HomeMy WebLinkAbout463ORDINANCE NO. 463 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE REPEALING ORDINANCE NO. 384 PERTAINING TO CREDITS FOR THE PAYMENT OF SALES AND USE TABES TO THE IRWINDALE COMMUNITY REDEVELOPMENT AGENCY. A. Recitals. (i) On October 17, 1985, this City Council adopted Ordinance No. 384, which Ordinance amended Ordinance No. 269 of the City, and provided "credits" against City sales and use taxes of sales and use taxes paid to the Irwindale Community Redevelopment Agency ("the Agency" hereinafter). (ii) Said Ordinance No. 384 was adopted in furtherance of the Agency's adoption of its Ordinance No. CR(I)85-2 providing for a sales and use tax payable to the Agency. (iii) The Agency adopted its Ordinance No. CR(I)85-2 in order to provide a revenue source to service its 1986 Sales and Use Tax Bond Issuance (the "Bonds" hereinafter). (iv) The Agency has entered into that certain Loan Agreement with the Irwindale Public Financing Authority to discharge the lien on sales and use tax revenues imposed thereon by Agency Resolution No. CR(I) 86-180 and to defease said Bonds. (v) Based upon the discharge of the lien and defeasance of said Bonds, the need for the Agency's Sales and Use Tax Ordinance no longer exists and the purposes for which Ordinance No. 384 was adopted have been obviated thereby. 1 (vi) All legal prerequisites to the adoption of this Ordinance have occurred. B. Ordinance. NOW, THEREFORE, the City Council of the City of Irwindale does ordain as follows: Section 1. In all respects, as set forth in the Recitals, Part A, of this Ordinance. section 3. Ordinance No. 384 hereby is repealed, in its entirety. sectiQn 3. Pursuant to the provisions of California Government Code § 36937, this Ordinance shall take effect immediately. Section 4. The City Treasurer hereby is instructed and directed to take any and all actions necessary to cause the reinstatement of sales and use taxes within the area encompassed by the City Industrial Development Project in favor of the City and the Mayor and/or City Manager, as the case may be, hereby are authorized directed to execute any and all documents, contracts and/or agreements as may be necessary or convenient to cause the City's contract with the State Board of Equalization for the performance of all functions incident to the administration or operation of the City's Sales and Use Tax Ordinance to be in full force and effect. Section 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published as required by law. pq 1993.
