AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE,
CALIFORNIA, APPROVING ZONE CHANGE NO. 2-05 CHANGING THE ZONE
DESIGNATION FROM C-3 (HEAVY COMMERCIAL -RESIDENTIAL) TO R-2 (LIGHT
MULTIPLE -RESIDENTIAL) FOR PROPERTY LOCATED AT
5135 IRWINDALE AVENUE (A PORTION OF ASSESSOR'S PARCEL NO.
8417-028-901 AND ASSESSOR'S PARCEL NO. 8417-028-902)
WHEREAS, the City of Irwindale (the "City") is requesting that the existing
zone designation of C-3 (Heavy Commercial -Residential) be changed to R-2
(Light Multiple -Residential) for property located at 5135 Irwindale Avenue (a
portion of Assessor's Parcel No. 8417-028-901 and Assessor's Parcel No. 8417-
028-902); and
WHEREAS, the subject property has a current zone designation of C-3 (Heavy
Commercial -Residential) and R-2 (Light Multiple -Residential); and
WHEREAS, the retention of the C-3 zone designation on a portion of the
property located at 5135 Irwindale Avenue would continue inconsistent zoning on the
site (currently both C-3 and R-2). If the entire property was designated R-2, it will
preclude incompatibilities between the current C-3 zone designation on a portion of the
subject property and surrounding residential properties fronting Hidalgo Street; and
WHEREAS, on March 2, 2006, the Planning Commission duly adopted
Resolution No. 469(06) PC recommending that the City Council adopt an ordinance
approving the proposed Zone Change; and
WHEREAS, this City Council has heretofore conducted a duly noticed public
hearing, as required by Law, concerning the potential adoption of this Zone Change and
said public hearing was concluded prior to the adoption of this Ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: The City's Zoning Map is hereby amended, changing the zoning
designation for the subject property from the current C-3 (Heavy
Commercial -Residential) to R-2 (Light -Multiple Residential).
SECTION 2: The Deputy City Clerk shall certify as to the passage and adoption of this
Ordinance.
SECTION 3: The Deputy City Clerk shall forthwith transmit a certified copy of this
Ordinance, by certified mail, to the Applicant at the address of record set
forth in the Application.
