SECTION 12: Section 17.56.020 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
"17.56.020 Uses requiring a conditional use permit. Because of
considerations of smoke, fumes, dust, odor, vibration or hazard, the
establishment or operation of the following uses in the M-2 zone shall not
be permitted unless a conditional use permit authorizing such use has
been granted:
1. Agricultural contractor equipment, sale or rental or both;
2. Alcohol manufacture, other than for human consumption (excluding
beer manufacture);
3. Asphalt plants;
4. Automobile wrecking or dismantling yards;
5. Automobile forwarding;
6. Acid manufacture;
7. Batching plants;
8. Blacksmith shops;
9. Blast furnaces or coke ovens;
10. Boiler works;
11. Breweries;
12. Brick tile, cement block or terra cotta manufacture;
13. Building material sales and storage yards;
14. Cement, lime, gypsum or plaster of paris manufacture;
15. Concrete and concrete products manufacture;
16. Contractor's storage yards;
17. Distillation of bones;
18. Drop forge industries;
19. Explosives, manufacture or storage;
20. Feed and fuel yards;
21. Gas manufacture or storage;

SECTION 13: Section 17.60.010 of the Irwindale Municipal Code is hereby amended in 100)
its entirety to read as follows:
"17.60.010 Uses requiring a conditional use permit. No person shall use,
or permit to be used, any portion of any real property which is classified in
zone Q, except for the following uses, or combinations thereof, unless a
conditional use permit authorizing such use has been granted:
1. Any use first permitted in the M-2 zone, subject to all the limitations
and restrictions imposed by Chapter 17.56, except as expressly
provided in this chapter;
2. Quarries;
3. Asphalt plants;
4. Batching plants;
5. Dumps, inert solid;
6. Block, tile or specialty plants, using or processing crushed rock,
sand, gravel, decomposed granite or similar material;
7. Accessory uses; provided such uses are established on the same
lot or parcel of land, are incidental to, and do not substantially alter
the character of any use permitted above, including, but not limited
to, signs aggregate dryers, truck storage, equipment and supply
storage, scales or weighing equipment and office and repair shop
structures; 110)

8. Any similar use not listed in this section but determined by the
Planning Commission to require a conditional use permit."
SECTION 14: Section 17.80.030 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
17.80.030 Conditional Use Permits -- When Required: The purpose of
any conditional use permit shall be to insure that the proposed use will be
rendered compatible with other existing and permitted uses located in the
general area of the proposed use. The following uses, having unique and
unusual characteristics, shall be permitted, provided that a conditional use
permit is first issued:
1.
Aircraft beacons, radio cones and any other directional devices or
stations;
2.
Airports, heliports and landing fields;
3.
Automobile trailer, trailer coach or mobile home parks (excluded
from R-1, R-2 and R-3 zones);
4.
Barrels, storage of empty barrels;
5.
Cemeteries (excluded form R-1, R-2 and R-3 zones);
6.
Commercial units of more than four thousand square feet and
manufacturing units of more than four thousand square feet which
are shared by more than one independently owned business
enterprise in the C zones and M zones;
7.
Churches;
8.
Dairies;
9.
Entertainment Permits (as a secondary or ancillary use to a
permitted primary use) for presentation of entertainment in a
restaurant, bar or eating establishment in a C or M zone or on the
premises thereof. Entertainment is defined as any dancing,
authorized singing, shows, exhibits, modeling or other
demonstration permitted or allowed by the owner, operator or
lessee of the premises. Any such permit as may relate to activities
that are protected as "speech" under the First Amendment, as well
as all other licenses, zoning actions or other city processes relating
thereto shall be processed by the appropriate agency as
expeditiously as practical, but not exceeding thirty days;

Educational institutions;
11.
Equestrian establishments, including academies, school
amusements and riding stables;
12.
Establishments or enterprises involving large assemblages of
people or automobiles, including, but not limited to, the following or
similar uses (excluded from the R-1, R-2 and R-3 zones):
a. Amusement parks,
b. Circuses or carnivals (for a period of thirty-one days or
longer) or fairgrounds,
C. Hospitals (excluded from the R-1, R-2 and R-3 zones),

