URGENCY ORDINANCE
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF IRWINDALE, CALIFORNIA AMENDING
THE CITY CODE BY ADDING SECTION 15.04.080
AS IT PERTAINS TO GENERAL LIABILITY INSURANCE
FOR BUILDING OR ENCROACHMENT PERMITS, AND
DECLARING THE URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF IRWINDALE, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. The following is added as Section 15.04.080 to the
City Code.
SECTION 25.903 - General Liability Insurance Coverage.
No Individual or business employing any worker or possessing a
State of California Contractor's License shall be issued a building
permit or an encroachment permit by the City of Irwindale for any
building activity valued at more than $200.00 as provided for in this
Code, or for the encroachment upon any public right of way without
having first provided written proof of possession of current general
liability insurance coverage in an amount and form to be established
by the City Engineer.
SECTION 2. Government Code Section 53080, which became effective
January 1, 1987, prevents a city from requiring an applicant for a
building permit to show evidence of bodily injury or property damage
insurance unless the City has adopted an ordinance imposing this
requirement. Such insurance protects homeowners and occupants, in
the case of building permits, from the negligent acts of the
applicants in performing the work for which the permit is issued.
The City of Irwindale currently requires evidence of such insurance
prior to the issuance of building and encroachment permits, but does
not impose this requirement pursuant to an ordinance. This ordinance
will permit the City to continue to require evidence of bodily injury
and property damage insurance prior to issuing building and encroach-
ment permits, it is necessary for the immediate preservation of peace,
health and safety, and shall take effect immediately upon its adoption.
SECTION 3. The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be published in the manner
prescribed by law.
