ORDINANCE NO. 395
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF IRWINDALE MAKING AN
ELECTION AS A CHARTER CITY REGARDING
PUBLIC WORKS PROJECTS
.THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS
FOLLOWS:
SECTION 1. Pursuant to the provisions of California Constitution
Article XI Section 5 and the cases of Vial v. San Dim 121, CA3d 346;
R & A v. L.A. 218 CR 667; Piledrivers v. City 198 CR 731, the City
Council finds and determines as follows:
SECTION 2. On all public works projects that are local in
nature (as determined by separate motion of the City Council), the
City does hereby exempt itself, as an exercise of a municipal
affair and is not bound by bid requirements, bond requirements,
prevailing wage requirements, or other requirements or limitations
General Law Cities and public works construction.
SECTION 3• Specifically, the City Council finds that the
Senior Citizen Center, Comminity Building, Police Department
Addition, Council Chamber and Swimming Pool (all in process) are
local projects to which the exemption in Section 2 applies.
SECTION 4. The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be processed in the
manner prescribed by law.
APPROVED and ADOPTED this 27th day of March, 1986.

do hereby certify that the above Ordinance, being Ordinance No.
395 was introduced at a regular meeting held on February 27, 1986,
and was duly passed, approved and adopted by said Council, approved
and signed by the Mayor and attested by the City Clerk at a regular
meeting held on the 27th day of March, 1986, by the following vote
if the Council.