d. Open-air theaters,
e. Racetracks and rodeos, 110)
f. Stadiums;
13. Hotels and motels;
14. Oil production facilities;
15. Parks, playgrounds and other public or private recreational
facilities;
16. Plating of metals, and finishing of metals, provided no perchloric
acid is used;
17. Public utility facilities, except as otherwise expressly herein
provided;
18. Utilities operated by mutual agencies, consisting of water wells, gas
metering and regulation stations, communications equipment
buildings, booster stations or appurtenances incident thereto, but
not including distribution mains;
19. Electric distribution and transmission substations except as the
same may be expressly authorized as permitted uses in the various
zones;
20. Radio or television transmitters;
21. All restaurants, eating establishments and on -sale ABC licenses;
22. Service stations (excluded from the A-1, R-1, R-2 and R-3 zones);
23. Sewage disposal plants (excluded from A-1, R-1, R-2 and R-3
zones);
24. Theaters;
25. All outdoor storage of building and contractor supplies;
26. All uses which involve the use, sale or storage of any materials
classified as toxic or hazardous by either the federal or state
government as a substantial part of the total use shall require a
CUP, as shall the parking or storage of vehicles used to carry such
materials."
SECTION 15:
If any section, subsection, sentence, clause, phrase, or portion of this
Ordinance is, for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this Ordinance. The City
Council of the City of Irwindale hereby declares that it would have adopted
this Ordinance and each section, subsection, sentence, clause, phrase, or
portion thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases, or portions thereof may be
declared invalid or unconstitutional.
SECTION 16:
Effective Date. This Ordinance shall be in full force and effect thirty (30)
days after its passage.
SECTION 17:
The City Clerk shall certify as to the passage and adoption of this

locations in the City of Irwindale.

ORDINANCE NO. 571
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
IRWINDALE, CALIFORNIA, AMENDING THE IRWINDALE ZONING
ORDINANCE TO REDUCE THE TYPES OF YARD USES LISTED AS
PERMITTED USES IN THE COMMERCIAL, INDUSTRIAL, AND
QUARRY ZONES AND ADOPTING PROCEDURAL REQUIREMENTS
FOR THEIR ESTABLISHMENT AND OPERATION
WHEREAS, "yard uses" are land uses, such as storage yards, that are
conducted in open yards, usually with minimal improvements to the property, restricting
industrial and commercial development by utilizing large areas for storage purposes,
creating visual blight and contributing very little to the City's revenues and goals for
future development; and
WHEREAS, the City has approximately 345 acres of land devoted to yard uses
and only 327 acres of vacant land available for commercial and industrial development,
and the continued unregulated growth of yard uses will result in the further reduction in
land available for more desirable commercial and industrial development; and
WHEREAS, the City of Irwindale Planning Commission conducted a number of
public workshops in 1998 and 1999 and concluded that the City needed to update its
land use regulations concerning yard uses; and
WHEREAS, on December 9, 1999, pursuant to Government Code Section
65858, the City Council adopted an urgency interim ordinance (Ordinance No. 544) to
place a 45 -day moratorium on yard uses and to establish interim zoning provisions in
the commercial and industrial zones of the City of Irwindale pending the completion of
the zoning ordinance amendment process; and
WHEREAS, on January 13, 2000, the City Council adopted Ordinance No. 547
to extend the initial 45 -day moratorium by ten (10) months and fifteen (15) days on yard
uses and to establish interim zoning provisions in the commercial and industrial zones
of the City of Irwindale pending the completion of the zoning ordinance amendment
process; and
WHEREAS, on April 6, 2000, the Irwindale Planning Commission duly adopted
Resolution No. 338(00) recommending that the City Council adopt ordinance
amendments reducing the types of yard uses permitted by the Zoning Ordinance; and
WHEREAS, on November 30, 2000, the City Council requested that the Planning
Commission research this issue further to assure a consistent application of the
ordinance amendments in the Commercial and Industrial zones; and
WHEREAS, on February 6, 2003, the Planning Commission duly adopted
Resolution No. 397(03), which addresses the City Council's concerns and
Ordinance No. 571

recommended that the City Council adopt ordinance amendments reducing the types of
yard uses permitted by the Zoning Ordinance and requiring conditional use permits for
all yard and related uses.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: The following Sections or subsections of the Irwindale Municipal Code are
hereby repealed in their entirety:
17.32.015 entitled "Conditional uses", including subsection 17.32.015, A
thereunder.
17.36.015 entitled "Conditional uses", including subsection 17.36.015, A
thereunder.
17.40.015 entitled "Conditional uses", including subsection 17.40.015, A
thereunder.
17.44.015 entitled "Conditional uses", including subsection 17.44.015, A
thereunder.
17.48.015 entitled "Conditional uses', including subsection 17.48.015, A
thereunder.
17.80.030, at the following subsections, I, N, V, and AA, with all other
provisions of Section 17.80.030 remaining unchanged and in full force and
effect:
SECTION 2: Section 17.36.010 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
"17.36.010 Permitted Uses. The following uses, and no others, shall be
permitted uses in the C-1 zone:
1. Any use permitted in the C -P zone, subject to all the limitations and
restrictions imposed by Chapter 17.32, except as expressly
provided in this chapter;

