AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE
AMENDING CHAPTER 8.04 OF THE IRWINDALE MUNICIPAL CODE AND
ADOPTING BY REFERENCE LOS ANGELES COUNTY ORDINANCES, AT TITLE
11, HEALTH AND SAFETY, AND DIVISION 1 OF TITLE 8, PUBLIC HEALTH
LICENSES, AS AMENDED AND IN EFFECT ON MARCH 1, 1998, AND
REPEALING ALL OTHER ORDINANCES OR PORTIONS OF ORDINANCES IN
CONFLICT THEREWITH
RECITALS
A. The City Council of the City of Irwindale has adopted Los Angeles
County Ordinance No. 7583, as amended through and including December 31, 1967, as
the health code for the City of Irwindale, at Chapter 8.04 of the Irwindale Municipal
Code.
B. The City Council wishes to adopt the amendments to Ordinance 7583,
now Title 11, adopted by the County of Los Angeles since 1967 and through and
including March 1, 1998, and Division 1 of Title 8, including the amendments to those
titles by Los Angeles County Ordinance 97-0071, which amendments together protect the
public health and safety by authorizing the enforcement of the health and safety code and
requiring inspection of food establishments and posting of food establishment inspection
grades.
C. On August 24, 2000, the City Council of the City of Irwindale performed
the first reading of this Ordinance to amend Chapter 8.04 of the Irwindale Municipal
Code.
D. On September 14, 2000, the City Council of the City of Irwindale,
pursuant to a notice duly issued, conducted a public hearing to consider this Ordinance
amending Chapter 8.04 of the Irwindale Municipal Code.
E. The City Council wishes to amend Chapter 8.04 of the Irwindale
Municipal Code to adopt Title 11, and Division 1 of Title 8 of the Los Angeles County
Code, as those titles have been amended by the County of Los Angeles through and
including March 1, 1998.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES ORDAIN AS FOLLOWS:
SECTION 1: Section 8.04.010 of the Irwindale Municipal Code is hereby amended to
read as follows:
8.04.010 Title 11 and Division 1 of Title 8 of Countv Code--Adooted--Copies on file.
The "Health and Safety Code of the County of Los Angeles," the same being Title 11 of the Los
Angeles County Code, and the 'Public Health Licenses Code of the County of Los Angeles," the

same being Division 1 of Title 8 of the Los Angeles County Code, as those titles have been
amended through and including March 1, 1998, are adopted as the health and safety code for the
city (hereinafter referred to as "health code"). Three copies of the health code are on file in the
office of the city clerk of the city.
SECTION 2: Section 8.04.020 of the Irwindale Municipal Code entitled "Amendments
adopted by reference --Copies on file" is hereby deleted in its entirety.
SECTION 3: Section 8.04.040 of the Irwindale Municipal Code is hereby amended to
read as follows:
8.04.040 Violation --Penalty All violations of the provisions of the health code, as
adopted by the city pursuant to Section 8.04.010 herein, shall be a misdemeanor and subject to
the penalty provisions contained in Chapter 1.12 of the Irwindale Municipal Code.
SECTION 4: Full Force and Effect. Except as expressly amended herein, all other
subsections of Chapter 8.04 of the hwindale Municipal Code shall be unchanged and in full
force and effect.
SECTION 5: Effective Date. The City Clerk shall certify to the passage and adoption of
this ordinance by the City Council of the City of Irwindale and shall, within 15 days after its
final passage, cause the same to be published or posted, as required by law, and this Ordinance
shall take effect 30 days after its passage.
SECTION 6: Severabilitv. If any section, subsection, sentence, clause, phrase, or
portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of Irwindale hereby declares that it
would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or
portion thereof, irrespective of the fact that any one or more sections, subsections, sentences,
clauses, phrases, or portions thereof may be declared invalid or unconstitutional.
