AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF IRWINDALE REPEALING CHAPTERS 15.04, 15.16
AND 15.20 OF THE IRWINDALE MUNICIPAL CODE AND
ADDING NEW CHAPTERS 15.04, 15.16, AND 15.20
THERETO, AND ADOPTING BY REFERENCE OF THE "LOS
ANGELES COUNTY BUILDING CODE" 1992 EDITION,
THE "LOS ANGELES COUNTY PLUMBING CODE" 1992
EDITION, AND THE "LOS ANGELES COUNTY
MECHANICAL CODE" 1992 EDITION, INCLUDING ALL
APPENDICES, WITH CERTAIN AMENDMENTS, ADDITIONS
AND DELETIONS THERETO, INCLUDING FEES AND
PENALTIES.
A. Recitals.
(i) Article 2 of Chapter 1 of Part 1 of Division 1 of
Title 5 of the California Government Code (§§ 50022.2, et seq.)
authorizes the adoption by reference of county codes, including
the above -entitled Codes of the County of Los Angeles.
/^11 (ii) A duly noticed public hearing, as required by
California Government Code § 50022.3, has been conducted and
concluded prior to the adoption of this Ordinance.
(iii) All legal prerequisites to the adoption of this
Ordinance have occurred.
B. ordinance.
The City Council of the City of Irwindale does ordain
as follows:
Section 1. In all respects as set forth in the
Recitals, Part A, of this Ordinance.

Section 3. Chapter 15.04 of the Irwindale Municipal
Code is hereby repealed, provided that said repeal shall not
apply to or excuse any violation thereof occurring prior to the
effective date of this Ordinance and provided further that the
Los Angeles County Building Code, 1990 Edition, as previously
adopted by reference and amended by Ordinances of this City,
shall continue to be applicable to construction wherein plans
have been submitted for plan check as of the effective date of
this Ordinance so long as the initial permit therefor is issued
no later than ninety (90) days after the effective date of this
Ordinance.
Section 3. A new Chapter 15.04 is hereby added to the
Irwindale Municipal Code to read, in words and figures, as
follows:

1115.04.010. Adoption of code.
"There is adopted as the 'City Building Code,'
except as provided in this Chapter, that certain
Building Code known and designated as the Los Angeles
County Building Code (Title 26 of the Los Angeles County
Code), including all appendices thereto and including
all changes made by the County of Los Angeles, and such
Code shall be and become the Building Code of the City
of Irwindale, regulating and controlling the design,
construction, quality of materials, grading, use,
occupancy, location and maintenance of all buildings or
structures and prescribing conditions under which such

work may be carried on within the City and providing for
the issuance of permits and the collection of fees
therefor.
"Los Angeles County Ordinance No. 92-0114,
effective October 29, 1992, amending Los Angeles County
Ordinance No. 90-0045, as previously adopted by the City
of Irwindale, is adopted in its entirety.
"15.04.x. Copies filed.
"Three copies of the Los Angeles County Building
Code, referred to Section 15.04.010 of this Chapter,
have been deposited in the office of the City Clerk of
the City of Irwindale and shall be at all times
maintained by said clerk for use and examination by the
public.
"15.04.x. Terms defined.
"Whenever any of the following names or terms are
used in the Los Angeles County Building Code, each such
name or term shall be deemed and construed to have the
meaning ascribed to it in this section as follows:
11(1) 'Board of appeals' means the board of
eo"�, appeals established by Section 206 of the Los Angeles
County Building Code.
"(2) 'Board of supervisors' means the city
council.
"(3) 'Building department' means the 'building
and safety division' of the department of county
engineer, acting for the City.
"(4) 'Building official' means the county
engineer.
19(5) 'City' means the City of Irwindale, except
in Section 103 of the Building Code.
1'(6) 'County,' 'County of Los Angeles' or
'unincorporated territory of the County of Los Angeles'
means the City.
11(7) 'County engineer' means the county engineer
of the County of Los Angeles.
11(8) 'Electrical Code' means Chapter 15.08 of
this Municipal Code.

