sufficient distance beyond the
proposed finish slope to allow compaction equipment to operate at the
outer surface limits of the final slope surface. The excess fill is
to be removed prior to completion of rough grading. Other construction
procedures may be utilized when it is first shown to the satisfaction
of the County Engineer that the angle of slope, construction method and
other factors will accomplish the intent of this section.
1. Fills not intended to support structures need not be
compacted to these standards if the Building official determines that
such compaction is unnecessary as a safety measure. In making this
determination, the Building Official may require that an investigation
be made by a soils engineer to establish the characteristics of the
soil, the amount of settlement to be expected and the susceptibility
of the soil to erosion or slippage.
2. Slope surfaces may be prepared for planting by scarifying,
by the addition of top soil, or by other methods provided such slopes
when so prepared otherwise comply with the requirements of this section.
SECTION 10. Section 7010(8) of said Building Code is amended
to read:
(g) Inspection and Testing. The soil engineer shall provide
sufficient inspection during fill placement and compaction operations
to determine that such work is being performed in accordance with the
conditions of plan approval and requirements of this Code. Continuous
inspection shall be provided by the soil engineer or his responsible
representative for all fills that will exceed a vertical height or
depth of 30 feet or result in a slope surface steeper than two
horizontal to one vertical.
Tests to determine density of the compacted fill soils shall
be made on the basis of not less than one test for each 2 foot
vertical lift of the fill but not less than one test for each 1,000
cubic yards of material placed. At least one-half of the required
tests shall be made at the location of the final fill slope, except
that not more than one such test need be made for each 50 horizontal
feet of slope in each 2 -foot vertical lift. Additional tests shall be
ps"formed where deemed necessary by the soils engineer or the Building
Official. All such density tests shall be reasonably uniformly
distributed within the fill or fill slope surface. Results of such
testing and location of tests shall be presented in the soil engineer's
report.

Sufficient tests of soil properties, including soil types
and shear strength, shall be made during grading operations to
verify compliance with design criteria. The results of such
testing shall be furnished to the Building Official upon the
completion of grading operations or when necessitated by varying
field conditions upon request by the Building Official.
SECTTON 11. Section 7011 of said Building Code is amended by
adding the following paragraphs to read:
Swimming pools shall be set back from slopes as required by
Figure 70-A for buildings subject to the following provisions:
1. The minimum setback distance from the bottom of any
slope shall be that applicable to slopes not steeper
than 2:1.
2. At the tops of cut or fill slopes, setbacks shall be
governed by dimension "e" which shall be measured from
the soil side of the pool structure. That portion of
the pool structure extending above the level of
measurement or within seven feet of the slope face
shall be capable of supporting the water in the pool.
Buildings shall be set back from natural slopes which exceed
2:1 according to the cut slope setback provisions of Figure 70-A
and the requirements of Figure 70-A-1.
SECTION 12. Section 7012(c) of said Building Code is amended
by adding the following sentence to read:
The grading shall provide for drainage around proposed
buildings and their appurtenances.
SECTION 13. Section 7012(e) of said Building Code is amended
to read:
(e) Overflow Protection. Berms, swales or other devices
shall be provided at the top of cut or fill slopes to prevent
surface waters from overflowing onto and damaging the face of the
slope. Gutters or other special drainage controls shall be
provided where the proximity of runoff from buildings or other
structures is such as to pose a potential hazard to slope integrity.
SECTION 14. Section 7013(a) of said Building Code is amended
by adding a paragraph to read:
Plant material shall be selected which will produce a coverage
of permanent planting effectively controlling erosion. Consider-
ation shall be given to deep-rooted plant material needing limited
watering; to low maintenance during the lifetime of the project;
to high root to shoot ratio(weight of above ground parts versus
root system), wind susceptibility and fire retardant characteristics.

agent shall notify the Building Official a minimum of 24 hours
before the grading operation is ready for each of the following

1. Initial Inspection: When the permittee is ready to begin
work, but before any grading or brushing is started.
2. Toe Inspection: After the natural ground is exposed and
prepared to receive fill, but before any fill is placed.
3. Excavation Inspection: After the excavation emplacement
is started, but before the vertical depth of the excavation exceed
ten feet.
4. Fill Inspection: After the fill emplacement is started,
but before the vertical height of the lifts exceed ten feet.
5. Drainage Device Inspection: After forms and pipe are in
place, but before any concrete is placed.
6. Rough Grading: When all rough grading has been completed.
7. Final: When all work, including installation of all
drainage structures and other protective devices, has been completed
and the as graded plan and required reports have been submitted.
The permittee need not wait for the inspector to arrive before
proceeding with the work.
The Building Official shall approve the work inspected or shall
notify the permittee or his agent wherein it fails to comply with the
requirements of this Code.
In addition to the called inspections specified above, the
Building Official may make such other inspections as he may deem
necessary to determine that the work is being performed in compliance
with the requirements of this Code. Investigations and reports by an
approved soil testing agency and/or geologist may be required.
SECTION 16. Subsection (c) of Section 7014 of said Building
Code is amended by adding the following paragraph.
In addition to the above, the grading contractor shall submit
a statement in writing that the work under his direction was per-
formed in accordance with the approved plans and requirements of this
code or wherein such work was not in accordance with such plans and
code.
SECTION 17. Chapter 70 of said Building Code is amended by
amending Figure No. 70-A "Required Setbacks" to be as shown in this
ordinance.
SECTION 18. Section 7009(a) of said Building Code is amended
by adding a sentence after the first sentence to read:
Substantiating calculations and supporting data may be required
where the Building Official determines that such informathn is
necessary to verify the stability and safety of the proposed slope.
SECTION 19. The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be processed in the
manner prescribed by law.
