HomeMy WebLinkAbout618NOT ADOPTED ORDINANCE NO. 618 A JOINT ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AND IRWINDALE RECLAMATION AUTHORITY APPROVING AND ADOPTING THE IRWINDALE TECHNICAL ADVISORY COMMITTEE AS THE OFFICIAL ADVISORY BODY TO CITY AND AUTHORITY STAFF ON MATTERS RELATING TO THE PROPER RECLAMATION OF MINING QUARRIES WITHIN THE JURISDICTION OF THE CITY OF IRWINDALE WHEREAS, the City of Irwindale ("City") has regulatory oversight responsibilities and is lead agency for several mine quarries and inert landfill operations within its jurisdiction pursuant to the provisions of the California Surface Mining and Reclamation Act of 1975 and implementing State Mining and Geology Board Reclamation Regulations (collectively "SMARX), and City's Charter and Municipal Code; and WHEREAS, the Irwindale Reclamation Authority ("Authority") is a joint powers authority created to receive and reassign, for the purposes of complying with the California SMARA and the operating rights from each of the mining company participants to the Authority and to provide a financial assurances mechanism under SMARA for certain of the quarries located in the City of Irwindale; and WHEREAS, City has adopted various ordinances, Charter provisions, land zoning, zoning overlays and technical guidelines to regulate these operations, and has approved site specific conditional use permits ("CUPS"), development agreements and other agreements addressing specific procedures for the mining and reclamation of the quarry sites and for the backfill of such sites using inert debris landfills to create industrial, commercial and retail development sites; and WHEREAS, the City has formed the Irwindale Technical Advisory Committee ("ITAC"), composed of consulting technical professionals, to assist the City in the technical oversight and assessment of ongoing mine quarry and landfill operations, review and analysis of technical quality control and quality assurance procedures and Ordinance No. 618 Page 1 documentation, assess compliance with regulations, guidelines, CUPs, development agreements and other agreements, and to review, analyze or proposes new methods of assuring the quarries are appropriately reclaimed and the landfill sites are developable without geotechnical restraints (collectively "Reclamation Oversight Work"); and WHEREAS, the City, at the direction of the Public Works Director and City Manager, has retained the professional services of certain geologists, geotechnical engineers and other professional engineers to assist the City regarding the Reclamation Oversight Work and wishes to designate the ITAC as the official technical advisory body to the City's Public Works Director on issues concerning the Reclamation Oversight Work. NOW, THEREFORE, the City Council of the City of Irwindale and Board of Directors of the Authority do hereby determine as follows: Section 1. The recitals contained hereinabove are true and correct. Section 2. The ITAC is approved and adopted as the official technical advisory body to advise the City's and Authority's Public Works Director/City Engineer on issues concerning the Reclamation Oversight Work. The Public Works Director, with approval of the City Manager, shall be authorized to select the members of the ITAC. Section 3. The Deputy City Clerk and Authority Assistant Secretary shall certify to the passage and adoption of this Ordinance and the same shall thereupon take effect and be in force. H.