11(9) 'Fire Code' means Chapter 15.12 of this
Municipal Code.
11(10) 'Fire zone' means the fire zone or zones
adopted by an ordinance creating and establishing fire
zones.
"(11) 'General fund' means the city treasury.
"(12) 'Health Code' or 'Los Angeles County Health
Code' means Chapter 8.04 of this Municipal Code.
11(13) 'Health officer' means the health officer of
the City.
11(14) 'Mechanical Code' means Chapter 15.16 of
this Municipal Code.

"The fee schedules adopted by Section 15.04.010 of
this Title 15 may be amended by resolution adopted by
the City Council of the City of Irwindale."
Section 4. It is hereby found that the County of Los
Angeles, in adopting its Ordinance No. 92-0114, has made all
appropriate required findings related to local conditions as
specified under the provisions of the California Health and
Safety Code.
Section �5. Chapter 15.16 of the Irwindale Municipal
Code is hereby repealed, provided that said repeal shall not
apply to or excuse any violation thereof occurring prior to the
effective date of this Ordinance and provided further that the
Los Angeles County Mechanical Code, 1990 Edition, as adopted by
reference and amended by Ordinances of this City, shall continue
to be applicable to construction wherein plans have been

1115.16.010. Adoption of Code.
"There is adopted as the 'City Mechanical Code',
except as provided in this Chapter, that certain
Mechanical Code known and designated as the Los Angeles
e County Mechanical Code (Title 29 of the Los Angeles
County Code), including all appendices thereto and
including all changes made by said County of Los
Angeles, and such Code shall be and become the
Mechanical Code of the City of Irwindale, regulating and
controlling the design, construction, installation,
quality of materials, operation and maintenance of
heating, ventilating, cooling, refrigeration systems,
incinerators and other miscellaneous heat -producing
appliances and providing for the issuance of permits and
the collection of fees therefor.
"Los Angeles County Ordinance No. 92-0116,
effective October 29, 1992, amending Los Angeles County
Ordinance No. 90-0047, as previously adopted by the City
of Irwindale, is adopted in its entirety.
"15.16.020. Copies filed.
"Three copies of the Los Angeles County Mechanical
Code, referred to Section 15.16.010 of this Chapter,
have been deposited in the office of the City Clerk of
the City of Irwindale and shall be at all times

1115.16.030. Terms defined.
"Whenever any of the following names or terms are
used in the Los Angeles County Mechanical Code, each
such name or term shall be deemed and construed to have
the meaning ascribed to it in this section as follows:
11(1) 'Board of supervisors' means the City
Council of Irwindale;
11(2) 'County' or 'County of Los Angeles' or
'unincorporated area' means the City of Irwindale;
11(3) 'Board of appeals' or 'board of examiners of
plumbers' means the board of examiners of plumbers, gas
fitters, and sewerage contractors of the County of
Los Angeles established in the Los Angeles County
Plumbing Code as published in the 1990 Edition of the
Los Angeles County Uniform Building Laws previously
referred to in this Title 15;
"(4) 'Building department' means the 'building
and safety division' of the department of the county
engineer;
11(5) 'Building Code,' 'uniform building' or 'Los

the City of Irwindale;
11(6) 'Building official' means county engineer of
the County of Los Angeles;
"(7) 'City' means the City of Irwindale;
11(8) 'Electrical Code' means the Electrical Code
of the City of Irwindale;
10(9) 'Fire Code' or 'Los Angeles County Fire
Code' means the fire code of the City of Irwindale;
11(10) 'Health Code,' or 'Los Angeles County Health
Code' means the health code of the City of Irwindale;
11(11) 'Plumbing Code' means the Plumbing Code of
the City of Irwindale.'