SECTION 3: A new Section 17.36.015 is hereby added to the Irwindale Municipal Code
to read in its entirety as follows:
"17.36.015 Uses Reauirino a Conditional Use Permit. Because of
considerations of smoke, fumes, dust, odor, vibration, noise, traffic
congestion, or hazard, the establishment or operation of the following uses
in the C-1 zone shall not be permitted unless a conditional use permit
authorizing such use has been granted.
1. Parking lots, commercial; provided, that where such parking lots
are not to be enclosed within a building, and where such facilities
abut properties zoned for residential or agricultural uses, there shall
be erected a six-foot decorative masonry wall adjacent to the
^* property line between such parking lot and residential or agricultural
zone;

2. Restaurants, cafes and refreshment stands;
3. Tobacco stores."
SECTION 4: Section 17.40.010 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
"17.40.010 Permitted Uses. The following uses, and no others, shall be
permitted uses in the C-2 zone:
1. Those uses first permitted in the C-1 zone, subject to all the
limitations and restrictions imposed by Chapter 17.36, except as
expressly provided in this chapter;
2. Administration and professional offices;
3. Appliances, household sale and repair (no outside display);
4. Blueprinting and photocopying;
5. Clothing or wearing apparel;
6. Electrical supply;
7. Feed and grain stores, retail only; all operations to be conducted
within a completely enclosed building;
8. Frozen -food locker, retail only;
9. Furniture stores, new and used (no outside display);
10. Glass edging, beveling and silvering in connection with the sale of
mirrors and glass decorating furniture;
11. Libraries and reading rooms;
12. Medical and dental laboratories;
13. Motion picture films, processing;
14. Pawnshops;
15. Secondhand goods (all goods displayed, sold and stored within an
entirely enclosed building);

SECTION 8: A new Section 17.48.015 is hereby added to the Irwindale Municipal Code
to read in its entirety as follows:
"17.48.015 Uses Requiring a Conditional Use Permit. Because of
considerations of smoke, fumes, dust, odor, vibration, noise, traffic
congestion, or hazard, the establishment and operation of the following
uses in the C -M zone shall not be permitted unless a conditional use
permit authorizing such use has been granted:
1. Auction houses or stores;
2. Box lunch preparation, hours of operation to be approved by
planning commission;
3. Carpet cleaning plants, planning commission to approve noise
level;
4. Ceramic products manufacturing, including figurines, using only
previously pulverized clay and kilns fired only by electricity or low-
pressure gas;
5. Electric distribution substations, including microwave facilities;
6. Industrial emergency hospitals;
7. Market, public, wholesale and jobbers;
8. Motion picture studio (no outdoor sets);
9. Parcel delivery terminals;
10. Produce market, wholesale;
11. Public market, wholesale;
12. Testing laboratories;
13. Wiping rag storage, laundered only (no outside storage)."
SECTION 9: Section 17.52.010 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
"17.52.010 Permitted Uses. No person shall use any portion of any
property zoned M-1 within the city, except for such uses as are permitted
by this chapter. The following uses shall be permitted in the M-1 zone:
1. Any use permitted in the C -M zone, subject to all the limitations and
restrictions imposed by Chapter 17.48, except as expressly
provided in this chapter;

SECTION 10: Anew Section 17.52.015 is hereby added to the Irwindale Municipal Code
to read in its entirety as follows:
"17.52.015 Uses Reauirinq a Conditional Use Permit. Because of
considerations of smoke, fumes, dust, vibration, noise, traffic congestion,
or hazard, the establishment and operation of the following uses in the M-
1 zone shall not be permitted unless a conditional use permit authorizing
such use has been granted:
1. Acetylene; storage of oxygen and acetylene in tanks if oxygen is
stored in a room separate from acetylene, and such rooms are
separated by a not less than one-hour fire-resistant wall;
2. Automobile assembly, body and fender works, and used parts
storage when operated and maintained wholly within an entirely
enclosed building;
3. Automobile painting, providing all painting, sanding and baking
shall be conducted wholly within an enclosed building;
4. Batteries, manufacture and rebuilding;
5. Boat building;
6. Cleaning and dyeing establishments, wholesale;
7. Creameries and dairy products manufacturing;

8. Engines, manufacture of internal combustion or steam engines; this
subsection does not permit a foundry;
9. Fish hatcheries;
10. Flour mills;
11. Manufacturing, including processing and storage, of food products
of animal and/or fish origin:

13. Hatcheries, and sale of baby chicks;
14. Hay barns;
15. Iron, ornamental iron works, but not including a foundry;
16. Metals, manufacture of metal:

SECTION 11: Section 17.56.010 of the Irwindale Municipal Code is hereby amended in
its entirety to read as follows:
"17.56.010 Permitted uses. No person shall use any portion of any
property in a M-2 zone, except as permitted by this chapter. The following
uses shall be permitted uses in the M-2 zone:
