HomeMy WebLinkAbout479r" ORDINANCE NO. 479 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING THE OFFICIAL ZONING MAP BY AMENDING THE ZONE DISTRICTS TO (R-3) HEAVY MULTIPLE RESIDENTIAL FOR THE PROPERTIES GENERALLY ADDRESSED AS 16140 ARROW HIGHWAY AND 16148 ARROW HIGHWAY AND 5172 AYON AVENUE, AND ENVIRONMENTAL FINDINGS IN SUPPORT THEREOF. A. Recitals. (i) The City of Irwindale has been developed with and pursuant to various zoning districts and zoning standards which currently present a broad spectrum of development opportunities. The current R-3 zoning district development standards present the standards most advantageous to the 100' development of higher density residential development. (ii) The City has experienced ongoing demand for affordable housing, and particularly housing available to senior citizens. A development site for such housing has been identified; this site comprises the parcels identified as 16140 Arrow Highway (C-3), 16148 Arrow Highway (C-3) and 5172 Ayon Avenue (A-1). These parcels are currently zoned either (C-3) Heavy Commercial -Residential, or (A-1) Agricultural. To accommodate the anticipated affordable housing development, City staff has determined that the zoning district should properly be (R-3) Heavy -Multiple Residential to ensure that adequate zoning related dwelling density is provided for on the ultimate site. 1 v^^ (iii) The Planning Commission determined, at its regularly scheduled meeting of January 6, 1994, that the best interests of the citizens of the City of Irwindale would be served by amending the official land use designations for the subject parcels to that of (R-3) Heavy Multiple Residential and made such recommendation to this City Council by resolution. (iv) This City Council, prior to action upon the Ordinance set forth herein, has conducted a duly noticed public meeting as required by and in conformance with law, and has concluded said hearing. (v) All requirements and preconditions necessary for the adoption of this Resolution have occurred. B. Ordinance. NOW, THEREFORE, the City Council of the City of Irwindale does ordain as follows: I. In all respects as set forth in the Recitals, Part A, hereinabove. 2. the City Council hereby finds and determines that the adoption of this Ordinance is categorically exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder pursuant to Sections 15305 and 15061(b)(3) of Division 6 of Title 14 of the California Code of Regulations. 3. Pursuant to the provisions of Section 753.5(c) of Title 14 of the California Code of Regulations, the City Council �""• finds as follows: In considering the record as a whole, there is 2 r^ A"^ no evidence before this City Council that the proposed Ordinance will have potential for an adverse impact on wildlife resources or the habitat upon which wildlife depends. Further, based upon substantial evidence including the staff report and exhibits and the information provided to the City Council during the public hearing, this City Council hereby rebuts the presumption of adverse effect as set forth in Section 753.5(c -1-d) of Title 14 of the California Code of Regulations. 4. The City Council hereby approves the changes of zoning district application for the subject parcels, as follows and directs that the Official Zoning Map of the City of Irwindale be amended to reflect such amendments: "A. The parcels generally addressed as 16140 and 16148 Arrow Highway, Irwindale, and further identified as Los Angeles County Assessor Parcel numbers 8417-029-017 and 8417-029-915 shall be redesignated on the Official Zoning Map of the City of Irwindale as described in Section 17.12.020 of the Irwindale Municipal Code, to (R-3) Heavy Multiple Residential from (C-3) Heavy Commercial Residential. "B. The parcel generally addressed as 5172 Ayon Avenue, Irwindale, and further identified as Los Angeles County Assessor Parcel Number 8417-029-918 shall be redesignated on the Official Zoning Map of the City of 3 Irwindale , as described in Section 17.12.020 of the Irwindale Municipal Code, to (R-3) Heavy Multiple Residential from (A-1) Agricultural." 5. The City Council declares that, should any provision, section, paragraph, sentence or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences and words of this Ordinance shall remain in full force and effect. 6. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published as r"" required by law. 1994.
