HomeMy WebLinkAbout583ORDINANCE NO. 583 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE REPEALING ORDINANCE NOS. 496 AND 579 AND DIRECTING THAT GENERAL MUNICIPAL ELECTIONS OF THE CITY OF IRWINDALE BE HELD ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF ODD -NUMBERED YEARS A. RECITALS (i) Pursuant to the provisions of the California Government Code and City Council Ordinance No. 496 adopted on February 23, 1995, the general municipal elections for the City of Irwindale presently are held on the first Tuesday after the first Monday in March in each odd -numbered year. (ii) On April 20, 2004, the City Council adopted Ordinance No. 579, amending Ordinance No. 496 to require its general election to be held on the first Tuesday of March in each even -numbered year. (iii) By letter dated June 16, 2004, the County of Los Angeles rejected the City's action under Ordinance No. 579, thereby requiring that the City Council reconsider its decision regarding the appropriate date for the e^+ City's general municipal elections. f (iv) California Elections Code §1301(b) provides that a city council may enact an ordinance requiring its general municipal election to be held on alternate election dates, as specified in said ordinance. (v) Pursuant tck Elections Code § 1301(b), the City Council desires to cause the municipal elections for the City of Irwindale to be held on the first Tuesday after the first Monday in November of odd -numbered years in order to realize a savings of city resources, both monetary and staff time, through consolidating its general municipal election with the County of Los Angeles. (vi) All legal prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Irwindale hereby does ordain as follows: (i) The City Council hereby finds that the Recitals, at Part A of this Ordinance are true and correct. Ordinance No. 583 Page 1 (ii) The City Council hereby repeals in their entirety Ordinance No. 496 adopted on February 23, 1995 and Ordinance No. 579 adopted on April 20, 2004. (iii) The City Council hereby directs that general municipal elections of the City of Irwindale shall be held on the first Tuesday after the first Monday of November in each odd -numbered year. (iv) The City Council hereby directs that pursuant to Elections Code § 10403.5, the general municipal elections of the City of Irwindale be consolidated with the Los Angeles County -conducted elections to coincide with the Uniform District Election Law ("UDEL") date, and that pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Los Angeles is hereby requested to consent and agree to the consolidation of a general municipal election of the City of Irwindale with the UDEL date. (v) The City Council further directs that the County Election Department is authorized to canvass the returns of the general municipal election of the City of Irwindale. The elections shall be held in all respects as if there were only one election, and only one form of ballot shall be used. The Board of Supervisors is requested to issue instructions to the County Election Department to take any and all steps necessary for the holding of the consolidated election. The City will reimburse the County pursuant to Elections Code § 10002. (vi) Those elected officers of the City of Irwindale whose terms of office would have, prior to the adoption of this Ordinance, expired following the March 2005 general municipal election, shall, instead, continue in their respective offices until no later than the third Friday after the November 2005 general municipal election of the City of Irwindale in accordance with Elections Code § 10403.5. (vii) Those elected officers of the City of Irwindale whose terms of office would have, prior to the adoption of this Ordinance, expired following the March 2007, general municipal election, shall instead, continue in their respective offices until no later than the third Friday after the day of the November 2007 general municipal election of the City of Irwindale in accordance with Elections Code § 10403.5. (viii) Pursuant to the Charter of the City of Irwindale, at section 601, the City Council shall elect one of its members to be the Mayor at the regular council meeting at which the canvass of the results of the general municipal election shall be conducted, and in even -numbered years at the first regular meeting of the Council held in November. (ix) The Deputy City Clerk is hereby directed to: (a) Cause this Ordinance to be posted in the manner required by law; and (b) Notify the County Board of Supervisors of this Ordinance for approval of consolidation forthwith. Thirty days after approval by Ordinance No. 583 Page 2 the County Board of Supervisors this Ordinance shall become operative. (c) Within thirty (30) days after this Ordinance becomes operative, cause a notice to be mailed to all registered voters in the City of Irwindale informing them of the change in the general municipal election date effected by this Ordinance, which notice shall be in accord with the requirements specified in California Elections Code §1301.