1115.20.010. Adoption of Code.
"There is adopted as the 'City Plumbing Code,'
except as provided in this Chapter, that certain
Plumbing Code known and designated as the Los Angeles

/^ County Plumbing Code (Title 28 of the Los Angeles County
Code), including all appendices thereto and including
all changes made by said County of Los Angeles, and such
Code shall be and become the Plumbing Code of the City
of Irwindale, regulating plumbing and drainage systems,
house sewers, private sewage disposal systems and
prescribing conditions under which such work may be
carried on within the City and providing for the
issuance of permits and the collection of fees therefor.
"Los Angeles County Ordinance No. 92-0115,
effective October 29, 1992, amending Los Angeles County
Ordinance No. 90-0046, as previously adopted by the City
of Irwindale, is adopted in its entirety.
1115.20.020. Copies filed.
"Three copies of the Los Angeles County Plumbing
Code, referred to Section 15.20.010 of this Chapter,
have been deposited in the office of the City Clerk of
the City of Irwindale and shall be at all times
maintained by said clerk for use and examination by the
public.
115.19.030. Terms defined.
"Whenever any of the following names or terms are
used in the Los Angeles County Plumbing Code, each such
name or term shall be deemed and construed to have the
meaning ascribed to it in this section as follows:
11(1) 'Administrative authority,' 'chief plumbing
inspector' or 'plumbing inspector' means the city
engineer, except in Section 4 of the plumbing code.
11(2) 'Board of examiners of plumbers, gas
fitters, and sewerage contractors' or 'board of
examiners' means the board of examiners of plumbers, gas
fitters, and sewerage contractors of the county
established in the Los Angeles County Plumbing Code.
11(3) 'City' means the City of Irwindale except in
Section 3 of the plumbing code.
"(4) 'County,' 'County of Los Angeles' or
'unincorporated territory of the County of Los Angeles'
means the City.
"(5) 'Gas fitting contractor,' 'journeyman gas
fitter,' 'journeyman plumber,' 'plumbing contractor,' or
'sewage contractor' means a person holding a valid
certificate of registration issued by the County as set

r'l forth in Section 72 of the Los Angeles County Plumbing
Code.
9115.20.040. Fee schedule; modification by
resolution.
"The fee schedules adopted by Section 15.20.010 of
this Title 15 may be amended by resolution adopted by
the City. Council of the City of Irwindale."
Section 10. It is hereby found that the County of Los
Angeles, in adopting its Ordinance No. 92-0115 has made all
appropriate required findings related to local conditions as
specified under the provisions of the California Health and
Safety Code.
section 11. Penalties for violation.
It shall be unlawful for any person, firm, partnership,
or corporation to violate any provision, or fail to comply with
any of the requirements, of this Ordinance or the Codes adopted
hereby. Any person, firm, partnership, or corporation violating
any provision of this Ordinance or the Codes adopted hereby or
failing to comply with any of their requirements shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be
punished by a fine not exceeding Five Hundred Dollars ($500.00)
or by imprisonment not exceeding six (6) months or by both such
fine and imprisonment. Each such person, firm, partnership, or
corporation shall be deemed guilty of a separate offense for each
and every day or any portion thereof during which any violation
of any of the provisions of this Ordinance or the Codes adopted
hereby is committed, continued or permitted by such person, firm,

partnership, or corporation, and shall be deemed punishable
therefor as provided in this Ordinance.
Sectio 12. Civil remedies available.
A violation of any of the provisions of this Ordinance
or the Codes adopted hereby shall constitute a nuisance and may
be abated by the City through civil process by means of
restraining order, preliminary or permanent injunction or in any
other manner provided by law for the abatement of such nuisance.
section 11. severability.
The City Council hereby declares that, should any
provision, section, paragraph sentence or word of this Ordinance
or the Codes hereby adopted be rendered or declared invalid by
any final court action in a court of competent jurisdiction, or
by reason of any preemptive legislation, the remaining
provisions, sections, paragraphs, sentences, and words of this
Ordinance and the Codes hereby adopted shall remain in full force
and effect.
Section 14. The City Clerk shall certify to the
adoption of this Ordinance and shall cause this Ordinance to be
published as required by law.
