ORDINANCE NO. 429
AN URGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF IRWINDALE
IMPOSING A MORATORIUM UNDER THE
PROVISIONS OF GOVERNMENT CODE SECTION
65858 PERTAINING TO NEW CONSTRUCTION
AND NEW BUILDING PERMITS IN THE AREA
OF THE PROPOSED STADIUM, PENDING FURTHER STUDIES
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN
AS FOLLOWS:
SECTION 1. The City Council finds and determines that
it is giving serious consideration to establishing a
football stadium for the LOS ANGELES RAIDERS at or near the
area bounded by the 605 Freeway, Arrow Highway, Live Oak
Avenue, and Peck Road, and that such studies have indicated
that, if the Stadium is to be successful, it will have to be
surrounded with compatible uses;
FURTHER, that the establishment of incompatible uses in
that area could largely emasculate the benefits to be
received from the upgrading of the areas;
FINALLY, that the status and determination concerning
the RAIDERS STADIUM could be completed within a six-month
period.
SECTION 2. A Moratorium is hereby imposed on new
building permits, new construction, and new uses within the
following described streets; along the north and south sides
of Arrow Highway, Live Oak Avenue and Longden Avenue and
west of the I-605 Freeway.
SECTION 3. This Moratorium shall last for 45 days and
may thereafter be extended. During the effective period of
this Moratorium, all provisions of the Municipal Code
contrary to or inconsistent herewith shall be in suspense,
and the Building Inspector shall comply with this
Moratorium. There shall be exempted herefrom all uses for
which a building permit has already applied for and is
currently being processed.
SECTION 4. This Ordinance is adopted pursuant to
Government Code Section 65858, and the Council finds the
proper emergency exists in the manner and means as set forth
above.
ACCORDINGLY, this Ordinance shall become immediately
effective.
SECTION 5. The City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same to
be published according to law.
