AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE
AMENDING THE IRWINDALE MUNICIPAL CODE TO ADD A NEW
SECTION 10.28.190 PROHIBITING OVERNIGHT PARKING IN
PUBLIC PARKING LOTS
WHEREAS, the City Council of the City of Irwindale is informed that the
overnight parking of vehicles on publicly owned property, including those owned
by the City of Irwindale and the Irwindale Community Redevelopment Agency,
has become an increasing problem, requiring police resources in the monitoring
of any potential illegal activities and vandalism;
WHEREAS, the City of Irwindale is authorized by the California Vehicle
Code, at Section 22519 to prohibit, restrict or regulate the parking, stopping or
standing of vehicles on any offstreet parking facility which it owns or operates,
provided appropriate signage is installed giving notice thereof; and
WHEREAS, by this Ordinance, the City Council wishes to prohibit the
overnight parking of vehicles on public property, including property owned by the
City of Irwindale or the Irwindale Community Redevelopment Agency.
NOW, THEREFORE, the City Council of the Irwindale does ordain as follows:
SECTION 1. Title 12 of the Irwindale Municipal Code is hereby amended
to add a new Section 10.28.190 to read in its entirety as follows:
10.28.190 Overnight parking restricted on public parking lots.
It is unlawful for any person to park any vehicle in any public
property owned by the City or Irwindale Community Redevelopment
Agency for a period of time longer than thirty minutes between the
hours of twelve midnight and five a.m., which parking lot has been
posted as an area in which vehicles may not be stored overnight
with a sign that identifies this section and that a violation hereof
shall constitute an infraction, punishable by a fine pursuant to
Section 1.12.020 of the Irwindale Municipal Code. Such prohibition
shall apply to the property so designated once posted in plain view
at all entrances to the property, and on a sign which is not less than
seventeen inches by twenty-one inches in size with lettering not
less than one inch in height. The provisions of this section shall not
be construed to prohibit persons from engaging in organized
special events conducted and scheduled by, or with the duly -issued
written approval of, the city. Moreover, the city may authorize its
employees or agents or other persons, on a case by case basis, to

park a vehicle in a city parking lot overnight. Any vehicle that is
authorized to park in a city parking lot overnight must display a valid
permit on its dash board. Such permit shall be issued by the
Irwindale Police Department and shall authorize a specific vehicle
(identified by color, make and model) to park overnight in a
specified public lot on a specified date. Failure to properly display a
permit may result in the issuance of a citation for a violation of this
section.
SECTION 2. If any Section, Subsection, sentence, clause, phrase, or
portion of this Ordinance is, for any reason, held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this Ordinance. The City Council of
the City of Irwindale hereby declares that it would have adopted this Ordinance
and each Section, Subsection, sentence, clause, phrase, or portion thereof,
irrespective of the fact that any one or more Sections, Subsections, sentences,
clauses, phrases, or portions thereof may be declared invalid or unconstitutional.
SECTION 3. The Deputy City Clerk shall certify to the passage of this
ordinance and cause the same to be posted in the manner provided by law.
