ORDINANCE NO. 591
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE,
CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 2-04 GPA,
CHANGING THE CURRENT GENERAL PLAN LAND USE DESIGNATION FROM
COMMERCIAL TO RESIDENTIAL ON PROPERTY LOCATED AT
4812 AND 4922 IRWINDALE AVENUE
WHEREAS, the City of Irwindale (the City) is requesting that the existing
General Plan land use designation of Commercial be changed to Residential on
property located at 4812 and 4922 Irwindale Avenue; and
WHEREAS, the subject properties are more specifically identified as AP# 8417-
033-017, AP# 8417-033-008, and AP#8417-03-009; and
WHEREAS, the current General Plan land use designation for the subject
property located at 4812 and 4922 Irwindale Avenue is Commercial; and
WHEREAS, the Commercial land use designation allows a Commercial use; and
WHEREAS, the retention of the Commercial land use designation on property
located at 4812 and 4922 Irwindale Avenue could create land use incompatibilities after
ro*�l the development and occupancy of a commercial use in the future, between the subject
property and the surrounding residential uses; and
WHEREAS, the retention of the Commercial land use designation on property
located at 4812 and 4922 Irwindale Avenue would be inconsistent with the zoning
designation, which is R-1 (Single -Family Residential); and
WHEREAS, on April 7, 2005, the Planning Commission duly adopted Resolution
No. 437(04) PC recommending that the City Council adopt an ordinance approving the
proposed General Plan Amendment; and
WHEREAS, this City Council has heretofore conducted a duly noticed public
hearing, as required by Law, concerning the potential adoption of this General Plan
Amendment and said public hearing was concluded prior to the adoption of this
Ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Pursuant to the authority and criteria contained in the California
Environmental Quality Act (CEQA) and the CEQA Guidelines of the City of
(O`N Irwindale, the Lead Agency has determined that the proposed project is
exempt from the California Environmental Quality Act (CEQA), pursuant to
Ordinance No. 591

Class 32 (In -Fill Development Projects), Section 15332 of the CEQA
Guidelines; and the City's General Plan Map is hereby amended to reflect
the approval of the requested General Plan Amendment to change the
land use designation from Commercial to Residential.
SECTION 2: The Deputy City Clerk shall certify as to the passage and adoption of this
Ordinance.
SECTION 3: The Deputy City Clerk shall forthwith transmit a certified copy of this
Ordinance, by certified mail, to the Applicant at the address of record set
forth in the Application.
PASSED, APPROVED, AND ADOPTED this 17th day of May 2005.
