AN URGENCY ORDINANCE OF THE CITY OF IRWINDALE
ADDING NEW SECTIONS 8.24.291 AND 8.24.292
TO THE IRWINDALE MUNICIPAL CODE RELATING TO THE
OPERATION OF LANDFILL OPERATIONS WITHIN THE CITY
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS
FOLLOWS:
SECTION 1. New Sections 8.24.291 and 8.24.292 reading
as follows are hereby added to the Irwindale Municipal Code:
8.24.291 Depth of fill. In order to protect underground
water supplies and aquifers, no person shall place, or
permit to be placed, any disposal of waste (except class 3
materials) in any area less than 100 feet above high water
table elevation as determined by USGS survey.
8.24.292 Use of fill. No person shall use any landfill
operation or otherwise dispose of waste (except class 3
materials) when said material is brought from an area more
than ten (10) miles distant from the disposal site. This
section is enacted in order to provide a continuing
capacity for landfill operations in this immediate area
and to discourage inputting of such material from
elsewhere.
SECTION 2. This Ordinance shall become effective
immediately as an emergency ordinance for the following reasons:
1. The City Council finds that landfill operations in
the vicinity have in the past and threaten again to
cause water pollution by reason of leachate;
2. That a buffer of 100 feet above high water table
elevation will reasonably protect against leachate,
and should any landfill operation have a capacity at
a depth lower than said 100 feet buffer, they will be
compelled to first refill such capacity with clean
dirt;
3. The current crises in landfill operations threatens
this area with a capacity of landfill operations
unless the waste streams for such facilities is
curtailed in a manner that requires each area of Los
Angeles County to share the problems inherent in such
operations, so that one area is not unduly burdened.
SECTION 3. The City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same to be
published according to law.

Irwindale, held on the 30th day of July, 1987, was duly passed,
approved and adopted by said Council, approved and signed by
the Mayor and attested by the Deputy City Clerk by the
following vote of the Council:

Castellanos, and Mayor A. Tapia
NOES: Councilmen: None
