ORDINANCE NO. 417
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF IRWINDALE IMPOSING A MORATORIUM UNDER
GOVERNMENT CODE SECTION 65858 PERTAINING TO
1) MULTI -TENANT BUSINESS ENTERPRISES WITHIN A
SINGLE BUILDING OR PORTION THEREOF; 2) OUTDOOR
AND INDOOR SWAP MEETS AND OTHER NON -COMPARTMEN-
TALIZED, BUT SEPARATELY OPERATED ASSEMBLAGES
OF RETAILERS
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN
AS FOLLOWS:
SECTION 1. Section 17.08.510 of the Irwindale City
Code is hereby amended by adding:
17.08.510. Unit, Commercial and Manufacturing:
Means a space occupied by a Business
Enterprise(s) located within a building or
portion of a building with direct access from the
outside or from a common interior accessway
intended for use by the general public. A
commercial or manufacturing unit shall have the
following features:
A completely enclosed room or interconnecting
rooms with lockable doors to common accessways or
the exterior, full walls from the floor to the
ceiling, independent cooling and ventilation
controls, independent lighting which is
controlled within the unit itself.
SECTION 2. Section 17.80.030 of the Irwindale City
Code is hereby amended by adding:
17.80.030 CONDITIONAL USE PERMITS. WHEN REQUIRED
E-1. Commercial units of more than 4,000 sq.
ft. and Manufacturing units of more
than 4,000 sq. ft. which are shared by
more than one independently owned
business enterprise in the C Zones and
the M Zones.
SECTION 3. Section 17.64.030 of the Irwindale City
Code is hereby amended by adding:
R Unit, Commercial
For any commercial unit as defined in
Section 17.08.510 - one (1) parking space
for each 250 square feet of gross floor
area, with a minimum of three (3) parking
spaces for each commercial unit.
S. Unit, Manufacturing
For any manufacturing unit as defined in
Section 17.08.510 - one (1) parking space
for each four hundred (400) square feet of
gross floor area, with a minimum of three
(3) parking spaces for each manufacturing
unit.
SECTION 4. Section 17.08 of the Irwindale City
Code is amended by adding new Section 17.08.491, reading as
follows:
17.08.491 Swap Meets. "Swap Meets" are defined
as those businesses which rent or lease small areas (+
1,000 sq. ft.) to retailers as a part of a larger
retail area in which several of such small areas are

similarly leased to other retailers, the predominant
theme of which is to present multi -operated sales of
new or used goods for a limited number of days per
month.
SECTION 5. This ordinance shall become immediately
effective as a moratorium against all uses inconsistent
herewith and shall remain in effect for a period of 45 days
unless further extended during which time all ordinances of
the City inconsistent with this ordinance shall be
superseded, and the building and zoning officials of the
City are directed to not issue permits for use or
construction inconsistent with this ordinance. The reasons
for the urgency are as follows:
A. Studies indicate that the sectioning of existing
store fronts into smaller subdivisions result in
increased parking needs.
B. The City presently has no regulations controlling
the segmentation of existing buildings into
smaller units.
C. Swap meets create traffic, and criminal and
social problems by virtue of the crowds attracted
thereto.
D. That there appears to this City Council to be a
need for immediate control of further
segmentation until the social and economic
problems relating thereto are resolved.
E. That permiting further segmentation before
adoption of final rules could only serve to
enhance problems already in the formative stages.
SECTION 6. The City Clerk shall certify to the
passage and adoption of this Ordinance and shall cause the
same to be published according to law.

I hereby certifyt the foregoing urgency ordinance,
being Ordinance No. 41 was introduced as an urgency
ordinance at a regular meeting of the City Council of the
City of Irwindale, held on the 30th day of July, 1987, and
was duly passed, approved and adopted by said Council,
approved and signed by the Mayor and attested by the Deputy
City Clerk by the following vote of the Council:
AYES: Councilmen: J. Breceda, R. Diaz, P. Miranda,
J. Castellanos, and Mayor A. Tapia
