AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF IRWINDALE, ESTABLISHING AND CONFIRMING TIME
LIMITATIONS FOR THE NORA FRAIJO, PARQUE DEL
NORTH AND CITY INDUSTRIAL DEVELOPMENT
REDEVELOPMENT PROJECT AREAS WITHIN THE CITY OF
IRWINDALE, CALIFORNIA, PURSUANT TO THE
PROVISIONS OF CALIFORNIA HEALTH AND SAFETY
CODE SECTION 33333.6.
A. Recitals.
(i) Health and Safety Code Section 33333.6 requires
this Council to review, and if necessary establish by ordinance,
amended time limitations applicable to the redevelopment project
areas of the Irwindale Community Redevelopment Agency.
(ii) The time limitations referred to in Recital (i),
above, include a time limitation on Agency's establishment of
loans, advances and indebtedness pursuant to Health and Safety
Code subsections 33333.2(a)(2) or 33333.4(a)(2), which cannot
exceed twenty (20) years from the adoption of the subject
redevelopment plan (or the addition of a new area to that plan)
or January 1, 2004, whichever is later. Said time limitation
does not prevent Agency from incurring certain prescribed debts
related to low and moderate income housing.
(iii) The time limitations referred to in Recital (i),
above, include a time limitation on the effectiveness of a
redevelopment plan which cannot exceed forty (40) years from the
adoption of the plan (or the addition of an area to the plan) or
January 1, 2009, whichever is later.

(iv) The time limitations referred to in Recital (i),
above, include, with some stated exceptions, a limitation on
Agency paying indebtedness or receiving property taxes pursuant
to California Health and Safety Code Section 33670 so that the
same may not occur after ten (10) years from the termination of
the effectiveness of the subject redevelopment plan (or an area
added to that redevelopment plan).
(v) This Agency's Project Areas were commenced in
the following years and for the following terms:
(35) year term;
a. Nora Fraijo - formed in 1974 for a thirty-five
b. Parque del Norte - formed in 1976 for a
eo.- thirty-five (35) year term; and
c. City Industrial Development - formed in 1976
for a fifty (50) year term.
(vi) The purpose of this Ordinance is to establish
the time limitations specified in Health and Safety Code Section
33333.6 for the Agency's Project Areas.
B. Ordinance.
NOW, THEREFORE, the Council of the City of Irwindale
hereby does ordain as follows:
Section 1. It hereby is confirmed that the following
dates are the latest dates upon which Agency may establish loans,
advances and indebtedness for the following respective Project
Areas:

a. For Nora Fraijo, January 1, 2004;
b. For Parque Del Norte, January 1, 2004;
c. For City Industrial Development, January 1,
2004.
The time limitation confirmed in this Section 1 shall
not prevent Agency from incurring debt to be paid from Agency's
low and moderate income housing fund or establishing more debt in
order to fulfill Agency's housing obligations under California
Health and Safety Code Section 33413.
Section 2. Pursuant to California Health and Safety
Code subsection 33333.6(b), the following dates hereby are
established as the dates upon which the effectiveness of the
r Agency's Project Areas shall be deemed to be terminated:
a. For Nora Fraijo, the anniversary date of the
adopting ordinance in the year 2009;
b. For Parque Del Norte, the anniversary date of
the adopting ordinance in the year 2011;
c. For City Industrial, the anniversary date of
the adopting ordinance in the year 2016.
Section 1. Pursuant.to California Health and Safety
Code subsection 33333.6(c), except as provided in California
Health and Safety Code subsections 33333.6(g) and (h), the
following dates hereby are established as the latest dates on
which Agency shall pay indebtedness related to its activities in
or receive property taxes from its Project Areas:

a. For Nora Fraijo, the anniversary date of the
adopting ordinance in the year 2019;
b. For Parque Del Norte, the anniversary date of
the adopting ordinance in the year 2021; and
c. For City Industrial, the anniversary date of
the adopting ordinance in the year 2026.
Section 4. The City Clerk shall certify to the passage
of this Ordinance and shall cause the same to be published in the
manner required by law.
