HomeMy WebLinkAbout587ORDINANCE NO. 587 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE, CALIFORNIA, APPROVING ZONE CHANGE NO. 1-04 ZC, CHANGING THE CURRENT ZONING DESIGNATION FROM M-2 (HEAVY MANUFACTURING) TO C-2 (HEAVY COMMERCIAL) ON PROPERTY LOCATED AT 15744 ARROW HIGHWAY; AND GENERAL PLAN AMENDMENT NO. 1-04 GPA, CHANGING THE CURRENT GENERAL PLAN LAND USE DESIGNATION FROM INDUSTRIAL TO COMMERCIAL ON PROPERTY LOCATED AT 15600, 15700, AND 15744 ARROW HIGHWAY WHEREAS, the City of Irwindale (the "City") is requesting that the existing Zoning designation of M-2 (Heavy Manufacturing) be changed to C-2 (Heavy Commercial) on property located at 15744 Arrow Highway; and that the existing General Plan land use designation of Industrial be changed to Commercial on property located at 15600, 15700, and 15744 Arrow Highway; and WHEREAS, the subject property is more specifically identified as AP# 8417-027- 007, AP# 8417-027-008, and AP#8417-027-005;and WHEREAS, the subject property located at 15744 Arrow Highway is currently zoned M-2 (Heavy Manufacturing); and WHEREAS, the M-2 zoning designation allows an industrial use; and WHEREAS, the retention of the M-2 zoning designation could create land use incompatibilities, after the development and occupancy of an industrial use in the future, between the subject property and the surrounding commercial uses; and WHEREAS, the City (the "Applicant") proposes a zone change for the subject property located at 15744 Arrow Highway from the current M-2 (Heavy Manufacturing) to C-2 (Heavy Commercial); and WHEREAS, Section 17.84.010 of the Irwindale Municipal Code allows for the change in the zoning designation of any property 'whenever the public interest and necessity so require;" and WHEREAS, the proposed zone change is in the public interest since the approval of the proposed zone change will preclude future land use incompatibilities with their resulting detrimental impacts on the environment and property values; and WHEREAS, the current General Plan land use designation for the subject property located at 15600, 15700, and 15744, Arrow Highway is Industrial; and Ordinance No. 587 Page 1 WHEREAS, the Industrial land use designation allows an industrial use; and WHEREAS, the retention of the Industrial land use designation on property located at 15744 Arrow Highway could create land use incompatibilities after the development and occupancy of an industrial use in the future, between the subject property and the surrounding commercial uses; and WHEREAS, the retention of the Industrial land use designation on property located at 15600 and 15700 Arrow Highway would be inconsistent with the zoning designation, which is C-2 (Heavy Commercial); and WHEREAS, on October 7, 2004, the Planning Commission duly adopted Resolution No. 431(04) PC recommending that the City Council adopt Negative Declaration No. 12-04 ND pursuant to the California Environmental Quality Act (CEQA), and adopt an ordinance approving the proposed Zone Change and General Plan Amendment; and WHEREAS, this City Council has heretofore conducted a duly noticed public hearing, as required by Law, concerning the potential adoption of this Zone Change and General Plan Amendment and said public hearing was concluded prior to the adoption of this Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Negative Declaration is hereby adopted and the City's Zoning Map is hereby amended to reflect the approval of the requested Zone Change from M-2 (Heavy Manufacturing) to C-2 (Heavy Commercial) on property located at 15744 Arrow Highway; and the City's General Plan Map is hereby amended to reflect the approval of the requested General Plan Amendment to change the land use designation from Industrial to Commercial. SECTION 2: The Deputy City Clerk shall certify as to the passage and adoption of this Ordinance. SECTION 3: The Deputy City Clerk shall forthwith transmit a certified copy of this Ordinance, by certified mail, to the Applicant at the address of record set forth in the Application.
