The City Council finds and determines that it presently has no setback requirements for private streets, but that the City municipal code does maintain a 20 foot setback from public streets. Recently, developments have started on a private street known as Live Oak Lane with many of the setbacks at 20 feet, but with some far less than that; (a) that it is important that the setback line be established for construction purposes on private as well as public streets in order to avoid hazards of traffic, congestion, and line of sight; (b) that pending before the Building Department at the present time is a proposal for a 5 foot setback applied for by SIMBURG Co.; (c) that it is important to establish an immediate control for setback on private streets for all the foregoing reasons. SECTION 2. There is hereby declared a moratorium on all new construction, i.e., construction that has not yet obtained a valid permit, which is set back at less than 20 feet from private, as well as public streets, and all provisions of the municipal code inconsistent hereby are suspended; the Building Inspector is directed to issue no permits involving a setback of less than 20 feet. In particular, the application of SIMBURG for a permit of less than 20 feet setback is denied, and this ordinance shall apply to such application. SECTION 3. The City Clerk shall certify to the passage and adoption of this urgency ordinance and shall cause the same to be published according to law. APPROVED and ADOPTED this 24th day of September 1987.
