ORDINANCE NO. 404
AN ORDINANCE OF THE CITY OF IRWINDALE
ADDING NEW SECTION 9.53 TO THE IRWINDALE
MUNICIPAL CODE RELATING TO ADULT
BUSINESSES.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. New Section 9.53 reading as follows is hereby
added to the Irwindale Municipal Code:
Chapter 9.53 Adult Businesses
SECTION 9.53• No. "adult businesses" as defined in Ordinance
No. 401 (IMC #17.59.3), may maintain any closed area, booth, cubicle,
room or other such area (within its place of business) that could
be used for private sexual activity. No nudity or sexual activities
shall be allowed on the premises. All portions of the premises shall
be available by access and visual inspection at all times by any City
Inspector standing at the front door. Bona fide bathrooms are an
exception.
SECTION 2. This ordinance shall become immediately effective
for the reasons stated above and as authorized by the U.S. Supreme
Court in the cases of Acara v. Cloud and Renton v. Playtime.
SECTION 3. The Acting City Clerk of the City of Irwindale
shall certify to the passage and adoption of this Ordinance and to
its approval by the Mayor and shall cause the same to be posted as
required by law.

I, Charles R. Martin, do hereby certify that the foregoing
Ordinance, being Ordinance No. 404, was introduced at a regular
meeting held on the 17th day of July, and duly passed, approved
and signed by the Mayor and attested by the City clerk at a regular
meeting of said Council held on August28, 1986, by the following
vote of the Council:
AYES: COUNCILMEN: Breceda, Tapia, Diaz, P. Miranda
and Mayor Castellanos
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
