HomeMy WebLinkAbout494f"* ORDINANCE NO. 494 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING SECTIONS 17.64.010 17.64.020 AND 17.64.030 (OFF-STREET PARKINGi) AND SECTION 17.24.020 (R-3 STANDARDS TO SENIOR HOUSING PROJECTS) OF TITLE 17 OF THE IRWINDALE MUNICIPAL CODE (ZONING} ORDINANCE). A. Recitals. (i) The City Council of the City of Irwindale has previously adopted the Municipal Code, including the Zoning Ordinance, which establishes the zoning and development standards for the City of Irwindale. Said Code has been, and may be amended from time to time pursuant to law. (ii) The Planning Commission of the City of Irwindale heretofore conducted, and concluded, a duly noticed public hearing, as required by law, and has recommended the adoption of the Ordinance set forth below. (iii) The City Council of the City of Irwindale has, prior to its action upon this Ordinance, conducted, and concluded, a duly noticed public hearing, as required by law, with respect to the adoption of this Ordinance. (iv) All legal prerequisites to the adoption of this Ordinance have occurred. B. Ordinance. The City Council of the City of Irwindale does ordain as follows: section 1. In all respects as set forth in the Recitals, Part A, of this Ordinance. 1 M Section 2. The City Council hereby finds, determines and concludes that the adoption of this Ordinance is exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to § 15061(b)(3) of Division 6 of Title 14 of the California Code of Regulations in that it can be seen with certainty that the adoption of this Ordinance cannot have a significant effect upon the environment. 8 at o J. Section 17.64.010 of Chapter 17,.64 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: 1117.64.010 impose. e""* "A. All regulations set forth in this chapter are r�' for the purpose of providing convenient off-street parking space for vehicles. The parking requirements of this chapter are to be considered as the minimum necessary for such uses permitted by the respective zone. "B. The intent of these regulations is to provide adequately designed parking areas with sufficient capacity and adequate circulation to minimize traffic congestion and promote public safety. It shall be the responsibility of the developer, owner, or operator of the specific use to provide and maintain adequate off-street parking. 2 r "C. Off-street parking facilities required and established pursuant to this chapter shall be continuously maintained for off-street parking and the temporary parking (not storage) of motor vehicles and shall not be utilized for any other purpose. "D. All parking, loading, storage, driveway, and vehicle maneuvering areas within any lot or parcel designated subject to the provisions of this chapter shall be kept and maintained so as to not detract from the appearance of the immediate neighborhood and to protect the health, safety, and welfare of the user, a vehicles, abandoned items, trash, debris, or rubbish, and free of potholes, sinkholes, standing water, cracks, and/or broken areas. Parking space delineation, pavement striping and related features, and signs shall be repainted, refurbished, and/or replaced when the same become faded, damaged or destroyed to such an extent as to no longer be effective. Such areas shall, further, be periodically resurfaced or sealed in order to minimize seepage of water through such areas into the ground below such areas." 3 occupant, and general public. Section 17.64.020 of Chapter 17.64 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: 1117.64.020 General Provisions. "A. Off-street parking facilities, for both motor vehicles and bicycles, shall be provided for any new building constructed, for any new use established, for any addition or enlargement of an existing building or use, and for any change in the occupancy of an existing building. "B. For additions or enlargements of any existing building or use, or any change of occupancy of manner of operation that would increase the number of parking spaces required, the additional parking spaces shall be required only for such addition, enlargement, or change and not for the entire building or use, unless required as a condition of approval or a conditional use permit. "C. The required parking facilities needed for any development shall be located on the same site or, if an irrevocable access and/or parking easement is obtained, the parking may be on an abutting site. Property within the ultimate right-of-way of a street or highway shall not be used to provide required parking or loading or unloading facilities. 4 M "D. The requirements of this chapter shall apply to temporary as well as permanent uses. "E. No existing use of land or structure shall be deemed to be nonconforming solely because of the lack of off-street parking facilities prescribed in this chapter. However, the facilities being used for off-street parking on the effective date of the ordinance codified in this chapter shall not be reduced in capacity to less than the minimum standards prescribed in this section. "F. Projects with unexpired site approvals or conditional use permits approved prior to the effective the date the site approvals or conditional use permits were approved. "G. All required off-street parking spaces shall be designed, located, constructed, and maintained so as to be fully usable during workday periods or as needed by the use of the premises. "H. Where the application of these schedules results in a fractional space, then the fraction shall be rounded to the higher whole number. 