HomeMy WebLinkAbout450"REVISED COPY" ORDINANCE NO. 450 AN ORDINANCE OF THE CITY COUNCIL OF CITY OF IRWINDALE AMENDING SECTIONS 5.08.430 AND ADDING SECTION 17.08.426 TO THE IRWINDALE MUNICIPAL CODE, RELATING TO QUARRIES AND ROCK CRUSHING OPERATIONS THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS: SECTION 1. For the purpose of clarification, Section 5.08.430, of the Irwindale Municipal Code is hereby amended to read as follows: 5.08.430 - Land Excavation. A. Definitions. The terms quarry, rock crushing, excavating, etc., as used in this section shall include (but not by way of limitation) any processing or production of any rock or rock product (whether natural, excavated, imported,- exported, mported;exported, removed, relocated, treated, crushed, re -crushed or otherwise dealt with in any manner) by any machinery operated by any person, firm, government, corporation, whether as owner, lessor, lessee, operator, licensee, or in any other capacity whatsoever, on, in, upon, to, from, or in any other way, involving property over which the City exercises or may exercise licensing and police power regulations of any nature whatsoever. B. Not withstanding any other provisions of this code relating to business license taxes, and in lieu of all other business license taxes imposed, there is imposed upon each person engaged in the business of extracting and or processing of rock, sand or gravel or similar material (hereinafter "material"), from any real property located within the city, for the purpose of commercial use thereof, in fill, construction or similar operations, other than on the property where so excavated, a business license tax of .1400 cents per ton of material extracted, whether or not thereafter processed, for the use described above in subsection A of this section. SECTION 2. Section 5.08.430 is further amended by increasing the tax rate prescribed therein (and subject to California Price Index increase as provided in Section 5.08.490) to .1400 cents per ton (Actual 140 per ton). SECTION 3. The following Section is hereby added to the Irwindale Municipal Code to read as follows: Section 17.08.426 - Quarry Operations Definitions.