6� date of the ordinance codified in this title shall meet the requirements of the parking ordinance in effect on the date the site approvals or conditional use permits were approved. "G. All required off-street parking spaces shall be designed, located, constructed, and maintained so as to be fully usable during workday periods or as needed by the use of the premises. "H. The parking requirement for uses not specifically listed in the matrix shall be determined by the approval body for the proposed use on the basis of requirements for similar uses, and on any traffic engineering and planning data that is appropriate to the establishment of a minimum requirement. "J. In the calculation of parking requirements for centers, off -peak -hour uses from the normal operating hours of the center shall not be counted toward the parking requirement. "K. In situations where a combination of uses are developed on a site, parking shall be provided for each of the uses on the site according to the schedule given in this chapter." Beation ,5�. Section 17.64.030 K of Chapter 17.64 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: "K. Manufacturing uses research and testing laboratories, creameries, bottling establishments, bakeries, canneries, printing and engraving shops. N 0 Parking space for all vehicles used in conjunction with the business; and 1 space for each 2 employees on the maximum (most workers) working shift or 1 space for each 350 square feet for the first 10,000 W square feet of gross floor area, and 1 space for each 500 square feet for the next 40,000 square feet of gross floor area, and 1 space for each 1,000 square feet for the next 50,000 square feet of gross floor area and 1 space for each 2,000 square feet for all floor area over 100,000 square feet of gross floor area, whichever is the greater." @ection ¢. Section 17.64.030 O of Chapter 17.54 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: 110.1 Offices providing 1 parking space for each 2 customer service on employees on the maximum the premises. Section 7. Section 17.64.030 S of Chapter 17.64 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: "S. Unit, manufacturing Same number of spaces as (see: § 17.08.510). required under § 17.64.030K, minimum of 3 spaces for each manufacturing unit." Section q. Section 17.64.030 T of Chapter 17.64 of Title 17 of the Irwindale Municipal Code hereby is amended to read, in words and figures, as follows: "T. Warehousing and storage buildings n 1 parking space for each 1,000 square feet of the first 20,000 square feet of gross floor area, 1 space for each 2,000 square feet for the next 20,000 square feet of gross floor area and 1 space for each 4,000 square feet for all floor area over 40,000 square feet of gross floor area." Section 9. Section 17.64.030 of Chapter 17.64 of Title 17 of the Irwindale Municipal Code hereby is amended by the addition of a new paragraph U to read, in words and figures, as follows: 1117.64.030 U. In addition to the standards set forth herein for manufacturing and related uses (§ 17.64.030 K), unit, manufacturing (§ 17.64.030 S) and warehousing and storage buildings (§ 17.64.030 T), each r", such use shall also provide parking for the office use(s) on site based upon the requirements set forth in § 17.64.030 O, above, for the gross floor area thereof devoted to office/administrative use." Section 10. Section 17.24.020 of Chapter 17.24 of Title 17 of the Irwindale Municipal Code hereby is amended by the addition of a new paragraph D thereto to read, in words and figures, as follows: "D. Senior housing projects are permitted subject to approval of a conditional use permit issued pursuant to Chapter 17.80 of this Title. Notwithstanding the requirements of § 17.24.040, a senior housing project may vary from the otherwise applicable standards set r"� forth in this Chapter with regard to parking 0 requirements (§ 17.24.060 F2), dwelling unit size (§ 17.24.060 H), open areas (§ 17.24.080 A), accessory storage (§ 17.24.090 A), trash enclosures (§ 17.24.090 S) and utility area (§ 17.24.090 C) upon a showing by the applicant that deviations from the standards set forth therein will adequately address the unique needs of seniors. Factors to be considered with regard to such variations include, but are not limited to, the type of senior housing project proposed (i.e, ambulatory vs. residential care), the amenities included within the units and availability of off-site parking facilities (within 300 feet of the project)." l**N Section 11. The City Clerk shall attest to the adoption of this Ordinance and shall cause the same to be published as required by law.
